    As someone who had recently gotten an expedite request approved I would say it worth trying. Just make sure to include valid evidence. The good thing about expedite requests is that whether or not it get approved it will not affect further processing of your case. Good luck !

    For Part 5 question regarding previous petition filed, I had filed for a fiance visa years ago from obviously my ex fiance who lives in Japan. The k1/fiance visa was approved but she never came to the US. I already forgot the date it was approved (atleast 7 years ago) Can I leave the date section blank and explain on Part 9 additional information about I don’t recall the exact date? Also forgot the city and state but must’ve been texas lockbox if I were to guess.

    This would be a yes. You filed a petition regardless of not fully going through with the process.  You can estimate the month and year that you submitted the petition. At least that’s what I did in my case being previously married and filed a petition for my ex-husband. USCIS approved my current husband’s case and we are almost at the end of our case.

    I recently found out that my mother might have metastatic cancer and things aren't looking to good right now.  She has multiple fractures in her pelvis and can barely walk.  My mother will find out the results through a biopsy this week.  I am looking for the best way to bring my wife to see my mother as this a very serious situation.  

     

    Right now I'm trying to plan this out ahead of time and weigh my options. Any advice or help would be appreciated on how to approach this situation.

    Hello, 

    You can try the expedited route just as long as you can provide strong evidence with supporting documents. My husband and I cr1 case recently got approved for expedited processing in the NVC stage because our daughter is having surgery in October. I provided photo evidence of her condition as well as progress notes from our doctors visit with the recommendation for surgery and her surgery date. Our request got approved within a week, and our case was forwarded to the US embassy in my husband’s and I country, my husband is scheduled for interview September 1st. Again provide as much evidence as you can. Good luck 👍🏽

    My husband’s case is currently at NVC; however, our four month old baby has been diagnosed with droopy eyelids and needs surgery to lift his eyelids to prevent further vision issues. Will I be able to request for my husband’s case to be expedited so that he can be present for our baby’s surgery? Thanks for your assistance! 🙏🏽

    If I may ask what is preventing you from filing your 2021 taxes now? I’m going through the same process and I have filed 2021taxes already and my lawyer is in the process of submitting all the documents to NVC. If you can file now to save unnecessary waste of time with NVC

    Are you the petitioner, if so, your husband can mention it during the interview. If i864 is already submitted by the time the child is born, prepare another i864 as the household number gets increased after the child is born.

  7. Hello guys, 

    my husband’s I-130 got approved recently on 02/26 and we received the case creation letter from NVC today 03/01. I am currently pregnant and will be having our baby next month and for that reason I have plans of paying the fees and submitting all required documents to NVC. The only issue is the DS-260 form has a question about whether my husband has a child which would be yes if we submit the documents after our child is born in April, but I will be submitting no later than March ending, so it will be a no. Would we be able to update this information after our child is born?

    Lol...to your statement that many members marry during an international trip and are broke when they return. That was exactly my situation when I got back from marrying my partner in my country which is even worst considering me giving money out to relatives. We got married in December and even though I planned  on submitting the filing upon returning to the US in January,  I couldn’t because of the bills that I had to take care off. However I just submitted my documents to a lawyer who will be helping me out with the process because my ex-husband and I already went through the process before as he was in the US on a student visa. I felt that legal assistance along the way maybe necessary for this second filing.

    First, the I-130 asked if you petitioned, not sponsored, somebody before.  If you know the month and year, that's good enough, but it's the date you filed the I-129f petition, not the date you filed the I-485.  Just enter the first day of the correct month and year, as best you can.

    Thanks for explaining the difference between the two. I didn’t file I-129f for my ex husband. We met and got married while he was in the US on a student visa. So we filed an AOS

    I will be filing for my current fiancé when we do get married hopefully at the end of the year. I have been married before, and I sponsored my ex-husband, but I don’t remember date that we submitted the adjustment of status (AOS) application. There is a question on I-130 that asks whether you have sponsored someone before and asks to provide the date. I remember the month and year, but not the exact day. I have pleaded with my ex husband to provide it to me, but he denies having it which I think is a lie. Our marriage ended bad because he didn’t want the divorce even though he was unwilling to make the marriage work for me. Has anyone been through a similar situation? If yes, what did you do to overcome the issue?

