    I'm not in any way dismissing what you say has happened, but it is an unfortunate statistical fact that many marriages don't work out, and why should the ex spouse be able to dictate what happens to the immigrating spouse from then on?

    Having been on the receiving end of a bitter, violent, narcissistic ex-spouse who did go to USCIS with a pack of lies after we parted ways, it isn't pleasant and may cause problems (and indeed still is for me), so you could do this if you wish, but really, just get the divorce done & dusted, move, get on with your life and be the bigger person.

    There is no need to "be a bigger person". There is a need, however, to be safe and avoid any unnecessary problems in the future. It seems he used her, threatened her, reminded her that she is on the hook for I-864, and realistically, from where I stand, she should truthfully relay this to USCIS and let them decide.

     

    Yes, this is coming from someone who spent 5 years removing conditions because my ex lied to USCIS, so I have great perspective.

    Usually (from what I've heard) people receive RFE or get interviews scheduled at their local office when this happens. It means that they can't make the decision yet and they will keep going over your files.

    I am also going through a waiver filing and kind of worrying...

    There are better reasons for denial i.e. missed the 90 day window but my denial was one of the really bad ones. My ex and his attorney contacted USCIS and claimed that I didn't marry him in good faith. Immigration never acknowledged that. I found out from my ex. I went to I-751 interview with the divorce finalized and they denied based on lack of evidence two months later. I refiled I-751 and filed 290B all the same week.

     

    Some people here say don't send too many papers and be brief and straight to the point but my packages were close to 500 pages each. My statement/letter/explanation, whatever you call it, was 14 pages alone. I just forked over everything, literally. I figured, if you claim not having enough evidence, fine, I'll give you evidence. I called everyone I could. I even made Kennedy Space Center dig up our photos from when we were there for the last shuttle launch.

     

    USCIS had my paperwork for 3 years almost to date. I filed my second I-751 & 290B in April of 2016 and got the approval in May of 2019. I went about 2x year to NYC office to get a stamp and inquire about my case, before they purged appointments on their website. They never told me anything useful. They never sent me an RFE. I was waiting for a NTA (and periodically calling the automated court number) but it never came either. They told me that they will call me in for an interview "when it's your turn", whatever that means. Instead, one day I found the approval in my mailbox. I guess writing emotional 14 pages on how much of a (removed) my ex was did help at the end.

    They will call you back, but not within 48 hours. It took them almost a week to get back to me in January when I needed a new stamp. Some other center in Kansas makes those appointments, but the good thing is they had a lot of availability, including the next day. Be ready to have a good explanation as to why you need an appointment - they are not making those to just “ask questions” now.

    I feel like I need to share the knowledge. They release the appointments exactly at midnight, i.e. Tuesday midnight will get you in on Tuesday in two weeks, at least in New York. If you go at 12-12:05am, you will be 99.9% able to book it. They release them in very short intervals - if you open the page at 12am and see 7:30am/7:45am/8am and you want 10am, just keep hitting refresh. My strategy is usually to book anything available and then hit refresh in reschedule mode. 

     

    Edit: this works in times other than the government shutdown, when they are closed completely.

    Good luck - make sure you are on the same exact page as your lawyer, and he knows all the details and what you need to ask at the interview. Keeping my fingers crossed for you.

    Sorry for hijacking the tread, but wanted to say thank you for your messages here. I'm in the exact same situation with I-751 denied and refiled, and ex-husband who complained to USCIS. My second I-751 is pending with New York Field Office for three years now, and I made a mistake of filing I-290B at the same time in the name of justice which is pending as well. Thanks for sharing the knowledge, it's been super helpful (especially with a total lack of info on denied I-751).
