I remember this happening to a couple of VJers a couple years back, but so much has changed since then. Back then, the I129F was eventually forwarded on to the correct service center from the incorrect one when they realized that they did not have an underlying I130 to match it with.

I am sure alot depends on the local office and their interview schedule and any possible backlog. But for anecdotal evidence look at my timeline and that of Eric-Pris, both with NYC as the local USCIS office. Eric-Pris filed for AOS 2008-07-23 and was approved 2008-12-10 without interview.
We applied 2008-05-23 and were approved 2009-05-13 after waiting for the interview to be scheduled and then waiting for the interview. From around the time when I applied, most cases not transferred to CSC were waiting more than 3-4 months for interview (though not necessarily as extreme as our 12 months). I am sure there were some extreme waits at CSC as well.
This happens regularly and is a good thing. Your case will likely be approved without an interview (saves loads of stress and time preparing and gathering docs.) It is also usually faster than having to wait for an interview.Is this new? My understanding was that this lengthens the wait.

The interview letter always asks for the I693 (its a standard form letter). It does not matter whether you sent the DS3025, the I693 full medical or the I693 with just the vaccination piece completed (or the I693a vaccination supplement which was last used more than a year ago).
We sent in I693a (which was still acceptable at the time of our submissions), but our interview letter said to bring a copy of the I693 medical. We went to the interview with a copy of the I693a and expected them to have and use the visa medical which was less than a year old at the time of submission. They never asked to see the vaccine supplement or anything related to the medical at the interview.
OP, you will probably be fine if you sent in the DS3025, its in your file along with the visa medical and it won't come up. In an abundance of caution, you might want to get the vaccines transcribed to the vaccine section of the I693 just in case to make sure you are prepared at the interview if they ask. If at the interview you find out that they lost your visa medical, then you will have to redo the full medical, but don't do that now.
Yes, I sent it in with the AOS. Having done three of the AOS filings myself, and seen so many others I cannot count approved the same way, I feel it was not "luck" The OP has not answered if the vaccination supplement was obtained or sent with the AOS which could have generated the request for the I-693 at the interview. If that is the case then YES they will need it. -
Definitely do not just send it in to USCIS. They will most likely not match it up to your file.
You will either get an RFE or an interview notice. Send it in if you get an RFE, or take it in for an interview.
If you don't do the biometrics, you can't get an EAD. So that is why you have not gotten the EAD. Since it has been more than 90 days since you applied for the EAD, you are outside the processing times for EAD, so you could INFOPASS for that and see if you can get your case moving.

Also are you sure that your lawyer didn't just send the DS3025 as you vaccination supplement instead of the I693 if all vaccines were previously completed?
If you didn't include a medical form (I-693 or DS-3025) with AOS, they will undoubtedly ask for it, either through RFE or at the interview (if you have one), there is virtually no chance they will approve you without one. So I would go to a civil surgeon and get the I-693 filled out.Thanks for the replies.
I believe the I-693 was included, but only the basic personal info was filled in. The vaccination supplement that I believe is required was not done. Should I go get it filled out and wait for the RFE or should I go get it filled and just send it to USCIS?
To me, though, I'm still unclear why USCIS has not responded and sent out another RFE for the vaccination or the EAD or anything really. If I got anything I would welcome it, so long as I knew the case was being looked at.

Sure, this is normal. Pending just means that they have not made a decision, which is normal because they just received the file and it is awaiting processing.

AOS sent July 13, 2009- I checked my AOS status online.. I got NOA1 yesterday and the current status of my AOS is Finger Print fee was accepted, receipt notice was mailed and case pending. what is pending means? im kinda worried about that... does anybody here experience pending case? Thanks! -

Finally after waiting for agonizing 7 months, I found out that my I130 and I129F have been approved last Friday, July 17th. I had called Vermont on numerous occasions but kept on getting the same old answers. Thanks to all for helping me and wish you all very good luck. Can somebody also explain what next to expect and my next course of action. -
We avoided travel while waiting for the interview. It turns out that we could have gone, but I wasted 2 weeks in December sitting around the house because I have to take my time, but I didn't want to plan a trip that we would have to cancel. The risk is too great, there is no way to know when you will have the interview or you will get the interview notice.
Hello everyone!In my signature, you can see the timeline with our application. Me and my husband are planning on going to Ukraine for a vacation, and because of issues with my husband's job, the only time available for us is in September. But I really worry about booking the tickets, because I don't know if they are going to schedule our interview for the green card during September. I read on this forum that it is not a good idea to reschedule your interview, so I want to make sure that we are in the U.S.
So I wanted to see if any of you know how to find out when the interview is going to be, so we can plan our trip better. Any feedback will be highly appreciated!

