  1. Hello!

     

    I wasn’t sure which forum to use for this question, apologies if it’s wrong. 
     

    I’m currently in the US on a K1 visa awaiting my green card. I’m married to a US citizen and my green card is currently pending. 
     

    My family are from the U.K. and have flights booked to visit on September 18th. With the travel ban in effect, is there any way my mother/grandmother and stepfather can come and visit me since they’re immediate family? I’ve tried researching this online but nothing is very clear. 
     

    I was just wondering what process we could take as I’m not yet a permanent resident or a US citizen. Could my husband even be used to allow them to visit as they’re now his immediate family  and he’s an American citizen?
     

    Basically is it possible and if so, what would we have to apply for :)  we have rang the embassy but they were less than helpful..

    A joint tax return has a line for “total income” (Line 7b of the 1040) It combines all income for both filers without showing who earned what. Look at a tax return Form 1040.  It doesn’t say his salary/her salary anywhere on the form USCIS will view.  Form 1040 https://www.irs.gov/pub/irs-pdf/f1040.pdf

     

     So on a joint return, USCIS does not know if your sponsor earns enough by himself (or herself). Many people list the spouse of the joint sponsor as a household member (Person 1) on the joint sponsor’s I-864. Then that spouse fills out an I-864a and provides proof she is a USC with a birth certificate as above.  An alternate which I think works and easier is showing clearly that the joint sponsor earns enough. An employer letter addressing his employment and yearly salary would help along with his W2 showing his earnings are enough. I would make note of it where USCIS would notice it. “Proof of joint sponsor’s separate income—-Employer letter, W2. “ 
     

    Thank you again for the help! This makes a lot more sense and is likely the reason.  I will update when we get the letter 😊

    If it is about your joint sponsor and his affidavit of support, they need HIS birth certificate (or passport) to prove his US citizenship. Sounds like you sent yours instead. 
     

    Also if you sent photocopies of tax returns without the matching W2 (or 1099) wage statements, they will RFE.
     

     Or if your joint sponsor is married and filed a joint tax return, they need proof of his separate income because a tax return lumps it all together. 
     

    Any of these sound like why you may have gotten you first RFE wrong?

    Ahhhh! Thank you so much. We actually forgot

    to send my birth certificate with the initial package so just assumed it was that and sent mine. I didn’t even think of his!

     

    Also it was filed joint but my husband says it states the Income separately despite filing together? I’m so confused!

    You really don't want them to do this, because if they are sending another RFE it means they don't yet have enough info to approve the petition.  An adjudication based off of what they currently have would be a denial.

    I’m just confused as they sent us an RFIE 2 weeks ago, we met everything they asked and MORE and now we have another RFIE. An RFIE is requesting evidence we were supposed to supply when we submit the application (from the list of bullet points) Since we sent the remaining items last week how could they need anything else? 

    Sorry if you already knew the difference, I’m just baffled as to how they could warrant a further RFIE? I would understand asking for additional info but not more initial info. 

  5. We had an initial evidence RFE 2 weeks ago for a birth certificate and tax documentation for our sponsor. 
     

    I sent in all IRS tax documents for this year and the last 3 years for both my husband and our sponsor. I also sent in my full birth certificate with all parents names on, registrar etc. 
     

    5 days after they receive it and my case has updated saying they’re sending me ANOTHER request for initial evidence?! First I’m confused as I thought they had to adjudicate based off what we sent as we had one shot with the RFE. I’m utterly confused with what’s going on? Has anyone else experienced this?

    How has Covid prevented filing taxes?  In less than 10 days, 2019 taxes are due.  Personally, I would file for 2019, then send tax documents for both sponsor and joint sponsor.

    My in-laws who are sponsoring me own a business and have to go to a company to get their taxes done which has been shut. They’re in a rush to get it done now by the 15th, but I was hoping there would be something else i could submit for past years instead of having to wait on them.. 

     

    Would there be anything I could submit. Or am I going to have to wait. We did send the sponsors documents for this year so I’m assuming they just want the joint sponsors?
     

  7. Hello!

     

    My husband and I have received an RFE today. It states the following is required:

     

    ”Submit all supporting tax documentation (W-2s, 1099s, Form 2555, and all supporting tax schedules) submitted to the IRS for the most recent tax year”

     

    ”The petitioning sponsors household members, Darrel, must submit all supporting tax documents for the most recent tax year” 

     

    So do we just need to send in Darrel’s documents only? Also, due to covid he still hasn’t filed his taxes for the most recent tax year. We sent the past couple of years across showing his income from his pension which exceeds the 125% poverty guidelines. 
     

