I-751 Questions
mam521 replied to llcoolwil's topic in Removing Conditions on Residency General Discussion
All a matter of opinion, my friend 😉. Some couples get on well with shared bank accounts; others do not. It's easy to forget you have all of these other things because you're like "duh...that's just what people do"...because, well, you're in a real relationship 🙂. When it's legit, you take for granted the "obvious" things. Happy to hear you're feeling a bit of relief. You'll be fine! -
I-751 Questions
mam521 replied to llcoolwil's topic in Removing Conditions on Residency General Discussion
The house in both names is definitely a huge investment together! We don't have a joint bank account. I was only ever an authorized user. We listed each other on other important accounts like pension, 401k, life insurance, house insurance, vehicle insurance, health insurance. Are your other accounts listing one another as beneficiaries? I'm a citizen now, so it must have been enough . I filed under the 3 year provision, too, and they still gave it to me. I wouldn't worry too much! -
Big hugs, Friend. Big hugs. ❤️

As mentioned above, you will need to go through the visa process to enter Canada, the same as a foreigner needs one to enter the US. Which visa type will depend on the circumstances by which you'd qualify to enter Canada. USMCA visa (TN equivalent for Canadians who work in the US) may work if you are able to secure employment in Canada in an eligible field that meets the requirements. If you are in one of those fields, does your current employer have a Canadian division that you could transfer with?

You should start a separate thread outside of this one. Baby needs proof of identity before you can bring them to the US. Have you already activated your greencards or you have the I-551's in your passport and are waiting to come to the US for the first time? This has a big impact on the correct path forward.

If you could fill out your profile, it would be a great help to the community: https://www.visajourney.com/timeline/profile.php?id=490476 The Department of State, who determine eligibility and issue visas processed at embassies and consulates, have the information regarding K-1 visas here: https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html . The important part is in blue - K-1 visas are a single use only visa. You enter the US, you must marry and file AOS within 90 days of that date of entry. You cannot leave or you invalidate that single entry visa. Additionally, the DOS lists the criteria for AVR here: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visa-expiration-date/auto-revalidate.html#:~:text=Nonimmigrants who departed the United,Departure Record%2C endorsed by DHS. and lists F, J and M visas, but not K visas. IMHO, I suspect it's going to be an extremely challenging sell to try and pitch AVR when it's clearly stated that a K-1 visa is a single admission into the US and the categories of AVR eligible visas are limited. Typically, if people leave before they marry and adjust status, they have to start at the beginning of the application process and go through the wait times as they did in the first place. In the e-mail you received from CBP, it says: You would be marrying and filing for an adjustment of status, thereby not intending to resume the same non-immigrant status. Apply and come back to the forum and let us know how you make out. I'm certainly interested!

Anyone has similar situation?

Please fill out your timeline: https://www.visajourney.com/timeline/profile.php?id=273349 Assuming your wife is completing consular processing, she will have to fill out her end of the paperwork (DS-260) for her and your child. You will have to fill out the Affidavit of Support (I-864) for each of them. There will be supplemental evidence required, including your last three years of US filed income tax. Once those conditions are met and approved, an interview invite will be sent and an immigration medical will be required. There is a guide here: -
@JeanneAdil provided the information to get an ITIN. This is a tax number for people who are not eligible for a SSN and works fine for bank accounts and income tax filings. Once the greencard or EAD are approved, then a SSN can be applied for. As for AOS, it may be soon that you hear something, @Dragonsarereal, but it may be another 6 months. USCIS are unpredictable and the current administration has definitely moved the goal posts a bit on how they want things vetted, etc. I'd honestly take the conservative approach and just apply for the ITIN. If it works out that the conditional permanent residency is granted sooner, excellent. If not, you're good to go.

Do you have a community page (FB, NextDoor, Ring, etc) where you can ask? Our local community FB page often has people posting their used moving boxes or others asking for. Quite common and the price is definitely right - $0.

Did your spouse ever go into the SSA after obtaining citizenship, certificate in hand, and update their citizenship status? That's something that has to be done in person and cannot be done online. That said, I had created an online SSA account prior to obtaining citizenship and had no issues. They mailed a security document to complete online sign up. Yes, it does have an expiration on it because it is a security verification document.

You have 2 options, essentially: 1. Marry, adjust status, stay put until you have Advanced Parole 2. Marry, leave and complete Consular Processing, which will have you away for 2+ years You can't have your cake and eat it too, unfortunately. You'll have to decide your priorities. Is it finishing up your assignment with your J1 and being with your partner or is it heading back to the UK to visit? If going back to the UK for Christmas is imperative but so is being with your partner, the closest thing to having your cake is to marry now, celebrate in October and cross your fingers and hope you get AP in time for December. If you don't get AP in time, plan to visit once it's been awarded.

It's always advisable to have the instructions, which are separate, open in another tab while filling this stuff out. -
Question on USCIS account
mam521 replied to MarmiteC's topic in Removing Conditions on Residency General Discussion
Biometrics can be changed, too. Honestly, you could probably show up with your letter in hand to the center and they'd do them early. Maybe you'll be lucky and they'll just reuse your biometrics and then it's a non-conversation. -
