  1. If I am not mistaken, it's either you or your father OR you and your mother can sponsor your wife together. Your assets (bank money/ savings) and your parents assets (bank and house, etc) should be suffice for the 125% poverty guidelines. If both parents would agree to co-sponsor for you, so much the better. What's important is the current income as long as they can provide proof what they are currently making as their monthly salary.

    This works if they are all part of the same household. Otherwise, no.

    The OP qualifies on his own. The shortfall in income can be made up with assets using a 1 to 3 ratio. $15,000 in cash can replace a $5,000 shortfall in income.

    If Dad has a new job before the affidavit is needed, then he qualifies easily too.

    Meeting the minimum is no gaurantee a Consular officer will be satisfied.

    My mom has some income. Can I use her income supplement mine ?

    So I guess what your saying is my 16,000 will cover my 5,000 dollar shortfall.

    I am so scared. This is troubling me so much.

  2. I have some bad news. My dad started his new job on Monday but then he said he didn't like it. He decided not to go back. He says he'll be testing for another job on Monday.

    Do you think the chances of my wife coming are next to zero now ?

    Since I am a student, I make 15,808 per year and I have a 16,000 dollar bank account. Some of this is money my grandfather left in his will for me. I was looking at the Poverty Guidelines for 2007 and I noticed I am only 5,655 short on income since I am make 15,808 per year. I have a two kids, but I only claim one on my income tax returns. So $21,463 would be 125% for a family of three and I make 15,808 per year and I have a 16,000 bank account. Does my bank account make things look better ?

    I wanted to use my parents as co sponsors, since My dad has a larger amount in the bank, but I am scared because he currently has no income since he just moved here. My parents do own a house that is currently worth 229,000 which is all paid for. My mom has her own home health care business. She currently makes 14,300 per month, but that is due to change as she gets more customers.

    What is my best option. I am afraid my wife will be denied, and thus my life will be ruined.

  3. I am a student here in a local university here in Georgia. I will need a co sponsor for my wife.

    We just relocated from another part of Georgia. My dad is starting a new job on Monday. My question is will that hinder our plans? Since he had a one month gap in employment between his last job and this current one.

    My dad owns a home that has been paid for in cash and he has a large sum in his bank account. Do they even take real estate properties into consideration?

    My mom is self employed. She hasn’t incorporated her business as of yet, but it is registered with the state we live in. What kind of proof of employment does she need? My mom requested her clients to show their payments to her.

    My dad is doing the I864 and my mom is supplementing their income with a I864A.

  4. The letter from your employer should suffice, but you do need to show 2006 tax transcripts. Others have shown alternate proofs of income and still passed.

    Do bank savings that total more then the income requirement for a year do good also ?

  5. This statement does not make sense. Do you pay child support as part of the divorce settlement? Or do you pay it out of the goodness of your heart? If it is part of the divorce settlement it is "legal child support" whether or not you've ever been a dead-beat dad and whether or not you have the right to claim the child as a dependent for tax purposes.

    I pay child support not because of a divorce settlement. I pay freely because this is my child.

    If you are required to make the child support payments as part of your divorce settlement then you should identify the child as a partial dependent on your I-134 affidavit of support. If you could stop making the payments tomorrow without any consequence to you then you do not need to show the boy on your I-134.

    Ok, thanks you so much because I dont pay because of a divorce settlement. I feel its my duty as a parent to take care of my son.

    Now concerning the income. Do they take savings, property value, Value of personal possessions as a form of finances ?

  6. No, unless the child lives with you and you are fundamentally financially responsible for him, you would not put him as a dependent.

    If your annual income alone does not meet poverty standards, as you are a student, I would grab a co-sponsor to be safe.

    I asked my mom to co-sponsor. It's better to err on the side of caution in all visa matters.

    On your affidavit of support they ask for all sources of income, bank accounts, savings, bonds, stocks etc - but seriously, to be safe, I'd get a co-sponsor.

    My parents are my co sponors. My dad is working part time now. However, his job is slow. He usually works 4 days per week, and he does make way over the required amount. However, these last couple of weeks he hasn't gone to work since his firm is slow. I was wondering if his savings would help. My mom plans on opening her business and I know she will be making more then twice the requirements. I guess what I need is a miracle. I hope by the time the papers are to be sent to the embassy, her business is established.

    If she was in business for 1 month would they accept her income as stable, or does it have to be a certain time period for it to be valid to the embassy officials ?

  7. I have a couple of questions concerning the K3 Visa.

    I have two kids. One of them doesn’t live with me. However, I do pay his mom monthly support. This is not the same as legal child support, because legal child support deals with the state and is usually for dead beat dads. I never had an issue of not paying to support my kid.

    However, I didn’t claim the son that doesn’t live with me as a dependent on my income tax. Do I have to claim him as a dependent on my K3?

    I am a student at Georgia Tech. Would USCIS take issue with me being a student? I currently work part time and dont meet the Poverty Guidelines, however the money I have saved in the bank and plus my income meets the Poverty Guidelines.

    My parents are willing to be my co-sponsors. However, they just recently moved to Georgia and they haven’t found full time work yet. My dad is working part time job as an electrical engineer. His part time income, like me, plus the money he has saved is enough to care for 6 people according to the Poverty Guidelines.

    Does USCIS take into consideration the monies you have saved and your income or is it just based on income?