Has anyone else experienced this ?Rosie and I got her three letter and then a letter for her BIOMETRICS for July 1st in OMAHA NEBRASKA.
We did her Bios and were glad to see things starting to roll, we know this is a long waiting process.
BUT a week after her BIO's we recieved a LETTER stating that they were moving her FILING to CALIFORNIA to
speed up the process. I looked and it looks like a 6 months waiting list for her AOS (GREEN CARD) AP and AED.
So instead of a 3 month wait it looks like its turns into a 6 month wait.
Thank GOD ROSIE is already here. Thank GOD I have a great job and we don't ever need her to work but it would be nice for her future and to help the family a little back home.

To start the process for a CR1, you would file a I130 petition. Since you petitioned for a K3, you already did so for a CR1 (actually you probably did that first, then sent in the I129F with the I130 NOA1 to petition for a K3). If both petitions are approved and sent to NVC, make sure to follow up on the NVC mailings for the CR1, and to delay any consulate activity on the K3. That all.
They have about the same timelines now. In the past, the K-3 was much faster than the CR-1 however now they're within weeks of each other. The benefits of coming in on a CR-1 versus the K-3 are immense. With the K-3 once the person arrives in the US you need to apply for Employment authorization and for AOS. That costs about $1010 whereas with the CR-1 you basically pay $500 at the NVC and once the person arrives they are able to work right away.K-3 is just a hassle and will only save you about 2-3 weeks (maybe a month). I know that seems like forever right now, but it's worth it to just follow the CR-1 path. You started that when you submitted the I-130 and you will be notified by the NVC when it's time to pay the other fees prior to the interview being scheduled.

I have been on a couple of websites including USCIS trying to find the documents I will need to file the CR-1 but can't find anything. Are there any additional documents that I would need to file with the K-3visa? Is there an application for the CR-1 or do I just wait to hear back from USCIS in regards to the k-3?
You help is tremendously appreciated.

Medical must be within a year of when the I485 is received by USCIS. The processing and approval can happen after that 1 year point as long as it was received. That might be the situation that has you confused...
Am getting a little confused.I just read somewhere that someone did not have to get another physical, even though it has been over a year since their last one.
I can also remember reading that if the Work Authorization and Advance Parole has not already been filed, I can do that with the AOS for one cost. Has that changed? It use to be $1010.00 for all three.
(and no, we do not have my husband's WA or AP as yet

Also, if he did not need any additional vaccines after entering the US (that is, he got everything needed done in Peru and it is on his DS3025), many VJers have had success just sending in a copy of the DS3025 instead of getting it moved onto a I693.
We did the I693 transcription because my wife needed an additional vaccine.
hello all,my husband and I are compiling the papers for the AOS, and we have some questions.
About the I-693: Prior to coming to the United States he had a medical exam and vaccinations in Lima, Peru. They gave him the results in a sealed envelope and instructed him to give that envelope to immigration upon entry to the US, which he did. Does he now need another medical exam to accompany the I-693? Is that medical packed from his entry somewhere on file? (The medical exam took place sometime in March of this year and he entered the US on March 26th).
About the birth certificate: He has a copy of his birth certificate that was translated and notarized in Peru. Does it need to be notarized in the US? Or at all?

Since it's been less tham one year since his immigration medical in Peru he only is required to have his vaccination records and get any additional vaccinations transfered from the DS 3025 to a I-693 by a USCIS Designated Civil Surgeon. DCS will give him the I-693 in a sealed envelope to submit with the AOS application.
Dr. Arnold in Texas does it all for $30 by mail and fax. If you can't find a DCS in your area to do the transfer cheaper. I suggest using Dr. Arnold.
LOTS here on VJ have used him with good results.

we waited for almost 2 hours for a guy to deliver it to her house.. we were both on webcam.. she finally received it and everything is good.. "Your visa is approved, please bring your passport.. blah blah blah"...:thumbs:

I added my wife to my health insurance. It did not require an SSN. Call your HR/benefits department. Outside open enrollment, life events usually come with a 90 day window to make a benefits change.

