Yes, you should file right away. The expired I94 will not harm your AOS case. The receipt notice for the AOS confers on you the status of "adjusting status" and your expired I94 means nothing at that point.
You're right, it has expired - will it still be okay to file? I'm planning on getting this out right away.Thanks for the advice, especially re: the marriage certificate. I know these guys can be finicky and just don't want to take any chances.

Hi all I noticed that they are transfering many k1 cases to CSC what about k3s? anyone with experience with San Francisco field office , how long does it take to recieve you GC and EAD?Thanks

Medical exam records were in the envelope. They should've taken them at the POE. You should have a copy of your immunization record that should have been given to you by the panel physicians office following the visa medical (DS3025), which you will need for AOS.
It took only 6 months from the time that we first filed for the K1 Visa, until I recieved it. I crossed the border July 12th and went inside to hand them all my paperwork, etc. They kept a bunch of papers to send them off to the next destination. Now we're married and we're filing for "Permanent Residency". I'm looking like crazy for my medical exam papers and immunization record. I can't find them! Is it possible that this was one of the things they forwarded at the border? Please help! -
OP start preparing for your interview. Plenty of AOS applications go to CSC and are not interviewed. They must have determined they want an interview so they sent it back to NBC to forward to the local office.
Just because you've been transferred doesn't mean you've been put back to the end of the queue.Normally, when a case is transferred to California (CSC), it's subsequently approved there, without need for an interview. However, if CSC sent it back to the NBC then you can probably assume that you're going to be called for interview, probably fairly shortly so it might be wise to start gathering documents you might need. Did you have any RFEs during all this? They can hold you up but being transferred (even twice) shouldn't...

He should find a temporary home for it while you are visiting so that you can be comfortable and breathe easy while visiting him. That is something that a husband should do. Not cause his wife an unnecessary discomfort and harm her health knowingly.
Thanks LGG,I was suspecting something of the like. Sadly, that might mean that I'm not going to move to USA after all, because I don't think I could live in the same home with my husband for the time being. I think I mentioned somewhere in my posts, but I've always had a lot of allergies and last year I was diagnosed with asthma. The doctor suspected that the reason why it suddenly erupted was the fact that my husband got a kitten during my last stay in the USA. I've always been the MOST allergic to cats, though not all cats have caused me problems. Then again, I've never lived with one yet, only visited households with cats. At the time, we agreed that if the cat would cause problems with my allergies, we'd find him a new home... But now he has lived here with my husband for 2 years and of course my husband is very fond of him. I've however had to increase the amount of asthma medicine I take since I got here and even had to use my airway opening medicine a lot - something I never had to do before. I am also taking antihistamin on a daily basis. The humid air is only adding to my problems, but my health has been poor since I got here. I do always feel better after a day spent outside or shopping or whatever, but then at night when it's bed time I find it very hard to breathe again. So basically, me and the cat... we don't mix. My husband loves the cat, he's used to the cat and so far he hasn't even considered about finding him a new home. And if I indeed can't just move to USA to my own place (somewhere near his), I will probably have to scrap the idea. I wouldn't want to ask him to give the cat away anyway, because I can see how much he means to him.
Well, one day at a time, but I do think my trip will turn out to be much shorter than the 90 days I could stay, since battling with my health might turn out to be a problem. I only had a certain amount of medicines with me, just enough for the trip. Since I've had to use so much extra, I'm not sure how long my medicine lasts. Or how long I last for that matter
Anyway, that's all for now. Still no news what so ever on the visa front anyway.
Oh also, I'm not sure what kind of a visa I would now be ending up with, since the USCIS was supposed to toss our I-129F away, but as far as we know, they haven't done this. So I don't know if it'll be a K3 or CR1. Last time we talked with them, we got the impression it'd be CR1, but with the I-129F still lingering about... who knows?

