  1. I'm march filler as well been waiting for a response for over a year as most of us in here. Does anyone know since next month most of us more likely have been in the USA for 3 years in March. Does that mean my wife can apply for citizenship since I was born in the USA. It says only 3 years for people that married to a citizen. 

  2. I went with my wife and kid. We checked In and waited about 3 hours before being seen. It turns out many immigration officers were out sick. Anyways the immigration officer just asked a few questions. Age, birthday, full name and ask the typical questions about ever being arrested. We did a small talk about how we met. We over looked our birth certificate and instead of bringing the originals we had copies. So the Immigration office said it was not a big deal as the department state had already verified it. She said everything look good but she has not received the K1 Packet so she couldnt make a decision. The office said the k1 packet should arrived next week and she will provide her decision then. 

     

    So one note guys, bring original documents, don't do what we did. Bring as many original documents, they won't keep any and its just for verification purposes. 

     

    Has anyone ever heard about the k1 packet being missing and still waiting for it to be delivered from another USIC office?

    You could file taxes with W-7 application for ITIN, but I assume you want to file taxes with SSN for the stimulus tax credits. SSN is a requirement for them to get stimulus tax credits.

    Yes my wife applied for EAD but thats still pending, Biometrics appointment is on the 20th of Jan, you think i should just wait until that's processed?

    Biometrics are mainly for background check, it's not necessarily tied to the interview. Before covid it was common to have biometrics within the first month after applying.

    a background check after you already in the states? I mean what was the point of her K1 Visa paperwork? you would think they would want to make sure they know of your background before stepping into the country and staying.

I have googled the heck out of this since I learned about the injunction of Dec. 2, to see if anybody knows anything about this whole mess and I even tried to call USCIS, but no success. USCIS keeps hanging up on me when I keep asking the bot to let me talk to a representative. 

     

    Basically, it seems that the DHS have 45 days to counter appeal this decision and I guess in the meantime USCIS will just pretend nothing happened lol while everyone in my situation has to stress and shed a lot of money to obtain the pile of documents and evidence that the form i-944 requires anyway.

     

     

     

    Thats why i was surprise, I received my RFE last month and two days ago we received the appointment for biometrics for my wife and son. So I'm not sure, wouldn't the case be on hold until i-944 is filled out and sent out. Also my son never received his RFE for i-944 request.

    gosh it's so revolting that when i filed the AOS back in August 2020 while the supreme court decision made the i-944 not applicable, all the pages for the i-944 were removed from the uscis's website and they said they would discard any form i-944 sent with the aos. it was as if the i-944 never existed. 

     

    now that the decision was stayed, the uscis was super fast (LOL) to send all these communications requiring the i-944 from people who filed it when it wasn't required. how is that not illegal and abusive? now i am being required to provide them with a ton of information that back when i filed was not required at all, otherwise i risk my application being rejected.  the decision that was stayed should make the form i-944 obligatory only for those who file after the date of that new decision, not before.

    Preach it!!! You know what irritates me the most is the actual information being requested. I believe this should Apply to people being in the states for years already that somehow manage to grow roots. My wife is freshly here since January 2020. She hasn’t been able to get an state ID or Ssn because we waited a bit too long to use the i94 arrival form. So we couldn’t get a bank account with her name since everyone asking for Ssn. I manage to get her into my health insurance. I currently don’t have many assets to begin with. So I’m not sure what’s the point of this. She won’t go asking for Medicare or food stamps? One who year here practically wasted. Imagine I could of received a stimulus check if I had her and my son on my taxes. Yet they want to know if she has a credit score. 😭

  7. Back in August, i sent our package for the third time, The last rejection was due to the missing 944 but since they had taken that requirement away. I was able to submit it without it this time. I printed the page where it said it was not required. Today I saw a pending Charge of the 485 hit my credit. So far from all rejections, I never saw a pending charge. So this seem like positive news.
