  1. We just got the case status update yesterday that my husbands interview was scheduled! We are still waiting for the letter in the mail to get the exact info but I've been told the date/time is typically 4-6 weeks later.

     

    What do we need to prepare for the interview? We are going to make an appointment to get his medical done now, as we've been holding out for the interview since I know the exam expires.

     

     What all do we need to have together to take with us to the interview? I know everyone's experiences are different, but is there anything that we can definitely know to expect them to ask of us?

    Did you ever get an RFE asking for the petitioner's debts/liabilities? I am taking the instructions quite literally and am interpreting that the instructions are telling you to include just the beneficiarie's debts/liabilities which my husband (who came in on a K1) does not have yet!

    We filed the paperwork with just my husbands debts and liabilities but included assets for the household (him and I) and everything was accepted - my husband got his work visa approved and currently we are just waiting for an interview.

    Yes we filed everything concurrently with his I-485 in March 2020 and paid the appropriate fee's.

  4. Hi all - my husband got his EAD approved in September (based on his AOS application). When does he need to send for renewal? At this point we are still waiting for his interview and there haven't been any updates to his case. We just want to make sure he can continue to work in the meantime.

     

    Also, when we send for renewal do we now have to send the form fee or is it still $0 since he originally filed with his I-485? We also need to send all of the same documents it initially required, correct?

  5. Hi all, I know things at USCIS are still a bit of a mess due to COVID. We had originally applied for AOS for my husband in 9/2019, which was denied due to a birth certificate error on our part, and we reapplied 3/2020. They utilized his previous biometrics and we received the courtesy letter about needing his medical exam. Our processing center is NBC for his EAD and until about 2 weeks ago the processing time was on target for 6-7 months and they were processing applications from 2/2020. Suddenly the processing time has now jumped to years and it says they are processing apps from 08/2017. I know this has happened with other processing centers from posts I have seen on facebook. Are we really going to have to wait 2-3 years now for his EAD? My husband has been out of work since August 2018 when he came and stayed in the US with me through December 2018.

     

    He returned to Canada with every intention of getting a new job, saving up and having a more "normal" progression of our relationship, eventually getting married. Well, he applied for jobs for 2 months, never getting anything despite having a solid work history aside from the few months he was in the US with me. We decided he would come and visit again for a few months over the summer and about a month into his stay he found out he would no longer have a place to live if he returned to Canada. We made the decision to get married and apply for AOS so he could stay in the US.

     

    So, it's been 2 years since he has been able to work and he's going a bit stir-crazy with nothing to do all day (I'm a nurse manager with a crazy schedule) and he is really itching to get back to work and help provide for us. I make a decent amount of money, but covering everything for both of us has definitely stretched things thin. I know it's difficult to get an EAD expedited on financial hardship alone and that it's more likely to go through if there's also a job offer - can he have a job offer from anywhere, even if it's from the grocery store down the road until he finds something better? Are they picky about what kind of job it is, or does it just have to be "a job"?

    I was hoping to file i-130 and i-485 together but with everything that has to be attached to the latter, it could take weeks/months and I don't wanna stay completely out of status for that long.

    So the I-130 is what the USC or LPR completes to petition you and basically shows “hey I want to bring this person to the US and here’s how we are related”. It does not grant the immigrant authorized stay. The I-485 is your actual petition/application that lets uscis know you are seeking a green card, and this grants you authorized stay once uscis accepts it. Until that happens the immigrant will be out of status. Once you are married and send in all the forms and it’s accepted, uscis often “forgives” the duration of overstay especially if you can explain it (it also helps that he will be your spouse).

    Debating whether we should do this, as well.  I guess it's worth a shot!

    We did receive a credit report type document in the mail about 10 business days later! All it had on it for my husband was a credit card I’d added him to as an authorized user, but I’m glad we were able to get something, god only knows if we hadn’t and uscis denied for it or something!

    unfortunately i can't really give a great timeline, we added him as an authorized user sometime in 2019 when we originally submitted his AOS packet. We found out it was denied this February because of a mistake with his birth certificate so now we are re-filing and have to deal with everything that comes with the I-944.

    I am concerned  about AOS before my I94 date expire.

