  1. I filed all the docs for my wife in March and finally on November 9th 2007 she was approved. Her interview was at the embassy in Manila. She said her entire interview was 5 minutes. After 4 questions and a quick glance at our picture the co said she's approved for the visa.

    Not to mention, I used a co sponsor. For those who said Manila doesn't accept co sponsors I would have to say your wrong, because my wife said many with co sponsors were approved.

    I'll get my wife to post the details on her interview. I would like to thank the following people for helping me along the final legs of this long journey.

    no my sisters are not dependents and neither am I. I have a son, so I am fully independent of my dad. My dad's dependents are just my mom right now.

    Thanks for wishing me good luck. I notice some on this forum have been saying the Manila Embassy doesn't take co sponsors. I think that is false. Like one person pointed out to many have been approved in Manila with co sponsors. Not to mention, all embassy have to abide by the Department of State rules. Thanks for your help

  5. I make about -1,000 short per year according to the poverty guideline. I own a house that's all paid for and I have around 20,000 in my account.

    My dad decided to co sponsor my wife. How does this co sponsorship even work ? Does he have to prove by the poverty guideline he can take care of me, my wife, my son, my mother, and himself or would only have to prove he can take care of himself, my wife, and my mom ?????

    Some here on Visa Journey have been saying the Manila Embassy no longer takes co sponsors. Is that true ? I am a student and my co sponsor is my father.

  6. The joint sponsor must meet the requirements for the number of people in their own household plus the intending immigrant.

    I think you qualify with your assets added but it might be easier to get an I-134 from Dad than to get your house appraised.

    Do they consider household people that live in your house or people you've claimed on Income Tax Return ?

    You will need to get about 3 years worth of W2 yearly statements, 1040 Federal Tax Returns, letter of reference from bank, letter of reference from employer, and most recent 6-12 months of bank statements and send most 6 -12 months recent paystubs. This is all documentary proof that you or the cosponsor has stable sustainable steady income above poverty line to support your K1 finance. You can send photocopies of all that stuff they do not require originals, only I-134 f signed and notarized by each, and the letters of reference. Assets are not really something they focus much on, they are more interested in your monthly cash flow and ability to support a K1 finance until they are able to get EAD or AOS greencard to go look for a job, and that could take about 6 to 12 months on average or longer.

    My bank doesn't give letter of references. I dont have 6-12 months statements since a large sum in my account was recently deposited. I do have a paper stating my current balance.

    I dont even have 6- 12 months pay stubs. I was working 3 days to now I am working 4 to move closer to the 125% line. So this increase of pay was recent. I do have a letter from my employer.

    My dad just recently started working. He can only submit one pay stub and an employment letter and the monies from his savings and checking account.

    Big alarms are going off in my head with all this recent change in finances but I think your best bet is to be the sole sponsor, using current pay stubs and bank statement to make up the difference. Although it is often argued, there is anecdotal evidence that using a joint sponsor in the PI is pretty iffy. Your Dad's short employment record may not help you in the best of circumstance.

    I would def. get the joint sponsor if they can prove what needs to be done.....you don't want to get all the way to your interview and find out you need one (I've been reading the horror stories on here). Secondly, my bank tried to tell me they don't do the letter either...I took them the instructions from the u.s. webpage and explained to them I NEEDED this information for my husband's visa...they got out some letter head and typed up a letter for me on the spot. (I sounded more desperate than demanding which probably helped). BEST OF LUCK!

  7. Even if the NVC did not review the Affidavit of Support. The petitioner makes $65,000.00 gross as a permanent, full time employee now. He stated he provided letters from employers proving this when he submitted his Affidavit of Support. $65,000.00 GROSS income is exceeds the 2007 poverty limit. So why does the guy need a joint or co sponsor?

    I do feel very bad for this guy. I dont think he even needs a co sponsor. ITR are based off last year, This is a new year. Why cant current income overide the income I made last year..

    People do get better job offers that can be thousands of dollars more then you made last year. The immigration folks dont realize how much pain and hearache they are causing people. Let the man's wife come. Life can be very short.

  9. Poverty Guideline for two people is not 21,000. I thought they count current income ( the money you make at your job now). I didn't know they only count IRS returns, not pay stubs and other documents that prove current income.

  11. My wife's interview at the Manila embassy is soon. I am a little over a thousand dollars short per year as far as the poverty guidelines. I do have $20,000 in my bank savings, and I own house that is worth $240,000. My house is all paid for, so I dont have any mortgages.

    I am a student and my parents bought the home under my name. My name is on the title deed, insurance, and bills are under my name. I don't currently reside at this house, and neither do my parents . We are currently looking for someone to rent it.

    I am trying to use that house and my bank account as assets. I had my mom write a note on how she's paying the bills at the house until I complete school, since currently I dont make that much at work.

    I also included a bank statement and all proof of home ownership.

    Would this be enough proof for the interview

  12. Ok. I got a pay increase at work so I now make $19,760 per year. I have $16,000 in the bank. My parents loaned me $4,000 ( I need to pay them back when I graduate) . So in totally I have $20,000 in the bank and income is 19,760 per year so added up its $39,760.

    fyi - Assets (like cash) do not count equally towards the poverty level -- it is 5 to 1. For example, your $20K in the bank is worth $4K of payroll income.

    Then you need to meet the 125% poverty level for three. For a spouse or fiance the conversion reate is 3 to 1, not 5 to 1.

    So, your income of $19,760 plus $20k/3 equals $26,427. That's exceeds the 125% poverty level in every state except Alaska.

    I am only $1703 short on the poverty guideline. To meet that level I would need to be making $32.75 more per week.

    I am a senior at university. There's no way possible I can take another job. I wanted to know if my bank account will cover my shortfall now enough for the Embassy to look over and approve my asawa.

    My shortfall is only $32.75 per week. Thats not very much at all. I will be done with school in the summer 2008. By the time my wife's K3 runs out I'll be done with school.

    Does this mean I can use my bank account and other assets as supplement ?

    It means you can use it if you need to. If your income is sufficient, you can skip it.

    So then you need to use your assets. Do so.

    Your questions have alreaady been answered in another thread. So, you need 15,999 in cash to make up for 5,333 in income shortfall and you have $16,000 in the bank. That's pretty tight but you have it covered. Put down your bank accoiunt balance and send a recent bank statement that indicates the money is there.

    Are you sure you're using your gross income?

    If you find a part time job, then annualize that income. You only need a little more than $100 in extra income to make up the difference that way too.

    Thanks again, pushbrk. Yes, I am using my gross income. Pretty bad huh ? Not to mention, I only work 3 days per week. I am asking my manager to atleast give me 2 more days. That would put me closer where I have to be for income. Thanks again for your help.

  15. If my wife is denied for K3 what happens next ? Will they just tell her to come back when she solved the issue that caused her to be denied ?

    Can she later try to go for the CR-1 ?

    They may ask for more information or documentation or they may give a notice of intent to deny. In either case, there are options to overcome from as simple as giving them what they ask for to having an attorney appeal their initial NOID (intent to deny). It all depends on the circumstances and reason for their initial unfavorable decision.

    Yes getting your CR1 petition to the Consulate is an option. It may be easy or difficult to get it there but the same issues are likely to arise, if any.

  18. Only the income of other household members can be used to suppliment. Do you live with your parents? If not, then there is no combining of income. One sponsor must qualify individually. It sounds like you do. Yes, your $16000 will cover an income shortfall of $5,333.

    Yes, I do live with my parents. I only have one bill, and thats my cell phone.
