  1. Hello y’all. 
    my husband and I are trying Once again to expedite our Petition under military reasons (deployment). First time we tried to expedite in January we got denied after one day without even requesting proof. 
    Exactly a month ago, we tried to expedite again and we were told that our expedite request had been forwarded to the proper department for further review and we should expect a decision shortly (it’s been a month). In the meantime we got transferred from Nebraska to Texas as well.  We have sent multiple emails asking what’s up with the expedite request, as we never were asked for proof or anything. They always tell us we have to keep waiting, or that we should wait X amount of days and then Contact USCIS again (then we contact them and they tell us the exact same thing). Last thing we did was to call the Military hotline last week and the Lady told us an officer has our case and They’re waiting for it to be approved but for some reason it has not been approved yet (again it’s been one month since we requested it). I keep reading on Facebook about people recently doing expedite requests and getting denials/approvals after a few days, yet our case seems to be forgotten 
     

    I don’t know who else can we contact or ask about this, We are so done with our patience and we really need this expedite to get approved...

    Any advices?

    to verify - you did email the correct email, not just respond to the original email sent, correct?

    We did the request through the military hotline, then they sent us that email and the following requests were done such though the Myuscis account inbox. We were never told which “proper department” was sent to and our case ain’t in NSC anymore so...

    Wow that was a fast decision. They just don’t tell us anything at all about our expedite request which is upsetting. They didn’t even asked for evidence.

    How long did it take you to get a decision for the expedite request? 
    We tried to expedite on feb. 19th under Military basis and our request was sent to NSC, then our case got transferred to Texas. We never got an answer or decision back, we have called and sent multiple emails and all they say is that our request has been forwarded to the proper department for further review and we should receive a decision or notice of further action SHORTLY. It’s been three weeks. 

    What can we do? Who can we contact about this? I am so angry!

     

     

    also, my date on the website changed from February 23rd (that’s when my case transferred to TCS) to March 10th!

    Its not 6 months max. You have to check the current processing times which vary by service center. For Nebraska 129f is 7.5 - 9.5 months and 130 is 12.5 - 16 months. 

     

    What you have to remember is processing times are always changing. Previously the processing times were very close if not identical for the 129f and the 130. USCIS decided because of such to consider K3s obsolete and unnecessary and discouraged people from filing them. They also virtually eliminated issuing them. The current policies dictate that if NVC gets both an approved 129f and 130 at the same time or the 129f after the 130- they close out the 129f and move forward with the 130.  USCIS also has a policy to 'marry' the 129f and 130 at service centers which prevents most K3s from even getting to NVC

     

    What that basically means -(similar to how people file the n400 during ROC and it can speed up the process of ROC)- because the 129f has a somewhat shorter processing time, most likely your 129f case will come across the desk of an adjudicator before the 130 one does. If that happens the Officer will pull your file containing the 130 and most likely will end up closing the 129f and approving the 130. 

     

    Because the OP just filed the 130, filing the K3 may shorten the processing times. It still may take the longest processing date of 9.5 months for Nebraska though (opposed to 12.5 for the 130).

    Just like you have been advice here, I think you should file a k3. It's free since you already filed 1-130 so you have nothing to lose. It takes max 6 months and you can try including a letter explaining your situation to USIS in your K3 package. Then you should do everything possible to buy time in Germany... You mentioned you just finished school, that entities you to what they call job seeker visa valid for 2 years so that you can find a job... If you are already on this visa.. Then consider going back to school while you wait.. It's fairly easy to get university admission in Germany and your permit will be renewed as far as you still studying. 

    I am not done with my studies yet unfortunately, still have almost a year to go

    Thank you very much! Finally someone who doesn’t tell me to go back to my war zone country and wait there “because others have done it too”, and tells me something good. My husband and I will be filling for the k3 soon hoping this will help. At least it’s a hope! Thank youuuuu!

    I’m only telling you what USCIS is thinking on this. Why should they expedite your case if you have an alternative? The alternative might not be your preferred option but it is available to you. 

     

    You might want to start researching jobs etc in Colombia so that you can move there. Because an expedite is almost certainly not going to happen. Should have applied sooner if your German student visa is close to expiration. 

    I would have but I got married two months ago. I wish life was as easy as you describe it.

    I’m not saying your situation isn’t difficult. I’m saying it’s not unique. 

     

    What is your status in Germany? 

    Read your past posts. You’re a dual national - Venezuela and Colombia. There’s your answer. 

    I have never lived in Colombia or know anyone there. Only reason why I have the citizenship is because my country has stopped renewing our passports so I was able to get it so I could stay in Europe .

    Yes that I know. But most of the Venezuelans who are applying for visas have lived there all their life or didn’t have a chanc to leave the country. I did so for my own safety Id rather stay here and do the entire process from Germany. 

     

    I am a student in germany, as I said I have the option to find a job afterwards and extend my German visa that way while I wait for my spouse visa, but if I do this I need to sign a one year work contract and if I only have six months to enter the country after visa is issued this really makes no sense to me
