  2. Hello everyone, i apologize if i haven’t completed yet my profile. These last days was just so crazy for me. 

     

    I got already my k1 visa and the yellow packet. I also have my cfo seminar that gave me sticker and cert. what else do i missed? Are these the only things i need to present the port of entry? I am from the philippines. 

     

    Please help me. My flight is on thurs sept 26, 2019. I am nervous. 😆

    As a K1, when checking your case online at CEAC.state.gov you have to select "immigrant visa" as it is treated like as such even though it is a "non-immigrant visa".

     

    Your K-2 will follow just give it some patience. I've experience the same thing and it evidentially in a day or so worked itself out.

    Hello guys, thank you for all your helpful responses! Yeah, as i checked.. i was actually clicking the wrong part. I should check the one for non immigrant part. 

     

    It is already flagged as “issued” and just waiting for my visa now.

    Manila US Embassy states that a scanned copy of the signed I-134 is fine, if you don't have the original.

    i don’t know the specifics of your country but usually you have to have an interview schedule and have the proof to take it with you for the medical.

     

    also, it’s in your best interest to do the medical closer to the interview date as your visa expiration will be tied to it

  7. Hi everyone, im sorry if my question has been asked before. Please send me the link of the discussion if you know one.

     

    im from the philippines. The CEAC status is now “ready” and i already have the email from nvc of my case number. I already registered online for my medical exam at st lukes. But i haven’t sched yet my interview. Will that be ok? Or its a must to have the interview sched first? Thankyou so much for your responses.

    The letter from the employer will be fine in verifying his income of $45K going forward into the future. The 2018 W-2 will be used to support the claimed income on his 2018 IRS tax transcripts which you are required to submit.

     

    Note that the "guidelines" are just that, guidelines. These are not hard redlines that if you surpass you're automatically approved. The CO makes a judgment based upon the "totality of the circumstances" as to whether the petitioner has shown an ability to support the beneficiary upon their arrival in the US and prevent them from becoming a public charge. This "totality of the circumstances" takes much more into account than just an income number.

     

    For example, if you are planning to live in NYC or SF, this income of $45K is likely insufficient to prove support since the COL is so high in those areas, where it may be fine if you plan to live in Iowa. Additionally, the fact that your fiance has only had his job for a few months and showed such low income in 2018 may also be taken into account (i.e., what is his employment history? Has he shown an ability to have continued employment?).

     

    Without further details it's hard to know whether the income will be sufficient to prove support. At a minimum though, I would attempt to verify all income (the $45K which you have a letter for + the side income).

     

    From your other posts, it appears that you are attempting to domecile in San Francisco. Just my opinion, but $60K is not enough to support 2 people in the Bay Area in the #1 COL area in the US. I think that your case may be borderline, but interested to see what some other more experienced members think.

     

    If your case truly is borderline, I suggest lining up a co-sponsor now. That way if you get rejected at the interview, you already have a co-sponsor lined up. If you get accepted then great, no co-sponsor needed. Having this lined-up ahead of time will save you worry in the event the consulate ends up requiring a co-sponsor.

  9. Hello everyone, my american fiance is gaining 60,000 usd annually. 45k from his permanent job which he started october 2018, and 15k from his 2 website part time jobs. He can get all the proper documents from all his job. My only question is: is it ok that his w2 form only states that he gained 9k something, because its duration is october 2018 to jan/mar (not sure if jan or march) 2019. Because its his new job. But he does have a certificate of employment which states that he will be paid 45k annually.

    I didnt applied for any waiver since i do not have bar. The k1 petition took exactly 3 months to get approved.

    Hello yes, don’t worry. There’s still a chance that you will get your k1 approved. Just like what happened to me, i was deported then applied for k1, we got approved and i am just waiting now for my medical and interview. I hope all things go smoothly. 

  12. I was deported back to my home country right after my arrival in san francisco. They took my phone and searched through every chat. They found out that me and my boyfriend have intentions of getting married. Same day, i was sent back home. They didnt barred me, they just revoked my visa. 

     

    After that, we applied for a k1 visa and after exactly 3 months, we got approved. Do i need a waiver for my case? Or any forms because i was deported before? I just dont wanna present again myself to the airport only to crushed all my dreams of being with my fiance.