    Personally I would advise you do a CR1 instead not just because of the prioritisation of spouses. Although it takes longer it is hardly refused..based on the peculiarities of your case (you met him while you still married) k1 might be tough....CR1 has no such requirements for number of times you have met...they just require than you both married in good faith and combine your resources ( which can be done from a distance) eg owning a property together or being on each other's life insurance etc.

    Sounds great 👍🏽! Thanks a lot! I feel much better now knowing that there is no requirement on the amount of time spent before getting married. I have a lot of proof of ongoing relationship and talks with not just him but his siblings as well as him with my father and sister. But I was still worried about the part of not being together before marriage after our initial meeting in June. Thanks again 😊!

  12. Hello everyone, 

    I first met my now fiancé in my home country, Sierra Leone June 2019, at that time I was married to my previous husband. It should be noted that I sponsored his AOS as we met and married while he was on a student visa. In total we were married for a little over 4 years before the divorce. I returned from my trip from Sierra Leone July 2019 and filed for divorce from my ex-husband due to marital issues and me being tired of fighting for our marriage alone. My ex husband and I officially divorced in September 2019, and I continued a long distance relationship with my now fiancé. I made plans and bought a ticket to visit him in April 2020; however the trip was cancelled due to COVID-19. I was planning to visit him this August 2020 as soon as international flight resumes for my country, but I am now reconsidering this plan as I would like to take the CR1 route due to factors of my fathers declining health and the prioritization of us citizens spouse and children visa and not knowing what the future holds with K1 visa processing. I am now planning to travel to Sierra Leone and get married to my now fiancé this December 2020, so at this point we will have no time spent except for the six weeks that I am planning to spend during my wedding trip. I do plan to file a CR1 visa as soon as I return from getting married and I plan on making trips to Sierra Leone at least twice a year until my then husband joins me in the US. With this being said, do I have a good chance of an approval based on your experiences this site? Thanks for your input 😊

    Thank you all for your input which has aided in the decision we are going to take. My fiancé and I have made the decision that I will visit him again before filing for the k1 visa. We are not going the spouse route because it takes long, and there are no guarantees of him getting a visa to visit me here in the US. I appreciate each and everyone of you for your help 😊

    It is not a reason for denial of the petition.

    it is not a sole reason for refusal of the visa. It can be a consideration by the CO if the relationship is genuine.

    As I've posted above, we met in the UK while my now wife was still (unhappily) married. She separated soon afterwards, and I visited her in the US a few months after that. Its not an issue with USCIS. It has no bearing on whether the meeting in person requirement is fulfilled, and no bearing on whether the relationship is real or not (in many ways, it tends to suggest its more real - if you were going to make up a history, you'd probably not use such dates).

    USCIS requires that you're legally able to get married at the point you file the k1, not at the point you first meet your partner.

    Technically the requirement for the K visa is showing you met with in the last 2 years. But in order to be approved you need to show its a valid relationship (and not for immigration purposes). Many people date after separating but before a final divorce decree. But you need to step back and look at all the dates on a timeline and see how they fall. Also when did your ex get his greencard in relation to the divorce dates? 

    Hello, thanks for your input, the divorce was filed after I returned back from my country. My ex-husband and I had issues during the most part of our marriage and had even separated at the beginning of the marriage. I had asked him for a divorce, but he convinced me that he will do better so we continued with the marriage. The breaking point was when my ex-husband didn’t call me during the duration of my trip in my country which was 30 days, we only talked when I would call him. I came to the conclusion at that time that I will file for a divorce upon my return. Shortly there after I met my now fiancé. I filed for the divorce after returning to the US on 07/23/19 and it was finalized on 09/12/19. 


    My ex-husband obtained his conditional green card early 2015 and regular green card beginning of 2018. And we had just submitted the N-400 a month before I left for my trip to my country June 15th.

    Regarding the advice of meeting after filing, it is useful for the second part of the process -the K1 visa interview-, but wouldn't help at all in the approval of the initial petition -the I-129f-.

     

    Your other choice is planning a wedding for the next meeting and filing for a CR1 visa.

    Thank you for the advice, I will take it into consideration. I am just wondering when we will be able to see each other again with the current situation we are in.

    Thank you, I thought as much. I have plans of front loading the application with call logs and texts, communications between him and I and also with his siblings. Hopefully with all that they can see that we are in a bonafide relationship despite the length of time.
