    With USPS specifically, I can actually mail it up to 3 days after that shipment label's date (I had to verify this was publicly disclosed before posting :P). Although they do actually provide a postmark when they get it. I can't speak for UPS, FedEx, DHS, etc...no idea on their label policies.

     

    But yeah, USCIS has no way to know what is on the receipt unless you show them. If they really wanted (or if their mail room has a tool to do so, which is 100% possible), they could scan the barcode and automatically lookup the date actually shipped. But I doubt they do any such verification.

     

    My guess here is that either:

    1) At least 1 wrong form edition was sent for a pre-24th filing, or

    2) They overlooked it or just didn't care to look at the shipment date.

     

    I guess #2 might have happened to my AOS because I included the receipt from Fedex and highlighted the date Fedex was in possession of it. They only looked at the shipping label and the day someone from USCIS received it. (Posted mine in the forum

    I see. So I should have used the newer form despite the notice on the USCIS website?

     

    Thanks for the feedback. I guess I didn't understand what postmarked meant.

     

    NOTE: Form I-485 is now used to collect information previously collected on Form I-864W, Request for Exemption for Intending Immigrant’s Affidavit of Support. Adjustment applicants no longer need to file Form I-864W. 


    ALERT:  On Feb. 21, 2020, the Supreme Court stayed the statewide injunction issued by the U.S. District Court for the Northern District of Illinois affecting Illinois filers. USCIS implemented the Inadmissibility on Public Charge Grounds final rule nationwide, including in Illinois, on Feb. 24, 2020. USCIS will apply the final rule to all applications for adjustment of status, and applications and petitions for extension of nonimmigrant stay or change of nonimmigrant status postmarked (or, if applicable, submitted electronically) on or after that date. For applications and petitions that are sent by commercial courier (for example, UPS, FedEx, or DHL), the postmark date is the date reflected on the courier receipt. USCIS will reject any affected application or petition that does not adhere to the final rule, including those submitted by or on behalf of aliens living in Illinois, if postmarked on or after Feb. 24, 2020.

    The final rule requires applicants for adjustment of status who are subject to the public charge ground of inadmissibility and certain applicants and petitioners seeking extension of stay and change of status to report certain information related to public benefits. Due to litigation-related delays in the final rule’s implementation, USCIS is applying this requirement as though it refers to Feb. 24, 2020, rather than Oct. 15, 2019. Please read all references to Oct. 15, 2019, as though they refer to Feb. 24, 2020.

    I would appreciate any feedback/advice about this. 

     

    I receive a rejection notice today for my AOS, outdated form was filed.

    I dropped off my documents at Fedex Sunday February 23. I know I should have mailed it earlier but we did not get some of the documents needed until Saturday.

     

    Anyway, I included the courier receipt with the documents (with the postmark date highlighted in yellow, looks faded by now) The documents weren't shipped until the 24th.

    I have my own copy of the receipt (blue highlight) and a screenshot of the package travel history in the Fedex website.

    Yes, it would have prolonged the process/processing of the visa.

     

    We're hoping I will be able to leave for the US on the first week of April.

    I just thought I'd provide update as the forum and everyone was such a big help during the process

     

    March 13 interview, visa approved

     

    March 14 status Issued

     

    March 15 has left consular section and getting ready for final processing (forgot the exact message, but basically getting ready to be picked up by the courier)

     

    March 18 I tried to track my passport by sending email to passportstatus@ustraveldocs.com  Status: in Transit from post. And also tried MNL case number* at 2Go website

     

    March 19 By chance I thought I would look up the status before bed and used MNL case number,  it said delivered/ ready for pick up

     

    I called 2GO and they said it is available for pick up. So I got dressed and brought my ID and picked up the passport & visa packet  😊

     

    March 29 CFO GCP

     

    April 1   Flight to US finally

    I know it is weird and my fiancé's family think we're pranking them 😂 

     

    Again, thank you Hank_ for answering all my questions.

     

     

     

    *I used the UID to track my passport as well.

    And don't stress about the interview, as long as you have a genuine relationship and know each other you will be fine   .. oh that reminds me.  Have your fiance email you a copy of the I-129F as it has the BIO information on your fiance which will be helpful at the interview.

    As for cancelling an interview the embassy requires 24 hrs before.      But like said DON'T cancel!

    One thing I don't have to worry about while preparing for the interview :)

     

    I will ask my fiance to scan the documents and email them to me.

    I am a new member and have found this forum a great help during the K1 visa process.

     

    I have a question about rescheduling the interview.

     

    I am still waiting for the I-134 to be delivered by the courier from the US but my interview is on Wednesday March 13.

     

    I have all the documents needed except for that.

     

    How many day/s before the appointment am I allowed to reschedule it?