A civil surgeon should know. Ours was very helpful. Gave us a list of vaccines my wife needed based on age and sex. Then we looked at what we had based on the DS3025 and got our family doctor to admin the other ones she needed. Then we got them transcribed by the same CS for $30
I would call another civil surgeon, one who has actually done this before.
I am trying to get my wifes AOS package together. She has not had any of her vacinnations. I contacted the closest Civil Surgeon using the locator to try and get a price quote on her shots. When I asked for a quote, the Civil Surgeon asked which ones does she need? I said all of the required ones. His reply was which ones? I reiterated the required ones for her AOS to get her green card. He seemed confused.So I went to USCIS site and got this list: My wife is 23.
Rotavirus
Hepatitis A
Meningococcal
Human papillomavirus
Zoster
Is this the correct list? I found a copy of the DS3025 and there are alot more than this on that list. I was under the impression the Civil Surgeon would know, but he seems clueless. I was also told by that Civil Surgeon that my health insurance won't cover the vacinnations which is BS. If they are under $200.00 then I will just pay to cut down on the chance of a mishap. If they go over $200.00 then I will get my family doctor to administer the vacs. using insurance and use the Civil Surgeon everyone else on here uses to transcribe them. I just want to make sure I get her the correct vacinnations. She had her medical done in her home country prior to the Visa being issued.

By and large, only the first shot of any series needs to have been administered. That includes Hepatitis B, HPV, etc. However, if your DS3025 says the vaccinations are not complete, you obviously cannot send that in as your vaccination record. Consult with a Civil surgeon, usually they can tell you by phone based on age and sex what vaccines are needed. See what you have and if you need anything. If so, get the vaccines and get the DS3025 and other record transcribed to a I693. If you don't need anything further, than go ahead and get the DS3025 transcribed to a I693. You can use someone local if the price is reasonable, or Dr. Arnold.
My wife and I are trying to get her AOS packet together, but we are confused about the DS-3025 and I-693. She had her medical done in the Philippines but on her vaccination records it states that the vaccines are not yet complete because of the time she has to wait in between the shots. Do we have to wait until she gets all of her shots before we mail her packet in? and even though her shots are not yet complete do we have to go to the civil surgeon and get what she has completed transcribed. Even though your daughter is not part of the petition, the birth cert is something that they request in the interview notice for any children of the marriage that is the basis of the petition, so nothing unusual. I think you will be fine, no more interviews, once they have received and processed it, you will be golden.
Hi 3 days after my aos interview based on US citizen spouse i got a letter from uscis requesting my daughters birth certificate (though shes not part of the petition) and i did reply with but its been two weeks now i havent gotten any letter or respond to that nor it has been touched in online status how long does it take do you think its a bad sign are we going to attend another interview though i think the interview went fine. -
Congrats on the approval. Obviously you will have the answer to your question about the GC expiration in a little while when it arrives. But be careful, since you were married less than 2 years it should be a conditional GC. If an error is made and you get a 10 Year GC you should verify that it is ok (perhaps through an infopass) or you run the risk of getting in trouble down the road with a card that says it is still valid while USCIS and CBP think is expired based on there systems.

You will get a 10 year green card if your AOS was marriage based. If you have been married more then 2 years, you get the 10 year card.

You should get the notification as well as the actual cards in the regular mail. You could get email notifications if you sign up for them at www.uscis.gov in addition to the regular mail.
How do you usually get notified for your AOS/EAD approval? I noticed some would get it through e-mail and I thought it would be through the (regular) mail the same as my other previous notifications. -
OP, please note that you if you decide not to send the DS3025 and get a civil surgeon to fill out a vaccine supplement, it is no longer the I693A. The I693A is no longer valid as of June 2008. You will need to use the vaccine portions of I693.

Yes, this should be your one and only interview. If all goes well, you will be approved at or right after this interview. If there is a problem at the interview or issue with your case, they might call you back for a second interview. This is not the norm.
Hello all,A few days ago I received a I-797C-Notice of action. It starts at the top with "Request for applicant to appear for initial interview"? is this the one and only interview? im confuse since it states "initial interview"?... They received it july 24,09 for our aos in regards to k1. This initial interview at the USCIS in LA/CA falls on 09/23.. any input?

Actually a copy of the forms you filed and the w-2s are enough. But you can certainly get the transcripts from th IRS if you want. I had transcripts from previous years and a copy of the actual return for 2008 at the interview showing my and my wife's signature.

The I693A became deprecated in June 2008. You can send in the DS3025 if all vaccinations are complete on it (that is you did not need to get more vaccines once in the US). If you did, then you will need to have the vaccine portion of I693 filled by a Civil Surgeon, who will transcribe the info from the DS3025 and other shot records.
Hi,In the Step-by-Step instructions, it says that if you are a K-1 filing within a year, you only need to submit I-693a (Vacination Supplement) with the AOS, but I didn't find I-693a anywhere to download.
My wife's Vacination Documentation is on a US Department of State Form DS-3025. Will this form be okay to submit or will she have to have another medical exam done on I-693.

