    No. You must apply for removal of conditions (ROC) form I-751 first, you can’t bypass this step. 
     

    When he’s eligible, he can apply for citizenship even if I-751 is still pending.

     

    From what you described it seems like he can apply for citizenship in 2025. Under the 3 year rule, you must be married to a US citizen AND be a lawful permanent resident for 3 years (so you have to count after he had his I-485 approved, not when he came to the US on K1).

  2. Hello, 
    My husband came in Sept of 2021 to US via K1 visa, we got married right away, 10 days after he arrived, but his green card didn't arrive until May of 2022. It is expiring in May of 2024, and I don't think he can apply for citizenship yet. Do we have to extend the green card first, and then couple months after he can apply for citizenship or is there a change we can apply for citizenship instead of renewing the green card?

    Happy to share my husband got a notice his EAD is in the makings! 
    Hopefully we receive it in the mail soon, along with SSI and a notice for GreenCard interview is shortly after.

     

    Happy to see that things are moving for others too! We can all finally relax and start living more freely

    Still waiting for my husband EAD and Green Card. We also filed in October 2021, Biometrics done November 12th, and still nothing. We filled to Chicago Lockbox, but our NOA say National Benefit Center. He wasn't able to get a Social Security nor Driver License, just waiting around.

    You can also file your taxes Married Filing Separately and for his SSN write in NRA (Non Resident Alien) by hand on a printed out return. You would get rejected by efile with nothing in that SSN space so you would have mail the return printout you hand wrote on. He would not have to file at all since he has earned no income since his arrival. You can’t write NRA for a joint return.
     

    Filing jointly usually gives you a better deal because you get an extra standard deduction for him. But if your income is less than $25,100. It’s probably not really going to benefit you to file jointly. Those that get a big tax break from the extra standard deduction often just amend their return later to pick up their extra refund. He will not qualify for the recovery rebate credit on an amended return unless he had his SSN before the filing deadline in April (or Oct if you apply for an extension.)

    I guess I'll just wait and hope it he gets EAD and SSI by October, so we can file Jointly. 

     

    And if he doesn't get it by October, I'll file it separately and write NRA.

    I am getting ready to file taxes and I have a question. 
    My husband came on K1 visa and we got married. 
    He is currently waiting on AOS without Social Security(they wouldn't give him one, and told him to wait until he gets EAD). We applied for SSI on his AOS.

    He is not working and doesn't have no income. 

    I was told that I(U.S citizen) have 2 options: 
    To file for ITIN for my husband, so we can file our taxes. This option is, of course, a waiting game as well, like everything right now. 

    Or, 

    my second option is to file an extension for filing taxes. 


    Is anyone here in a similar/same situation? 

    My thought is to file for extension, and by October 15,2022 he should receive his EAD/Social Security and we can file like a married couple. But then again, who knows? 
    Or should we apply for his ITIN regardless?

    my husband doesn't have US driver license ye and we have my company's holiday party. 
    My thoughts are he can still travel within US with a valid foreign passport even though he's in the pending status, waiting on EAD and Green Card(we just submitted the paperwork in October and got married in September). I'm reaching out to double check if he should be okay traveling?(we plan on bringing all the paperwork:marriage license, Notices from USCIS along).

  8. Thank you! I wasn't aware of the time limit for applying especially now during Covid. 
    We were initially put on the waiting list but they never called us back and in the meantime we submitted AOS and check option for SSI but we thought giving it another try wouldn't hurt. 
    We actually managed to get an appointment on Monday for me to change my last name and for him to get his # 

  9. Hey guys, 
    We've sent out AOS for my husband in October and checked the option for them to issue a Social Security Card since there were no available appts any time close when we arrived. 
    Did anyone else did the same thing? Does anyone know approximate waiting time to get Social Security Card? 

    We've received response for the EAD that they're actively working on it. And they've asked for 1 additional document for the Green Card form

     

    We are trying to stay patient but with this Covid situation many things are almost impossible to do in timely manner.

  10. Hi guys, 
     

    I'm a bit confused on how to fill out the question for the income. 
    I've recently started a new job(there was no days of in between previous and new job). Started 3 weeks ago, had my first paycheck couple days ago.
    I have a job offer letter stating my new salary. And I still have my part time job on a side(since 2019)
    I do have my tax return from 2020, which states Federal adjusted gross income(This return included my previous job salary + my part time jobs ) 
    Do I put the current salary only? Or do I put the last year tax return gross income?

  11. Who else is still waiting for any movement at NVC. Our case has been stuck from July 2020 and nothing. 
    Our embassy in Belgrade, Serbia is processing K1 visas since January

     

    I have been trying to call NVC for the past 2 days and I am unsuccessful. It's either busy line so it gets disconnected or I'm on hold for more than an hour.

    Ja sam americki drzavljanin i zvala sam NVC, tada sam dobila i broj slucaja. Mislim da je ipak problem u nasoj ambasadi i brzini njihovog rada.

    I'm on the call with them right now, this is the first time calling. It's been 70days since we got NOA2 approval and I'm getting anxious. 
     

    After an hour on hold I finally got our case number and invoice. The lady at NVC said it's currently processing... 
    When tracking the case it says the next step is DS-160 but isn't that required after the embassy reaches out to the beneficiary? 

    I know I'm probably overthinking it, but I just want this waiting game to be over with :)
