We filed in 2016, I was I was 51 then, he was 31. Took nearly 3 years due to we filed AOS from a expired visitors Visa, and the Houston USCIS office is very backed up.
We had 2 interview, cause I believe the 2nd interview was 15 months after the first one. The second was a Stokes interview, just 2 or 3 questions, and lasted maybe 5 minutes.
They asked how many dogs we have?, who walks them?, and if either of us smoked cigarettes.
Few weeks later they issues us a NOID, they wanted my registered divorce certificate from Egypt, we got it within a few weeks, then 3 weeks later my husband was approved for his 10 year green card.
But age was never mentioned at any point of the 2 interviews. Maybe cause I don't look like I'm in my 50s and my husband looks much older in person & he is very mature .
Thank you very much, i wish all happiness for you

Administrative processing. It occurs after an interview and is open-ended.
They check criminal record in both countries?
But i thought it can take longer for people who grew up lived in MENA countries but got naturalized after in European countries. But me, i was born in France ang lived all my life in France.

I realize that. I'm not talking about the banned list. I was referring to MENA countries.
Yes, thank you, what is exactly AP?
thank you

I'm not saying you will have any issues. I'm just reporting what we see here on VJ. There was recently a dual national with Norwegian and Iranian passports who wound up with a 16 month AP.
Everyone's circumstances are different.
I understand about Iran its a ban list country, there are 7 or 8 ban list, Tunisia is not on the list. And i have no problem in Tunisia.

Males with ties to MENA countries generally undergo more thorough vetting - background checks, etc. The process can take longer.
I just have Tunisian nationality but i lived all my life in France. My Tunisian passport even stayed expirated years because i did not go to Tunisia since long time.
After i understand, thank you. And i have already gone in USA to visit my fiance, i went in USA 3 times, customs never asked me anything there and i mentionned Tunisian passport on ESTA.

I think in your situation the Tunisian citizenship will be a bigger issue than the age difference.
Why?
Tunisian nationality is a problem?

That makes sense, the US also has that requirement.
Do you think my situation can be a problem with consulate if i'm younger?
thank you

Why did you not just use your French passport?
I use just my french passport when i travel, but my mother did me Tunisian passport because its an obligation all children from Tunisians, are automatically Tunisians and must go in Tunisia with Tunisian passport.

If you have Tunisian citizenship your case may get more scrutiny, background checks that take longer, etc. Hopefully your USC fiancee sent in a lot of evidence with the I-129F petition, and you should take more to the interview, to show that your relationship is real.
Yes, but i have never lived in Tunisia i just went for vacation. My mentality is not like in Tunisia, my mother make me Tunisian passport to go there for vacation when i was kid.

My husband is 20 years younger then me. I'm the US Citizen, he is from Morocco. Age was never brought up at our 2 interviews.
Thank you very much, when was the interview, maybe they dont ask about age but they can think about it without mention. Did you file for K-1? Why 2 interviews, did they denie first time?
Sorry for my questions, its just to know about experiences looks like my situation.
Thank you

Don't you know to never ask a woman her age and does it matter? I'm 21 years older than my husband and my husband didn't have any issues. Period.
You can look at my timeline to see the dates.
Thank you, do you think my situation can be problem, i saw others situation they denied. Maybe its like chance too.

If it is a red flag or not depends on local customs. I don't think it would raise that much scrutiny for France. It may raise a lot of scrutiny for a country like Morocco with an older female petitioner and younger male beneficiary. It would not bat an eye in a country like the Philippines where large age gaps are not uncommon.
Note that a red flag just raises the bar of what relationship evidence is needed - age alone is not a reason for refusal.
thank you very much, but the thing im French citizen because i was born in France and lived all my life in France but my parents are from Tunisia and i have Tunisian passport too. They can judge me because my background, but i consider my culture mostly western.
Thank you

My now husband and I have a 28-year age gap. I did a lot of research on overcoming age gaps in the US immigration process here on this site and followed it closely. We chose the CR-1 spousal visa route and he was approved 11 months after I filed an I-130 petition. Many have done it for K-1 too. All you have to do is submit evidence that the relationship is real. For France, you should be okay with basic evidence since it isn't a high-fraud country. Good luck!
Thank you very much my friend, who is the oldest in your couple. Is it like me.

Hi! In my opinion, CR1 is the way to go. It might take a couple months longer process (compared to the k1), but ultimately I believe it's less expensive and once you arrive you don't have to wait to adjust status: meaning you're able to begin working immediately, driving and really immersing yourself into your new home. I believe the approval ratings are better for cr1 petions also.
Thank you very much, i heard K-1 is more hard to get too

well, outta pure anxiousness and curiosity to see if it helps, I mailed off the K3 today. We were sure we weren't going to submit one, but figured, why not just try. TX SC.
Sorry, just to ask please what is the best to do for more chance of approval, CR-1 or K-1 visa?
do think its more easy for me to do like you CR-1 because i have two nationalities, i was born in France and live in France but i have too Tunisian nationality.
Thank you very much

That will be good for your case then if you were together in real life for a month before already. AOS is "adjustment of status", where you request a change from a non-immigrant status to an immigrant status, while currently being in the US. However, you cannot come in to the US on a non-immigrant status with the intent to change to an immigrant status in the US, unless you are on a visa that specifically allows it.
For example: you can come on a K1 visa, get married, and adjust status, as a K1 visas purpose IS to come to the US, get married, and stay.
BUT, you cannot come in on a tourist visa/ESTA with the intent to get married, stay, and adjust status to immigrant status, as coming into the US on a tourist visa/ESTA is supposed to be with the intent that you will return to your country. So, adjusting status (AOS) is illegal to do on an ESTA/tourist visa if you came in to the US with plans to stayAfter immigration will knot i left America?
thank you

It is perfectly legal to marry in the US and go back to Europe. What isn't legal would be to come to the US on ESTA, marrying, and not going back to Europe, as another user was suggesting Adjustment of Status. Adjustment of Status would not be legal as you cannot legally enter the US and marry with intent to adjust status. You can absolutely come to the US, marry, and return to Europe though
Thank you very much

Since they are asking about marrying on the first visit, and whether or not they can do so on an ESTA, then I would assume OP is outside the US, in which case they cannot plan for AOS as like you said it would be visa fraud and illegal
It's not really a first visit, i lived with her before during one month. But what is AOS, i don't understand thank you very much

First the I-130 and I-130A are filed with the fee of $535. After I-130 approval comes the NVC stage. Current NVC fees are $445. Medical Exam costs vary per country. Travel costs vary. The USCIS Immigrant fee is $220.
Unknown if OP is currently inside or outside the US. If outside, then it's illegal for OP to have preconceived intent to AOS.
I don't understand what is not legal?
to marry there and go back in Europe?
It is allowed to marry in US during vacation with an Esta?
in IR-1 / CR-1 Spouse Visa Process & Procedures

Hello, i ask if it is possible for a person to go marry in US with the family of the petitioner and go back in France?
Some people say we can, others say we can't.
thank you very much