Yep, that was your biometrics appointment (you filed July 20 for AOS, way too soon for an actual AOS interview). Now, with the biometrics done, you should get your EAD shortly.
As for the GC, since you are a K1, there is a chance that they will send it to CSC and approve you without an interview. Or, if they feel an interview is needed, they will send it off to your local office, where you will get a notice to appear at an interview.
well now im a little confused, all they did was take my fingerprints and a photo, is that it?? im guessing that was just the biometric is there another interview before i get my GC or EAD?? it was all real simple no problem at all!! -
OP, nobody said that you could not leave the country. Feel free do so. The US goverment (through the DHS and State Department) gave you permission to enter the country once to get married. Now, you can go to any other country that allows you to enter with your Swiss passport (and perhaps a visa). But, to come again to the US, you will need the permission of the US government since you are not a US national. You can apply for a visa for such permission (CR1, K3, a tourist visa if you just want to visit, you might be able to get in using Visa Waiver with a Swiss passport, but might also be denied since you are married to a USC unless you show strong ties to Switzerland and an intent to return ).
You cannot enter any country you want at will with a Swiss passport you know. Nobody ever told you that? Well, then I guess your travels have not been too extensive. Plenty of world travelers have passports littered with visas for permission to enter a country (NOT TO LEAVE). There are plenty of countries that require you to get permission (aka a visa) to enter with your Swiss passport. You got a visa (a single entry visa) to enter the US. The US does not care if you leave now, they are not holding you prisoner. If you get AP, you can re-enter the US. If not, you must get another visa.

1. YOU ARE finally with the person you love-why not be happy about that long process being over and done with instead of bitching about "being stopped from traveling"
2. I suppose you knew the rules when you applied for a K1 Visa to be with your loved one,if you didnt know the rules you obviously didnt take the time to GET the information
3.Would you have gotten married in Switzerland (or even in the US ) you could have applied for a multiple entry K3 Visa,which would enable you to re enter the US
4.nobody on this site likes how long the process is and 6that family Immigration is very comlicated and nerve wrecking at times,but ALL of us knew beforehand what we are getting into,so making it sound like the US hold you hostage here is ridiculous !
And last but not least 4,if you like (liberal) Switzerland and how they run their Country and what Immigration Laws they have oh so much then PLEASE feel free to get on a plane and leave ! But do me a personal favor and dont get AP before you do!

As long as your visa medical was less than 1 year old when your AOS forms were received and all vaccinations were done prior to the immigration medical, you should be fine. You do not need a full medical and your DS3025 works for the vaccine supplement. If you received vaccines after the visa medical, you will need to have the just the vaccine portion of the I693 filled out (the civil surgeon must transcribe all shot records to that form for you). You do not need the full medical. Getting the vaccine portion filled out is much cheaper than getting a full medical, but varies by Civil Surgeon. Dr Arnold does it for $30 over phone/fax/mail. Many here have used Dr. Arnold, just do a search for Dr. Arnold.

The I693A Vaccine supplement is no longer used. It was stopped in June 2008. You must now use the vaccine portion of the I693 for proof of vaccinations. If all vaccinations were completed in India, you can send the DS 3025 that you got from the panel physician instead of the I693 as proof of vaccinations.

Actually you are allowed to travel abroad, you just can not re-enter the US using your single entry K1 visa. You don't have to wait for AOS to complete. You can file for and get AP (advanced parole) which would allow you to re-enter the US. You might get this before the green card.
We are finding out while adjusting we are not allowed to travel abroad!!! It is insane to both of us to be subjected to this kind of treatment. No one in our life stopped us from traveling freely and here we go, the US, the alleged most free country in the world can tell us when we can travel and when we can't. We are not anymore in the 80's East block anymore. What is the purpose of this?? We are not criminals. What do they think they are???Further the all process of obtaining a visa for a spouse is ridiculous, heavy, un-respectful, expensive and borderline comical and stupid. I have better words for it but I should be nice! I tell you it does not show well to the rest of world, the way foreigners seeking visas are treated with this process. I am certain we will get many objections from the US if a US citizen has to be going through this type of process from another country.

Remember, if you use or used a joint sponsor, your wife is still the main sponsor and must submit an I864 and all supporting documents as well.