The vaccination supplement is all you need in terms of medical. If all your vaccines were done at or before your physical, you can submit your DS3025 (vaccination report) with your AOS app. Or you can take the DS3025 to a Civil Surgeon to have the vaccinations transferred to a I693 to submit. You must do this if need to get any additional vaccines.
For your second question, you must submit all documents requested for the AOS such as birth cert., marriage cert., etc. Police cert. is not needed.
Hi Guys,I have been searching high and low for this topic and am still soooo confused. :-~
(1) As a K1, I did my full medical check-up AND vaccinations back in my home country. Do I still need to visit a USCIS physician here in the States? When I enterred The States, I gave a thick envelope to the immigration officer which contained everything which the US Embassy used on me. I am currently in the process of filling up my OAS application forms. If I do not need to do anything extra to what I have already done in my home country, do I need to put that in my cover letter?
(2) When I attended my interview at the US Embassy in my home country, the documents which I provided them (example: birth cert, police certs/letter of good conduct, etc), I was told that these documents will be sent to USCIS (in that thick envelope which I passed to the Immigration Officer at POE). Do I still need to provide them together with my OAS/I-485 form filling?

Cover letter is not necessary, but the marriage certificate (and a certified translation if it is in Italian is). Also, passport sized photos for the G325A are required if those are the photos you are talking about.
This may sound like a stupid question, but were all Italian documents translated to english with the original submitted as well?The only italian was the birth certificate of the baby, but after reading the guide with my wife, we got it, there was no cover letter and no marriage certificate, and plus, she didnt send them the pictures as explained in the guide...
The real problem is that I found out about this website late after she sent the petition out already, and i never tought there could have been problems with the documents sent in the first time...
BTW, anyone knows how many days you have to send them the evidence requested?

Info pass is definitely worthwhile. After we waited 10 months for our AOS interview letter (we were K3 and were interviewed), we made an infopass. We waited 10 months to be well outside the posted I485 times for our local office. The IO was surprised that we had not been given our interview, saying that they were not that backed up. She looked up our case, said we should here something soon, and did a lot of typing. She then assured as something would happen soon and to come back if nothing happens in 30 days. 10 days later we got our interview letter.
BTW, you most likely won't have an interview since you are at CSC, unless you see a status update that they sent your case back to NBC.

or soon after getting approved I765 but in my case its been like 3 months since i got my I765 and 2 months since 2nd REF submitted ...
so do u think its been late in my case to get GC without interview ?
or still i have chances to get GC without interview even though its like quite a few months tht my case is in california ?

OP, you should follow up or you risk being on an expired green card in 2 years.
There have been others who have mistakenly received the 10 year card when it should have been a 2 year card. I suggest you make an infopass appointment and go in person to speak to an immigration officer. USCIS does make mistakes - but they still hold you responsible even though they make a mistake. If you have been married less than 2 years when your AOS is approved, then you only qualify for a 2 year card even if they mistakenly give you a 10 year card. You are still responsible for applying for a permanent 10 year card by the 2nd anniversary of your green card approval.You can make an infopass at http://www.uscis.gov . Select the option 'schedule an appointment' in the right hand column, then follow the instructions. Good luck.

Kathryn is a mod here, she knows her stuff. Everyone else who's posted so far in this thread is merely speculating or stating things as they would like them to be. Do the right thing, give yourself some peace of mind and make the infopass appointment. This may be a mistake on their part, but it's your responsibility to get it right. Otherwise in 2 years you'll be posting about how you missed the deadline for filing for removal of conditions, and that is a serious problem.

Right. Also, an interview when removing conditions is not totally unheard of that the USCIS officer should be confused about it. He might think it was unneeded because your file was fantastic and you should have been approved without an interview; but some people are interviewed for removing conditions.
