  2. Since your NOA2 has four months validity, my suggestion is to wait three months plus to schedule the interview. This will give you additional time to get an estimate of the length of time it will take to get the CENOMAR corrected.

    An annulment in the Philippines can take a year or longer, but since your fiancee was not legally married maybe the process wil be quicker.

    Darnell, there has been no packet 3 used at the Manila Embassy (USEM), only Packet IV. The process is a little different as the DS forms are submitted at the interview.

The data collected from people at Visa Journey might be a good approximation but it is definitely not valid statistical sample. The key to statistical sampling is that you must take a random sample. One characteristic of a random sample is that every object in the population of things to be sampled must have an equal chance of being selected in the sample. If the K-1 filers in Visa Journey only represent only 5% of all K-1 filers across the nation then you have excluded 95% of the population of K-1 filers. K-1 visa filers at Visa Journey are not a random sample.

    Exactly, only the USCIS has the data to pick random samples. Using only VJ members makes the sample biased and extremely skewed.

    Also, just because the geusstimate of 5% of VJ members are not getting approved does not correlate to (relate to, [mean that]) the other 95% of K1 applicants are not getting approvals.

  4. Only using samples from VJ is called biased sampling, which does not give an accurate sample of all visa applicants. This would be skewed rather than symmetrical.

    Also, in statistics it is not 98% accuracy, it is "there is a 95% probability that the number will fall within a cetain range"(e.g. between 5 and 9). Probability is the likelihood of something happening or being true.

    This is some of the ways statistics are easily mis-intrepeted to fit someones purpose.

    Some things never change. We have the opposite problem here in IL. People are still going 70 MPH on snow and ice.

    Not to hijack your topic, but we got an official record of 17.6 inches of snow with 45 MPH winds. This is the last few feet of snowdrift to the road:

  6. Does the girl need 4 copies of their Birth Certificate? Do they all have to be certified or can they be copies of the original? Very expensive for them if they need 4.

    It is best to get several certified copies of the birth certificate (BC). If the immigrant is comming over on a K visa a BC is needed for Adjustment of Status. You can use a xerox copy for citizenship, but the USCIS can request an original certified copy.

    You may need a copy for other purposes such as insurance, marriage license, etc. It is much easier to get at the same time time rather than trying to get a copy while in the USA.

    In going back to the Phils there are several things to keep in mind.

    1. Any stay outside the US for more than 6 months will cause the US Citizenship timetable of 3 years to start from 0 again.

    2. Any stay outside the US for 1 year to just under 2 years must be preappoved with AP or you will need to restart the visa process again.

    3. Long stays may cause an issue with Removal of Conditions, but I rarely read about it. My wife went back to the Phils for 4 months with no problems.

    4. Most airlines will not allow a lady to fly during her last trimester of pregnancy.

    For US Citizenship you wil need to report the birth to the USEM with a CRBA. This page from the USEM explains the process: CRBA

  8. Do the locals around Dallas still slam on the brakes when sliding on ice? I was in D-FW one winter and the locals scared me. lol.

    We received about 16 inches of snow here in Il with up to 45 mph winds. There was 2 feet of snow blockung the front door. A 4-wheel drive SUV tried to drive down our rode but backed up.

    It's a snow day for real!!

  9. What I remeber is parents are to accompany children under the age of 16 or send a signed consent form (DS3053 I think). This is for bringing [step]children to the US as you must be 18 to marry in the Philippines.

    A Fil under the age of 22 needs parental permissin to marry and 22-24 needs parental consent.

  10. Why would the OP need to have removal proceedings put on hold? He does not state that he is in removal proceedings....he's only inquiring about Removal of Conditions.

    A. The OP is not divorced yet. Getting a divorce is not always a quick process and can take years.

    b. Applying for ROC only gives a 90 extension for the divorce decree RFE.

    c. The lawyer is leading the OP done the wrong path.

  11. You need to file for ROC with the divorce waiver. You will have a day in court and need to ask for the removal proceedings to be put on hold until the divorce is final.

    You can remove conditions by yourself if your lawyer does not know how. And you need proof the relationship was entered into in good faith. You will not get an approval for the green card until you provide a divorce decree.

  12. The visa process is completed by two different organizations, the USCIS and the Department of State (DOS). USCIS does the original approving of the visa petition. Once the petition is approved it is sent to the National Visa Center (NVC) and then to the US Embassy which are both under the DOS. If your visa is approved and granted, when you enter the US the USCIS is in control again. The USCIS issues Green Cards, Work permits, Advance Parole, etc.

    In short, you must get the visa petition approved by the USCIS and then the Visa approved and issued by the DOS. Getting these two parties to work together is like getting Democrats and Republicans to work together for the greater good of the people.
