    He must be able to prove he must return to the P I. This is the most important aspect. He applies on his own merits.

    Has anyone have an experienced applying I-130 to petition their adopted children? I would like to know how long will the whole process takes before they get to come the United Sates? I called today and the agent told me that I will be hearing from them within a week or two if it approved or denied. I'm so stress out because I has been away from my wife for over a year now because she have to go back to Thailand to live with the kids. I really want them to come to US before then next school term start.

    Are you a USC?

    Have you legally adopted them?

    You hired some agent ?

    Did you try to bring them as step children?

    I am in the process of getting married and i had a few questions about the K3 visa process.

    First, I am the US Citizen and my soon-to-be wife is Thai. We will be marrying in Thailand. I am currently here on a tourist visa and will be traveling to other countries with my fiance once a month when this expires to both travel with her and renew a visa exempt status. My questions are as follows...

    First: I'm a little confused by the application process. Sometimes I see notes that say I need to be in the US to process some of the paperwork. Is this true or can all of the paperwork be processed from Thailand? I heard DCF could work but only if I was staying here on a more permanent visa. Can we apply for her K3 visa and file all the paperwork from here in Bangkok even though I'm only on a tourist visa?

    Second: Same question as above but this time for an IR1/CR1. This would be the end goal even if we got her to the US on a K3. Is this something I can apply for while in Thailand on a tourist visa/visa exempt status?

    Third: Some of these say that I need proof of a US domicile. Staying in Thailand I currently have no lease but do maintain a New York address at a friends place for tax purposes. Would I require a lease agreement for either a K3 or 1R1/CR1? Would having a friend who owns a house who could make some type of statement saying that we may claim his location as a domicile work? Any advise on this?

    The K 3 will convert to a CR 1.

    You can not file DCF case in BKK.

    Once you marry you can file the first petition by sending it to the correct address for your area in the USA. Your status in Thailand makes no difference.

    Staying in Thailand doesn't replace your domicile address in N Y. Use the address you use right now for mail in the USA.

  4. Hi all - I applied for my spousal Visa in September 2013, After an extremely long wait, I have my interview date for this month. They have asked me to bring a tax schedule for 2013 and I cannot find out what this is. Even the person that does my husbands income tax doesn't know. Could anyone enlighten me? Thanks

    Tax transcript. See IRS site to download 2013 doc. Its free and fast. This should be part of the 864 or support docs.

  5. We are now waiting for an interview schedule (cr-1), and I've heard that you will get an answer whether your visa is approved or denied right after the interview. Is this true? Would like to hear anyone else's experience!

    Sorry if this is posted in the wrong forum. I don't use this site very often and I'm still not sure if I'm using is right. Please no sarcastic comments, just want to hear other's experiences right after the interview. Thanks!

    Any response you get may not be an example of what happens in your case because they are all unique. If your case has been presented correctly the interview should be easy and quick. My embassy said they needed 3 days to insert the visa. There are cases that are put in A P which can then take days, weeks or months to be approved or denied.

    I hope your post is in the right forum so you will get info from Japanese based cases.

    I hope someone here can assist me with my situation. My Fiance went for an interview today at the US Embassy in Cairo. Everything was fine, 3-4 questions were asked then the consular took her passport and said that they will have to do more investigations and they will let her know.

    She asked if she wasrejected or something went wrong and the consular told he that she is not rejected and not to worry. I checked her case online and i found that she is under AP now.

    Does anyone know how long this will take and what is happening here?

    Actually no one knows except those that are reviewing your case. This is common for cases in her country and is very frustrating to endure. As long as the case remains at the embassy there is a good chance of approval.

  7. Hi everyone, what if your spouse do not have enough income per year to file an affidavit of support? Can someone sponsor an affidavit of support? Is friends can sponsor? Or just related to the spouse?

    If the USC doesn't have sufficient income they still fill out the 864. People can become joint sponsors if they are related or close friends & are USCs or LPRs.

  8. The form 864EZ, part 5 number 17, asks if I am employed or retired. I am a military retiree but currently employed and so receive income from both categories. Can I check both boxes? I ask because each income considered individually is just barely over the minimum income requirement but combined is more than enough to qualify. Thanks for any feedback.

    Are you submitting at least one years tax transcript? This would indicate total income and tax status.

    I would enter the two incomes by checking both boxes. If they need something more they will let you know but the transcript will reveal what they are looking for.

  9. Thanks for the note Ning. Well, Im happy to report that I emailed them today, and sure enough we were approved. They responded back in less than 2 hours after I emailed them and said that it should be issued within the next 7-10 business days. What a relief.

    Yes my wife knows where that attitude comes from, but for as long as I have been coming to Thailand, I just still cant get used to it. I get very defensive when someone stomps on my wifes feelings, but thats just a fact of life here when dealing with their society, upper class vs. lower class. Im over it now. :)

    Im very happy with the process so far, from the first officer I met when submitting the I-130, to the speed at which they processed it. Thanks Ning and others for all the advice.

    This is good news and people can learn from what happened in this special case.

    My husband feels as you do including when it occurs here in the USA which it does. I have never had this directed at me by an American but even here have experienced it at a local Thai temple gathering. Too bad they just wont leave it behind.

    Lots to do but at least its done together for reasons that make sense. Well most of the time anyway.

  10. My wife was interviewed today in Bangkok for our I-130 DCF. The positives were a short wait time and polite American officer, but the negatives were a rude Thai interviewer and no indication as to whether or not we are approved.

