    Your husband can either file “married filing separate” (probably makes the most sense in your case and does not require you to get an ITIN but he can’t list you as a dependent either since you don’t have a SSN) or “married filing jointly”, which would require an ITIN (a little late to get that now as it takes some time) and would make your foreign income subject to US tax.

    Although your foreign earned income under 105’900 USD (changes each year but currently it’s 105’900 for 2019) can be excluded (you need to file a form for that exclusion of your foreign income though) but still needs to be listed.

    I've been doing a little of research and it seems getting an ITIN takes time. Do you think would be best to file Married but Separately?

    I have a question and I would like to ask for your advise.

     

    My husband and I are still waiting on our I-130 approval. He's about to fill his taxes but we have an issue. We got married last year (August 2019 - I'm still living in Mexico) and his tax guy is telling him is best to fill as single since I don't have a SSC yet but our immigration attorney is telling him to file as "married filing separate" - she's also saying we will need an ITIN. Do you know what's the ITIN number? Do you think we will need it?

    You have to log in to the myuscis account and there it has a tab I believe which is called my case and it says „in progress“ and above it has a date in orange. 
    I was searching for a screen shot online but didn‘t find one and hubby has the log in ☺️
    Maybe someone else can post one.

    If you go to myaccount.uscis.gov and login, you should be able to access your case status. There it will show you your submitted date and another more recent date which is the last updated date of your case. For mine it says February 23, 2020 with the status “In Process”. 

    Thanks for your help! I just created an account but I'm being asked for my access code. Do you know where do I get my access code? We only received the form "I-797C, Notice of Action" and I can't find the access code there.

    I'm glad to hear your wife is visiting. I also have a visa but I will have to renew it since it's expiring in February 2020. I wasn't sure about renewing it but my lawyer told me that I could still visit the U.S. with my tourist visa and also my job might require me to fly.