     

    additional i find it difficult to retrieve additional documentation about language skills and US validation of my English Degree.. due to COVID19 these offices are also closed... what do you guys do ...

    I have a certified copy of my transcript incl a descriptive of the UK education system ...I have US Federal Aviation Authority issued documentation ( pilot licences etc stating i am english proficient- hopefully this will be accepted.

    yes, we did receive documentation in the mail from equifax. it took about 10 business days before we got it

  11. We are finalizing the i-485 packet to refile hopefully tomorrow or saturday, so we are triple checking all of the forms and the instructions. My husband is from Canada, so english is his first (and only) language. The i-944 instructions make it seem like we have to prove how fluent he is in english, even though it's his first and only language? anyone have any feedback?

     

    "Native English speakers, or other language if applicable, must provide documentation of language proficiency including language certifications. Evidence of language certification may include high school diplomas and college degrees showing that the native language was studied for credit."

     

    How on earth do we provide something that doesn't exist? We ordered a copy of his high school diploma, but there is nothing that explicitly says or shows he is proficient in the english language.

  12. So this is per the i-944 instructions:

     

    "Foreign education should include an evaluation of equivalency to education or degrees acquired at accredited colleges, universities, or educational institutions in the United States. For a list of organizations that provide equivalency evaluation, see the National Association of Credential Evaluation Services (NACES), at http://www.naces.org/members.htm."

     

    Basically any education outside the US that is beyond a high school diploma needs to have an equivalency evaluation.

It wouldn't make sense to include the debts of the entire household if the applicant is not (and will not) be responsible for them.

    Hi, Equifax asked us to send a copy of his birth certificate and Canadian Passport with a cover letter explaining what we needed and why. We did get a small packet in the mail for him - i'm not sure if its truly considered a credit report but the only thing on it is a credit card I added him to as an authorized user. it took about 1.5-2 weeks for us to get it once we faxed the request to them.

  15. We had to call the agencies and request by phone that they check. Equifax asked us to send copies of my husbands birth certificate and Canadian passport and a cover letter explaining what we needed and why. We did end up getting a "credit report" in the mail, but it's only because I added my husband as an authorized user to one of my credit cards. Otherwise they should send something showing no credit report. This is the only way that I have found to get what USCIS is asking for on the form.

    Double check your forms. USCIS did not upload the 10/15/19 forms until 2/24 when the I-944 became valid, so you may have to download and fill out the new version of the forms. The other info is correct.

    No, because they did not accept your forms so nothing has been filed.

    Same issue for my husband. I was originally told by our benefits people that i could not add him until he had his visa, but it was apparently incorrect info and i could have added him all along. now we have to wait until open enrollment for 2021. I asked my company to write a letter stating he qualifies to be added to my insurance during the next open enrollment period, I havent heard back yet if they are able to provide it.

  18. hi guys, I am finalizing everything to get my husbands i-485 refiled with the new i-944. Just want to have a double check and make sure im not forgetting anything. we are still unsure about some parts of the 944, like in the instructions it says "You can also provide any documentation from the household members’ assets" but it does not have any similar verbiage for the debts and liabilities section just "Provide a list of all your liabilities or debts. Examples of liabilities and debts include mortgages, car loans, unpaid child or spousal support, unpaid taxes, and credit card debt. Provide documentation for each liability or debt." I have debts but my husband does not. should I just include mine to be safe?

    How did you show that without a SSN though? none of the credit reporting agencies or even credit karma will populate anything without a SSN.

  20. We are having the same issue for my husband. I did add him as an authorized user to one of my credit cards and it did not require a SSN, but we have not been able to check if he has credit report or score since he does not have a SSN. We called equifax today and the representative ultimately had us write a cover letter with what we were requesting (verification of an existing report or the lack thereof) and an explanation with why it was needed. They asked us to include a copy of his passport and birth certificate since he does not have any US issued ID or any other form of government issued document (they even said a w-2 or 1099, which we obviously dont have since he cant work) and fax this info to them. It will be 5-7 business days before they send us any type of response in the mail. We are ultimately worried about this though as we are re-filing his 485 due to a prior denial and we only have 30ish days to do so before they could essentially deport him if he doesn't leave.