    The Thai employee was condescending to my wife when the American officer asked her to translate a question, and was short tempered with my wife. At the end of the interview, my wife was told that they are keeping her passport and that we should hear back from them in 2-3 weeks which to me could mean AP. No "congratulations," no "you are approved," no "have a safe trip." Nothing. And no 221g.

    All in all I would give them a 2 out of 5 for the experience and dont want to have to go through this again. I have read all of the VJ reviews for the Bangkok embassy, and almost all that were approved were told they were approved in some sort or another after the interview and that they will get their visa in a few days.

    Anyone have a similar experience with their embassy? Not told approved or not? Told to wait 2-3 weeks to hear from them?

    Your wife probably knows where this attitude comes from. Its common with people from BKK just like N Y city.

    I think the case was put in A P because they are backed up or simply wanted to review something possibly because its a DCF case. No reason to think they would need more than a few days to finish the case. We were told it takes 3 days to insert the visa due to computer time.

    She was told to wait 3 weeks? This is not uncommon when it comes to these A P cases in BKK. I have seen the A P take several months in other cases.

  11. Finally in the USA and starting the green card process. We have a co-sponsor. The co sponsor is self-employed having their own business. I am wondering when filing the support of affidavit, do they look at gross income for the year (before expensenses) or do they look at the profits made after taxes and expensenses?

    Obviously the reason being is trying to meet the 125% guidelines.

    Gross income.

  12. being that i made a mistake in my college graduation date, is it really a big deal that i fill out a new DS160 form for that or just leave it as it is right now?

    It isn't a big deal until later if the mistake is found & your case is set aside until you make the correction. Will they find it? Why ask if you don't intend to correct the form? We all have to make decisions & do what we think is best. If you don't think its needed just don't bother.

  13. Today I got checklisted for missing 2014 tax return transcript. I filed my paperwork back in January and I submitted everything they required. Including most recent return transcript 2013, pay stubs, w2 from 2014. I am well over federal poverty guideline requirements. When I called NVC they said I was not required to send them the w2 for 2014, but since I did now they want my transcript....which I don't even have!!!!!!! Everyone I know has filed recently with their 2013 returns and have gotten cc. Why am I being punished for giving them extra documentation??? I am at a loss for words. Even the person I called at NVC said it was an unusual checklist.

    You aren't being " punished ".

    You sent info that wasn't complete. A W 2 by itself indicates income but it doesn't mean you paid the taxes. All you have to do is go to IRS web site where you can download your current tax transcript if you have filed your 14 taxes and they were processed by the IRS.

  14. Hello All!

    My son who is 13 is in the Philippines, wants to visit the US for 4 weeks as he is not prepared to stay for good. This will be his first time to visit the United States.

    I was successful to get him an interview date for B1/B2 visa on 3/31, however, my brother and sister in law who act as his guardian are the ones to accompany him at the interview as I am in the US and unable to fly to the Philippines due to work.

    My questions are:

    1. What document should they show so that they let my brother and/or sister in law accompany him at the interview being a minor? Could I write a letter with my name signed stating that I am allowing my brother and his wife to accompany him at the interview and will this suffice?

    2. Because I cannot come to pick him up my husband comes to the rescue and will fly to the Philippines to pick him up. I understand I need to acquire a Travel Clearance from DSWD for him authorizing my husband to take him out of the country. I am trying to find solutions should there be any problems as their tickets have been purchased, is there anything else besides the Travel Clearance?

    I doubt they will issue a B 2 to the child but I hope they do. What will you present to the embassy that will convince them he must return to the P I ? This will be the most important aspect. It would be very easy to just have him stay in the USA.

    Buying the tickets in advance wasn't a good idea at all.

  15. They wanted a statement on how we met and what languages we communicate with, along with his court records. He had previously been in a car accident and was cleared because they found it not to be his fault. Unfortunately, the person who pulled out in front of him died, and we are worried that even though this was cleared in the court papers, it may affect his chance of getting a visa.

    They just want clarification on how you met and communicate which is pretty standard. The other situation would be revealed in his police report I would think. I haven't heard of them asking for court records in a case. If the court cleared him then it shouldn't be a problem.

  16. Well, her basis for being in the U.S. was based on marriage to me, however I might need to consult with a lawyer to figure this petition out. I think it might be difficult though to find a good one that knows how to deal with this.

    Her basis for being here is the fact that she submitted a false birth cert which allowed them to grant the visa. If she hadn't done that she either wouldn't be here or you wouldn't now have this unique problem.

    I doubt at the time you cared about the factual qualities of that B Cert. Its is now that you need the correct indication of the maternal parent to allow her to immigrate.

    You have also found that someone in Thailand will extort money from you to break the law and produce the doc that you need. I caution you that the price will rise and the document, if you ever get one will be questionable. To submit this could result in grave consequences that even a lawyer may not be able to overcome.

  17. My fiance had his interview on the 26th, and he was issued a 221g. We've returned the requested documents a week ago, and haven't heard back from the Embassy. The status online is under "Administrative Processing." Does anyone have an idea of how long it will be until visa approval?

    If you've ever been issued a 221g, could you tell me how many days you had to wait until sending the requested documents until approval?

    This is the system used when docs are incorrect or missing. Since you have turned in the docs required the case will now continue to be processed.

    No one can really tell you how long it will take. It depends on how busy they are; they deal with about 700 cases per month. You didn't mention what the docs are that were requested so its impossible to know how long they need to review them. One case for example resulted in a 221g because they wanted to look into the background of a person. That took 60 days. A simple addition to the file of the missing docs which we assume are correct may take a few days or weeks.
