  1. Hello,

     

    So finally after a year of waiting, we have our interview scheduled.

    We were looking through the document list and are wondering if we have to bring Form I-693 and Form I-864.

    We went through the K1 I-485 process and not sure if they need these again or not.

     

    From what I have read about the Form I-693 in the FAQ page, since we went through the K1 process, we do not need this as my wife already did the examination overseas before arriving.

    Also, what type of document helps establish her eligibility for Lawful Permanent Resident status as a fiancé nonimmigrant as they are asking for proof of this?

    Isn’t this only for the first time since we filed them both with form I-485. But now that its expiring and we need a renewal, does it still warrant a waiver or?

  3. Hello Everyone,

     

    So I am waiting for my Green Card Interview to be scheduled and I just got my EAD Card with my SSN.

    I have an Australian Drivers License (expired) and I need to start getting my USA (Michigan) Drivers License. 

    Do I need to take a driving test still or just a written test? Or How does it work? Visiting the DMV is by appointment only so I have 2 months in waiting.

     

    I would assume me having been driving for years in Australia would void me doing the actual driving test so just wanted to know.

    So I am in the USA waiting for my Green Card Interview and see that my Australian Drivers License is expired. 

    Can I or should I renew it? Also when the time comes that my Australian passport will expire, can I or should I also renew that?

     

    I'm just not sure if I am allowed to have a valid Australian passport and license along with a U.S. passport and license (when the time comes).

  5. Hello,

     

    So I am living in an apartment with my husband right now and we are moving into our new home on February 5th. 

    I already changed my address to the new home with USCIS and even the Post Office so all is good there.

    But for Form I-485, for the current address, can I put 02/05/2020 to current even though that date is in the future? 

    I mean by the time they actually look into my application that date would have already passed most likely.

  6. Hello,

     

    I have a silly question that I need to ask since I just want everything to go right.

    So I am the applicant applying for my AOS and I will be using my husbands credit card for the filing fee.

    Of course all his information will go into the credit card informarion box, but the first thing at the top it shows "Applicant's/Petitioner's/Requester's Information".

    Do I put my name or my husbands name here? My common sense is telling me mine since I am the Applicant but not sure if they mean applicant for this form or actual AOS etc

    I am self employed and so for Form I-864, I just give my passport/birth certificate, tax returns and transcripts (personal and business). But in the photo attached, it shows this on the checklist: 

    • Proof of their residency in your household and relationship to you if they are not the intending immigrants or are not listed as dependents on your Federal income tax return for the most recent tax year. 

     

    Does this have to do with me? I do have a utility bill with both our names on it but not sure if it's needed or just add it to be safe.

  8. Hello everyone,

     

    We are about to send out our AOS but had a quick question. So on Form I-485 there's a section that states "Expiration Date of Authorized Stay Shown on Form I-94" but when we look at my wife's I-94 it shows an "Admit Until Date" and not really a "how long can she stay in the US" kind of date. Is this the same thing? 

     

    The "Admit Until Date" on her I-94 expired in December of 2019 and if this is the date that we need to put, does that have any complications? Since we did fulfill the 90 day marriage and will be sending it out a month later after that date but not sure if having that date will cause an issue to a USCIS agent.

  9. Hey everyone,

     

    We are gathering all of our documents so we can send out the AOS for my wife but we had a question. Many people are saying that we need to send at least 2 proof of residency (her name on bills with current address) but after looking up and down the required document evidence list, we do not see that as a requirement. I just added her to my utility bill just to be safe but it will reflect on next months statement so not sure if we should wait for that, depending if needed or not.

  10. Hello everyone. So me and my wife (who was on a K1) just got married and we have started filling out all forms for AOS but we have a question regarding SSN. So we were so rushed into doing the wedding and seeing family etc.. and we did not apply for a SSN early on for her and her I-94 is expired as some people stated we need that to apply for a SSN but we are not sure.

     

    When filing form I-765 for employment authorization, parts 13.a, 14, and 15 allows the SSA to issue her a SSN during the whole process which is nice. Now the thing is would it be better to go to the actual SSA office and apply for a SSN (if possible) or just let it be issued through form I-765 since our main concern is the timeline. Wouldn't it take longer via form I-765 compared to the actual SSA office?

  11. So today i received an email from the NVC stating that our petition is on its way to the U.S. Embassy/Consulate in Sydney, Australia and is advising us to start the DS-160 (Visa Application) now. 

    My question is, should we wait for the embassy/consulate to send me, the petitioner, Packet 3 or do the visa application and then just wait for the packet?

     

    We are so close that we are just freaking out a bit. I know that the NVC tracking says our interview is already scheduled but people said to ignore that since it's a generic reply more for the other visas and not the K-1.

  12. Hey everyone,

     

    Petitioner from USA here, fiancè from Brisbane who will be going to the Sydney Consulate.

     

    After 4 weeks of being approved, I called the NVC and got our case # and invoice #. The tracking on CEAC shows status as “At NVC” and I am not sure what to do now. Do I wait for an email from the Syndey Consulate when they receive the case? Can we start to do the medical? We’ve already done the National Police Check and I am finishing with gathering my finances and  affidavit of support. Also for the Visa application (form DS-160), do we fill it out via the CEAC website or via the ustraveldocs website? 

  13. For the evidence part, I am still confused because I do not want to overdo it with evidence in my situation. I have attached an image and highlighted the parts in question. It states that I need evidence/documents that apply to my situation and the only thing is anything in part C. Not sure if this is all I should need or not. I heard sometimes too much evidence is actually a bad thing and unnecessary. Hoping someone who is actually self-employed and has gone through this could help.

     

    And the main question about address and 1.b is still needing answer.

    I, as the sponsor (in the USA), am starting to fill out the Affidavit of Support (Form I-134) for my fiancée to take with her to her interview in Sydney, Australia when scheduled.

    I am self-employed so wanted to post this thread to get confirmation on if this part is done correctly and just a bit more information.

     

    For part 3 (attached image) would I SKIP both 1.a and 1.a.1 and only complete 1.b correct? If so, what would I put for 1.b as I have an online business and not sure if I should put myself as a Small Business Owner, E-commerce Business Owner, Entrepreneur, etc...

     

    Also in part 3 (attached image), do I leave the 'Current Employer Address' section blank or would I just put the address that's registered under my business or house address?

     

    Lastly, what type of evidence should I send my fiancée along with this form? I get paid annually (basically whatever the business profits that year) and of course I have my personal tax return to show my income of that profit.
