As always, choices should be considered on a case by case basis. We had do go the K1 route because my fiancé couldn’t not get a B1/B2 to the US due to the Muslim ban and same sex marriage is illegal in his home country. We waited two years with me traveling back and forth every two or three months for two weeks to visit. I am able to work remotely. So we went K1. We still had to file Writ of Mandamus to get the answer. We were approved. Two weeks later he and our son were here and we married two weeks after that in January 2021. The AOS was filed and our appointment is scheduled for the end of May 2022.
Two things to note. The medical exam for the K1 is not valid past it’s expiry date. It had to be redone. We had both already had the two COVID shots so we’re were fine there. The exam cost $550 each for him and our son. We did not have the luxury of shopping around because the approved civil surgeons were either booked or would not do the exam for a child in the time frame between notice and interview. .
in October 2021 the rule changed and children over the age of five must now be fully vaccinated against COVID. We have a lawyer handling our application and they have been very thorough but the dropped the ball here in not telling us. There is less than 21 days between the exam/first shot and the interview so we will get an RFE for the medical for our son’s vaccinations. .
In short, K1 was the only way for us to go, the short warning about the interview made getting the medical difficult and the COVID vaccine requirement was a surprise. Fortunately we have been carefully compiling all the required evidence over the past year and are well prepared in that regard.
so get your COVID shots and avoid a time crunch which may result in an unnecessary RFE.

They tend to blame covid a lot. We were able to get an opening by getting my congressman involved. I know Beirut is very slow and only do interviews a couple mornings a week at this point. And none in the next two weeks due the the current shutdown that started today.

When we tried to schedule last year (pre covid) it took us a month to find an open slot.

The Embassy asked that the sole custody agreement be modified to add “May immigrate to and live indefinitely in the United States” which was done in August of 2019. My question is how long should it take to get the K2 completed? We haven’t much time since the clock on the now issued k1 is ticking. We effectively have only three months.

My fiancé’s K1 was presented to him on Friday 11/13 but we still have no answer on the K2. The visa is only good for four months so we are concerned that with Covid and all the upcoming holidays that the K2 might not be resolved in time. We waited a year after the embassy interview then filed Writ of Mandamus which got the case moving. How long after K1 approval has it taken to get the K2 answer? It isn’t possible for the boy to follow as he is only 7 and must travel to the US with us. My fiancé has sole custody and has since the joy was 19 months old.
How long after K1 does it take for the associated K2 to be completed? Have you ever heard of a K1 being approved and a young child K2 being denied?

I hope you are right. I have been told K1 is non-immigrant with immigrant intent so let’s hope it is exempt.

We have been in AP post interview in Beirut for 18 months.

Yes. The interview was in July and CEAC still says “ready to schedule interview” under immigrant status and “no status” under non-immigrant.

We received a call from the embassy in Beirut saying that my fiancé’s visa had been approved and requested to send the passport. We asked about the status of the associated K2 visa for my future stepson and were told that “it didn’t come” We asked why and were told that it comes from the US. My fiancé and his son both were interviews together (the boy is 5) this summer. We are concerned that the K2 May be denied but they have not yet told
us that. My fiancé has full custody and has had this since his divorce 5 years ago. He is concerned that the US embassy doesn’t want to accept his custody since it was determined in a Sharia court even though his ex-wife could have asked for custody if she wanted it. She did not want it.
Has anyone heard of a K1 being approved and the K2 not being approved concurrently?

The medical exam for the K1/K1 was more than two years prior to I-485 application due to the delay in the embassy adjudicating the case. The civil surgeon is the one that said he can not mark the form complete since the vaccination requirement is currently in effect.
in fact the case took
so long that the embassy required two medical exams in Lebanon.
