  1. I honestly wish i had that optimism at this point. The US govt were served, they now have till Jan 14 to respond. Based on what i have been seeing, there is a trend for them to continue throwing every delay tactic (extensions, motions to dismiss, etc) in the book rather than adjudicate, soooo…at this point it looks to me that i will continue to languish many more months. And i can’t tell you it feels great.
  2. It is actually impossible to say exactly because there is no clear rule spelled out anywhere that I know of. We had this debate on another thread a while back. The answer is “maybe yes, maybe no”.
  3. As far as I know, the passports usually come back around two weeks. If you received the 5535, then right now you are technically "refused" and pending further adjudication. That has already happened. You are not "denied", however.
  4. Personal layman opinion here: 60 days is still pretty early. If it was to go to court, I don't think it would be successful, and nowadays it seems the government is starting to push back on these suits. I would at least give it 120 days before you even start considering it.
  5. F___* them. Seriously. Why is this happening to me. This is likely another tactical maneuver the consulate is using for delay, and then the law firm i paid $5,000 USD says it isn't of their concern. Maybe i sound like a "Karen" guy at this point, but honestly I am tired of this.
  6. so yesterday as I said before my status changed to "Expiring Soon" all of a sudden. I sent email and called the law firm I am using, Hacking Law, about this and this is what the paralegal gives me as a response: HAHAHAHAHAHAAHA This is indeed very speedy. Interesting.
  7. I mean, it isn’t even accurate, obviously. The good news is that has to mean someone is doing something in the background in the case file, but that is bizarre…I have sent email to the lawyers to ask about this.
  8. Best case scenario, sure, i could believe this hypothesis, though I am skeptical. I don't think there is much evidence to say that the courts are insufficiently deferent to government requests, however. It seems quite the opposite. And a high proportion of people here (though not me) have chosen to go with Goldstein Law, and the judges in many of their cases are, in fact, granting the government their extension requests. I hope I am wrong.

Quite honestly, I also fear if they did waste the time and the taxpayers' expense to actually go to court, the govt will be successful in many cases only because of how much leeway the judges give them on the issue of what constitutes "unreasonable delay". The merits or demerits of the person's specific immigration case have little-to-nothing to do with the WOM suit, either.
  10. I think they have already been asking for and getting a *second* extension on some cases, and that does not look good. Only 3 of the WOM cases at Montreal were approved this month, apparently. I am exasperated with this. They are just doing everything they can to slow it down.
  11. What's worse, it looks like they are starting to delay as much as they can on the WOM cases too. I hope I am wrong. I will feel like a HUGE sucker if I actually put down $5k USD to be transported into a new black hole.
  12. Sorry to hear this Ashley. No one is going to be able to tell you how much time they will take, because it is like a black hole. take my own case, for example, and hope your results will be different. My interview was October 25–of last year. That is right, I have been in AP for 1 year today. I was given DS-5535 and returned it to them on Oct 28, 2021. Today I am still waiting. May you not have this drag on like it has for me.
  13. Super coincidentally, or not?, my CEAC "Last updated" was updated today for the first time in months. I am not sure if this means the law firm filed the complaint or served them already, because I just approved the draft complaint on Friday...
