Ok , its been a month since i sent my response to the RFE , uscis emailed me change of online statis today , it changed from we recieved your RFE documents to Case Is Being Actively Reviewed By USCIS etc..... so what does that mean? Does it mean they pulled my file and currently working on it ? Generally speaking how long does it take to get an answer at this stage? Anyone been in this situation before?

    USCIS has suspended in-person services until April and so it looks like we're in a for a long wait as far as getting a final decision rendered. Honestly, I'm glad they did this as the last thing I want is worrying about getting called in for a follow up interview in the midst of this pandemic. At least now we can just focus on our health and disregard this irritating RFE's for now.

    In person means interviews etc... but they're still working on cases like before and thats according to my attorney

    It wasn't a glitch , they want the i-9 document from my employer . My attorney's responded to that part at the second RFE and explained to them that it wasn't available since he never gave me anything but check subs and w2's and he explained to them that I  wouldn't have access to it in the first place since it's something belongs to the employer  ,not the employee . Things  Doesn't look good so far even though I've sent them tons of documents that are more important that the i-9 but i think they're trying to make excuses so they can deny my case.  I am preparing for a lawsuit at the federal court in case of a denial

Having said that, do we know if an RFE pauses that clock since my case status actually says they will pause my case until they receive what they're asking for? I'm curious because there was a gap of a week between when I received my RFE and when USCIS received my evidence. Would that week count towards that 120 days?

    The clock stops anytime they send out the RFE , and it resumes when they receive it back

    They have 120 days to make a decision from the timenyou received the first NOA according to my attorney, regardless of how many RFE you have received

    I was wondering about the same thing , the attorney said that more than one officer work on the paperwork and thats why they end up losing some files or making the wrong decision sometimes

    No they were all different but on one of them they asked for some items that I've already sent the first time .third time they did the same thing but they wanted colored copies instead which is pure BS, so god knows what they want this time.  Maybe they want to know how many times I've showered and brushed my teeth

The first RFE I received I was able to actually see the document right way in my account unlike this last RFE I got last week.

    No the message never changed to ( we recieved your evidence ) and i don't have the myuscis account, the account got locked for some reason at the beginning and I've sent countless of emails and they always said the same lie ( we called you but you didn't answer) so i give up

    Could this latest RFE be similar to mine and just a response to them receiving what you had sent? What was the deadline of the last RFE you sent to them?

    March 5th and they recieved it at the 2nd . I doubt they went through everything I've sent but i will expect anything from uscis since they requested the same things twice out of the three times . One lawyer told me that they're just trying to drain me so i can withdraw the application

    I doubt it . My first wife passed away 5 years ago and i didn't have issues getting my hreen card at that time without her ( 751 waiver) i just think the current administration changed the policy and made it much tougher for people to becoming citizens. They're asking for some ridiculous stuff and making it longer .i gave them a certified copy of my birth certificate and then they wanted the original with the blue stamp on it ! They wanted copies of every passport page of all my passport and when i sent them they asked for colored copies! They're FOS to be honest with you.  All my RFE were sent by the director,  not the officer .

However, after the original RFE deadline was hit which March 2nd, the online status updated to another RFE was sent on March 2nd and should receive it soon. However, I have not received anything and it's been a week since the status update. The tier 2 officer I spoke to seems confused as well and said he doesn't see another RFE other than the original one that was sent out on January 27th. Anyone with any insight on this? 

    I received 3 RFE letters after my interview.  Yes 3 ! And second one they requested totall of 570 pages. Yes 570 pages ! They even asked me for 5 years of bank statements,  every single page for the past 5 years

    Ask your employer to write a letter explaining why you don't have I-9s with them.  Submit this with all your other evidence.  Your employer can be fined for not having I-9s, but it shouldn't affect your case if you've been an LPR for 14 years.  Good luck!

    Really?  Thank you so much.  So with check subs and w2s you think i should be okay? Since i don't own the business the only thing i can do is to ask him if he can write a letter , i don't have authority over him and it's not my fault that he never had the i-9s . Thank you so much

    Thnx. Yeah the whole thing still doesn't make sense to me.  I know they can request anything but why on earth do i have to give them 5 full years of bank statements! Anyways thnx for your response

    I know 😔 and how the hell am i supposed to have copies of all pages fron my  Three passports when my country shreds the old ones after renewals! I might have copies of aomenpages but not all 180 pages from all three passports WTH! so sijcenny employer didn't do the i-9 i guess  my case is screwed

    I didn't get my green card through my current wife , it was through my first wife and thats why i find it strange . Now thebmajor problem i have is the i-9 from my employer.  I can pretty much come up with everything they're asking for except the i-9

  16. I will try to make this short , i went for my interview in San Bernardino last month and i was interviewed by the most rude and racist woman ever . Story short she blah blah too much she even said in my opinion you shouldn't even have green card in the first place because you owe one year of taxes ( i have payment plan with the IRS ) so i passed the test but she said that i will recieve a letter in the mail . Today i recieved the RFE and it's the most confusing thing ever . I filed based on 5 years role , not the 3 year marriage base.  They are asking for 

    1- tax return for 5 years ( i have them ) 

    2- rent or mortgage payments! I havr them but i find it strange to adk for them 

    3-  lease and phone bills ( a must ) ! 

    4- bank statements for the past ( 5 years) yes 5 years !

    6- copies of all pages of my passports for the past 15 years both expired and current ! 

    7- 1-9 employment eligibility verification for the past 4 years . Thats where i have a problem because my boss doesn't have them.  He pays me checks and i i have the w2 for all these years but no i-9 

    8- certified copy of my current marriage certificate! 

    9- copy of my birth certificate 

    Now is this normal? The letter was sent from the director , i don't understand why all these documents of my n400 wasn't based on a marriage to a u.s citizen! I've been permanent resident for 14 years ,  5 years of bank statements sounds little crazy to me . Nownthe problem i have is getting copies of all pages of three previous passports,  and the i-9 ? I am going crazy guys , any suggestions please :(

    That actually seems like a rather fast process to get to the interview, though each case and each field office is different.

     

    Now that they have scheduled an interview, there is no guarantee yet as to when that interview will be.  You will simply have to wait for the notice to arrive in the mail to get the actual interview date.  Depending on the office, it could be very soon or it could be quite some time in the future.  I would not pin any hopes for it to be in December though - if I recall right, they like to give more notice than that...

     

    However - your case may vary...

    Thank you so much . Yes i agree i wouldn't worry so much since i didn't really expect it to be that fast to begin with . But since they're scheduling me for an interview does it mean that they finished the name background investigation? I have nothing to worry about but I've heard so many times that some people went for their interview and they're told that the name check is still pending! Is that true? 

  18. 😬😛 funally an interview scheduled 🥳 5 year based case . I filed in june 16 -2019 . Took my fingerprints on August 16-2019  > i checked the status today on uscis website and it's showing the following  . . . . .  

    On December 5, 2019, we scheduled an interview for your Form N-400, Application for Naturalization, Receipt Number IOE0907078555. We will mail you an interview notice. Please follow any instructions in the notice. If you move, go to etc..... 🥳🥳🥳 my local office is san Bernardino,  ca .   does that mean the interview will take place in December?

    Thank you for your answer.  I know what you mean but I've never applied for assistance, i only have medi-cal . I was making good money but a year ago i got robbed at work , the guy hit me on my head with a sledgehammer so i had severe concussion etc... thats when i started working less hours etc... only medi-cal though! I hope this doesn't affect my case
