    omg, if they really deny him entry, will they take my son alone and board him back? He's only 8 years old. Can I request to stay with my son and back to China together?

    We just bought the insurance for added coverage.

     

    Actually, the first question on the website is asking about my SSN. We though without the SSN we can't go to the next step.

     

    However, we just try skip that question, and it let us go to the next page.

  3. My K1 application is gonna expired within 1 year but Consulate still NOT open for interview yet. How can I apply?

     

    I have got the Notice for K1 visa applicants on 1/1/2020 but the Consulate in China closed till now due to the pandemic. On my letter it said if failure to take the requested action within one year will result in your application being terminated. I'm worried if the Consulate don't open back before end of this year, my application will be terminated. How can I prevent it terminate?

    And they wouldn't reject specifically because she is retired.  They reject because they deemed her to be an overstay risk due to lack of ties to her country.  Ties can be things other than a job though.

    Yes. I cannot book the good time for my mom's interview (She only has 10 days to interview before she go to travel)  and that's why I finally choose the agency. I asked them about my mom's information what we should provide them before they fill the form. But anyway I think you're right,  maybe it's not only because her working history......I need to find out more details.....

    Also, if your mom just applied last month and turns around a reapplies, it is likely going to be another denial. Her circumstances hasn't changed in this month so what would be the compelling reason for her to overcome immigrant intent. Her applying with her husband does not disprove immigrant intent.

     

    But they are free to apply. Let us know how it goes. Hopefully, they will get lucky.

    For my mom's visa, I believed last time the agency make some mistake on her 160 form. That's why I wanna try one more time...... they will interview around end of July. I will update after that.

    I would guess that your parents reapplying one month later for a B-2 visa will result in another rejection, but that is your $160 to spend.

    I just called another agency just now, they said same. It shouldn't affect my K1. 

     

    For my parents B2, because I'm worried about after I applied K1, it would be much more difficult for them to get B2. So I wanna try one more time. It doesn't matter pass or not. Just try. lol..........

     

  7. My mom applied B2 visa on beginning of June this year but she got rejected. I wanna try one more time -- apply my parents together for B2.  We really wanna travel together this summer. 

    We didn't summit any document for my K1 application yet. We wanna wait for their visa first. Whatever pass or reject, we will summit K1 later. 

     

    But there's one of the attorney said,  my parents application will affect my K1 in the future. The officer would think my parents wanna using my marriage to reach their immigration purpose. 

    He suggested us to stop my parents application now (But I already summit the application and got the interview date). 

     

    My question, 

    1) Is my parents B2 application really affect my K1 visa in the future?

    2) If yes, how can I do now? I already booked the interview date. If I cancelled now, will it affect also?

    3) If yes affect, can I apply the IR 1 visa?  or any other suggestion?

     

    I'm not really understand about the attorney concern. But As I know, even if the officer really think like my parents using me, but if they apply in the legal way, it would be ok, right?

    Consent for the child to move, and giving up parental rights are completely different things. The officer was in this case looking out for the child's biological father in protecting his legal right to the child.

     

    The notarized letter of consent for the child to move to the US (NOT consent that he is giving up parental rights) is what you need.

    Thirdly, if you were here for business and primarily did business, but stopped by him for birthday, that didn't shift your primary reason of entering US, which was business. You didn't do business 24/7, did you? You went to eat somewhere, probably sightseeing as well. That's expected, and not out of ordinary.

    As i said, don't say unless asked. And regardless, you're good as you were here to do business, and just swung by.

    Yes, answer honestly that you will visit your fiance. That in itself should not have to cause issues. Make sure that you bring plenty of proof for your ties to your home country (job, house etc.) so they will know that you will not stay in The States.

    If you are filing in July and you already have the NOA1 when you travel in August, bring that with you so you can show that you are doing your Immigration the legal way and will not cut any corners.

    Yes my original country is China. And I try to get the notarized letter with sole custody before, but the officer rejected to do that. They said it's illegal in China. Both parents have the custody and nobody can 'give up' until die.

     

    And now we're planing to get the notarized letter from child's father to claim he consents the child immigrate with mom (me).  I hope it works.

    I think I will make sure to put all information on the letter, just in case if the USCIS will ask for more document or files. It will waste time.