    What would you recommend given he hasn’t filed taxes yet due to COVID? As the year hasn’t ended I thought it would’ve been fine to present past evidence?

    They will do the interview and put your approval on pause until you send in a proper birth certificate. Be sure you understand clearly how they want you to send it to them. Ask questions before you leave the interviewer.  It won't be by Royal Mail.

    Thankyou so much. Had a little meltdown at the hotel with my fiancé as he’s visiting. Glad to know it can be resolved with a short delay :)

    The impact of this would be that it would take longer for your visa to be issued (as they’ll have to wait for the medical results to be sent over) - but if you’re ok with waiting an extra couple of weeks or so, no problem. Of course, if there’s an issue at the medical, ie, you need to provide some other documents or something, again, this would delay stuff - but once the medical side is all sorted, the info would be sent to the embassy, who would then start reviewing/issuing your visa (it’d have to go through AP before being issued, but all visas do).

     

    Re best way to do it - I would suggest finding a suitable time/date appointment on the visa interview webpage - then give Knightsbridge a call before booking, to confirm they have an appointment free the day before. Then book both.

  10. Hello!

     

    I'm just wanting to clarify a few things before our interview in a few weeks.

     

    With the I-134, we are using a co sponsor. Am I correct in assuming both my fiancé and co-sponsor fill out separate forms and both provide documentary evidence. In addition, is the IRS tax transcript and documents from bank on deposits and date account opened enough?

    I've noted the medical and interview both require ACCRO. Do we need two copies or is one ok?

    My husband lived in the NE region, same as you. I personally (even as annoying as it is) would not book something like that one day after another, in fact I'm not even sure it's possible. The medical people need time to review and send the results along to the embassy. Depending on the specifics of the case something could crop up at the medical that would significantly delay it too. Under normal circumstances If the embassy hasn't any results this will delay the case as they won't be ready for you. Please make sure to have your vaccinations done before or during Knightsbridge.

     

    My husband drove all the way to London both times. Yes it required to get up very early but it was cheaper than train tickets.

    I’ve scoured online and always thought it is possible to book your medical followed by your interview the following day. It says on the embassy website you can even schedule it after the interview which surprised me! 

     

    I realise it causes delays,  usually around 5 days for Knightsbridge to post it? I’m wondering now how much it would delay me getting my visa by if we do it this way (providing there’s no issues)

    I was just wondering, is it possible to have the medical at Knightsbridge and interview the following day at the US embassy in London.  I realise it causes delays I just want to confirm it can be done. 

     

    Also, providing everything is fine document wise, does anyone have any idea generally what the delay would be?

    Oh blimey! I did wonder that but didn't want to risk it. I think I filled out the employment history page 5 times due to errors with the website before it eventually allowed me to save! I'll just take both confirmation pages just to be on the safe side. Should this be ok?

    The website was very temperamental and it totally skipped a page on my employment history. I didn't realise this until I looked online. I've created a brand new one and ensured the page was filled in (it actually did the same thing and skipped it!). Am I right in thinking I take both confirmation pages and this should be ok?

    That documentation of NVC email (or the letter of instruction from the embassy) are not needed for anything else except showing at the clinic. Not needed or shown at interview. 

     

    The London embassy instructions on the website changed and are weirdly confusing.

     

    I would suggest:

    1. Submit DS-160.
    2. Gather documents. (for interview as well as documents for medical appointment). You don't want a looming appointment if you hit a hiccup and won't have what you need for the appointment. 
    3. Book your medical date by calling the clinic. 020 7486 7822. 
    4. Book the courier, pay, and pick an interview date all at the same time on https://ais.usvisa-info.com/en-gb/iv. Select “I have received a letter from the consular section with instructions to register or schedule a K visa appointment”. Leave 10-14 days between medical and interview for best results.
    5. Attend your medical.
    6. Attend your interview.

     

    Gather documents step is important. See lists:

    So just to clarify, I book my medical now, I can then book my interview as well as paying the fee/arranging courier. All they need as documentary proof to book both (apart from all the obvious docs listed on the websites) is the email I had with my NVC number saying they've posted to the embassy? :)

  18. Quick question!

    We've received the email on 17th October stating the file was forwarded to the Embassy with our NVC case number. Our case now states it's Ready, however I've not received any documentation (i'm assuming ready means the embassy has it?)

    I've completed DS160 today and have collected all the documentation needed. Am I right in understanding I can book the interview/medical without having to wait for the letter from the embassy with the instructions? (we just use the email with the NVC number for the medical)
