    Yes its now close to one month, since I sent that letter to the officer but did not got any response. I also did service request more than a month ago, which was not responded as well. I talked to L2 officer but that was no help as well. Per my L2 officer my case is on extended review. I only have some speeding tickets that's it. No travel outside as well. HE just told me to wait because it is still  within normal processing time, which is 15.5 months in DC. I will be calling my congressman tomorrow again to check on my case status.

    Yes I got gc , after that I moved from Washington to Chicago. It was 5 years ago. I got interview in Chicago on June 18 everything  went smooth , officer was really cool but I got paper “decision can not be make”  and he told me my file is lost. After 90 days I started with service requests and I called 800 number multiple times. They have never told me that my file is lost. They kept saying “pending and reviewing” . Last time L2 officer told me that file is in Washington. Really confusing and frustrating. I ll wait two more weeks and I ll hire the lawyer. I don’t feel comfortable to handle on court vs USCIS case by myself .

    but they will send to Chicago shortly. Every time they tell me something different. I contacted 2 lawyers in Chicago both of them charge $2500 for WRIT on Mandamus. After that they told me you got your decision shortly ( approved or denied) . USCIS lawyer almost never go to Court. It is been 130 days from my interview.

    Thanks for this information, So you got your green card already, and waiting for N-400 approval? Good luck and please update me.

    Lawyer explained to me if I understood well, that they don’t  actually file lawsuit, they just give Uscis kind On warning that they will sue them if they don’t make decisions and in 100 percent on cases they make it.

    Will you send this warning? I talked with the lawyer and tol me that filling a law suite is very expensive and not all immigration lawyers do it. Please let me know your updates. Thanks.

    I filed my cases the same time as you, I-751 on Feb-2018 and N-400 Jan-2019, at this moment I have my I-751 approved (Green card on hand and NO combo Interview)  and I was waiting for my N-400 decision, but today I got a massage on my online inbox from USCIS that due to unforeseen circumstances they had to cancel my previously scheduled interview on June 05-2019 (my first N-400 interview)  that they will rescheduled interview appointment information under separate notice, then I checked the status fo my case and it seems like they send me a new notice with my new interview appointment.

    This sounds so weird to me. Good luck man. I really give up.

    I am not sure if he know how many people start applying for N400 waiting on 751, and being approved together 🙄 

    13 months is for N400, and I have another 4 months to wait for that expiration, but he says USCIS goes over it sometimes without action. And yes, I am Over 160 days from N400 interview. 

    I see, so What about I-751? But from what I read you can do Mandamus action after 120 days from interview!!!! Tomorrow is my 120 day, I will talk to lawyer too and will see. 

     

    Sorry, I think you said earlier that you got I-751 approval already.

    i called again, i got the “number” for Tier2, supposed to call me. It hasn’t happened.

    I found one lawyer for 30 min free consultation (usually those things are $200). 
    This was today. He told me:

    - that I shouldn’t have applied for N400 while I751 was pending.

    - That, basically, I751 being approved sits in CSC not assigned to any officer, and they also didn’t probably send any notification to my field office about I751 being approved. 
    - that N400 documents sits in field office, not assigned to any officer, cos I had interview, and there is no any notification about 751 being approved, so no one cares anymore

    - that I can wait until processing time is over (max 13 months for field office), and that those 120 days don’t matter to them, cos I had I751 pending (?)

    - or I can withdraw n400, and re-apply again, paying again and biometrics + interview all over again. 
    - going to the court would be thousands of $

     

    i don’t know how much of this is true, I will try to find another consultation, there is one cheaper, I will pay and hear another opinion.

    OOh this sucks. it doesn't sound right to me, you are eligible to apply for N-400 once you have green card for 2 years 9 month if you are married. Also, I know many people got approval in both cases which is I-751 and N-400 together. don't withdraw the case. I'm just wonder what your lawyer said about waiting for 13 month, is that for N-400 pr I-751? Are you already out of processing tie for I-751 and over 120 days for N-400 interview?

    do you mean to sue USCIS according to 120 days rule? That is in consideration, i really don’t want to deal with that, plus it is over $400 just to file. I hope something will happen.

    my timeline:

    —n400 in May

    -approved and received green card I-751 in July

    - 120 days passed as of September 9th, so over 160 days now :( 

    Even when I call with Tier 2 the same nothing different. But at least you got something I didn't get anything yet. Did you think to request judicial check on your case?

    But, all the call I made, all the emails I wrote to them, they would be like “you are within processing time”. Then, when I explain 120 days, it seems nobody knows (at least those Tier 1, first level) about it.

    The same here, every time I call they tell me something different. I know I feel i'm the most unlucky person in that world, people had their interview 3 month after me already citizens now. So how far are you after 120 days? did you get DC or still waiting for both too?
