  1. Thanks for the replies, I have known her for years, we lived together in Japan and were in a relationship together before that for about 2 years. 

    Would it not be likely that as the situation of Covid gets better that the K1 visa returns to its normal 8 month time frame? I understand the benefits to CR-1 but, I don't know how we can get married in a 2 week trip. Is that even possible?

    And wait over 2 years for the visa? That would be too difficult. Don't you have to prove that you met within 2 years for that too?
    We cannot meet for an uncertain amount of time, Japan will not let me into the country, period. And my fiancé would be forced to do a 14 day quarantine if she left Japan and came back, 3 weeks of paid time off she does not have. Also she does not want to travel without a vaccine which are on a slow rollout in Japan.

    I am honestly devastated but I guess if my petition which we worked so hard on really is a lost cause, and we can somehow, someway freaking meet once this year, then we could apply later this year again which would put her interview around summer/fall 2022. She leaves Japan in August of next year to go back to the Philippines. If we applied right now (not that we even can meet the 2 year requirement as well as we did 4 months ago when we applied), then we would wait for 4 entire months for a freaking NOA1, maybe have our payment accepted by the grace of god and then go through the now 1 year processing time for the application which would place her interview right at the end of her stay in Japan of summer next year, a stressful crunch time so close to having to move. 

     

    I think my only hope is that we meet sometime in the next 5-6 months, apply, and next summer/fall have an interview when she is back in the Philippines.

    I am honestly crushed because I have absolutely no way of knowing when I can just see my fiancé for the 1st time in almost 2 years. If I just knew when I could see her, then we could plan on applying again and it would make this feel so much less painful.

    It's curious that they gave you no reason for rejecting the petition.  Usually there is a letter explaining why the petition was rejected.  If they told you that you had to refile, there has to be a reason why.


    Unfortunately, there is nothing you can do unless you find an error on their part.  If the check bounced, I can't see how it's their fault.  


    You will have to find a way to meet again if you want to file.  

    They sent a notice explaining that the bank I have did not honor the check or something. I am going to call the number and see if the application I just waited almost 4 months for can be resent with a new check.

    Unfortunately, the only way to file again is for you two to meet again.

    It was signed, it was filled out correctly, written out to the US Dept. of Homeland Security. There has to be a way for them to take back the check right? Is there nothing we can do? We cannot meet again.

  5. I am devastated that after waiting over 3 months for a NOA1, and finally getting a NOA1, my check did not cash. I do not know why. It was an official check from my bank. My account had the funds in it. There is no explanation what so ever I could give for this happening. I am crushed because I cannot apply again, three months ago we were able to prove that we had met within two years and now we cannot. They sent back the application and said we would have to refile. Is there any way possible we could petition this? This is horrible and I could vomit.

    It's not like the reviewers don't have anything else to do and are just desperately waiting for new applications to come in to finally have something to work on. There is already a huge pile and your application will get there too with all the others in the order they're received. Covid didn't stopped at the doors of USCIS. They had and still have people calling in sick too. And people going on vacation and whatnot. Processing times are just longer again these days. I waited a year now for my AOS interview while it was only a six months wait for my office back in 2019. 

    It doesn't really matter when you get your NOA1. Even if you got it after a week there might still be 100000 applications in front of you. Maybe they're down to 50000 when you get your letter and the waiting time from there is not too long anymore.

    and since it has been months with no noa1, and my application only going to that pile after a noa1 this week for example, then that means it wasn't on that pile for the past 2 months. wouldn't that mean the application's lifespan having been extended by all that time not being on that pile having received no noa1?

    Is there any single person that filed in November that got an NOA1? It seems to me they simply stopped opening new petitions. The more they wait, the bigger the backlog gets, so I hope they hire more workers or work longer hours to clear it up or else it will never be cleared!
