    1. Try getting a tier 2 officer.  People have reported success by saying Info Pass to the automated attendant.
    2. It won’t hurt but I’m not sure on what basis.
    3. Yes it will be a 10 year green card. Also start thinking about filing N-400.
    4. A consult  with a lawyer might expose other options or advice.

Start getting in the habit of checking your case online each week.  That way of their mailings due to you, you will notice they are missed.

    set USPS informed delivery.

Thank you! I thought you needed to have a green card for 3 years to file N-400. Is that not the case?

  2. My husband and I were married on 3/1/2019 and have been waiting since then for his I-485 AOS interview. This is partially due to our initial interview being cancelled due to COVID-19, and also due to a glitch in the system where they sent our interview notice to an old address, which we haven't lived at for 2 years. (Note: we have received correspondence from USCIS to our current address, and it was confirmed by a Tier 2 agent that it was updated, and must have been a system error).

    I have a few questions:

    1. Is there anything we can do to expedite this? My husband is now applying for his EAD/AP for the third time.
    2. Should we file a request to expedite?
    3. Since we've been married for 2+ years, will we skip the 2 year green card and go straight to the 10 year?
    4. Should we hire a lawyer?

Here's a timeline of our events so far:

    • 03/15/2019: Sent I-485, I-131 and I-765 package
    • 05/08/2019: Fingerprints reviewed
    • 09/27/2019: Request to change address approved
    • 02/03/2020: I-485 interview scheduled
    • 03/18/2020: I-485 interview cancelled (due to COVID-19)
    • 03/19/2020: I-485 interview ready to be scheduled
    • 07/23/2020: I-485 interview scheduled
    • *08/06/2020: Interview (we missed it, as we hadn't received the interview letter, despite our address being updated and confirmed on 09/27/2019. Please note at this time the USPS in NYC was also barely operating, so all mail was delayed by 2+ weeks. If it had gone to the correct address, we probably still wouldn't have received it in time.)
    • 08/25/2020: Request to reschedule interview approved

It's now 05/05/2021, and we have not heard anything. We have tried calling USCIS dozens of times, and are unable to get through to an officer who can actually help us.

Our current case status is "Interview was scheduled. On July 23, 2020, we scheduled an interview for your Form I-485, Application to Register Permanent Residence...".

Would appreciate any and all advice. Thanks so much!

That’s great to hear!! Thanks for sharing the tips. My online status finally got updated today. It now shows interview canceled and notice ordered. Not sure what that means. What’s your current case status now? Did it say anything like  reschedule request completed?

On my USCIS case tracker, it says:

On August 27, 2020, your request to have your interview rescheduled, referral number [OMITTED], was completed.

We received an email which says:

On August 27, 2020, you or your representative contacted U.S. Citizenship and Immigration Services (USCIS) concerning your Form I485, Application to Register Permanent Residence or Adjust Status to notify us that you needed to reschedule a missed appointment. Below is a summary of what we found and how the issue has been or may be resolved.

We have received your request to reschedule your interview. Once a new appointment date is set we will mail you an interview notice to the most recent address we have on file.

We have updated your address in our data systems for the case(s) you contacted us about.

We hope this information is helpful to you.

Did you finally get rescheduled with the field office for the missed interview? Same thing happened to me as the mail was sent to old address and I missed the interview. Called tier 2 and was told to fax a written statement to explain and request reschedule. It has been two weeks and heard nothing from the field office... not sure if they’re going deny the AOS....😭

We were finally able to speak to a Tier 2 officer who called the Brooklyn office on our behalf to explain the situation. We also wrote a letter with proof of our address change and sent it to the Brooklyn field office. We received confirmation that the appointment has been rescheduled, but have no idea when. We've been calling every week for an update on the situation, and they said there's no way to know - could be a couple of weeks or a couple of months. So now we sit and wait!

The one thing that really helped our case is that we had proof of us updating our address. If you can find the receipt number or an email from USCIS with proof you updated it and that it was a system error, it might really help you. Also, make sure you sign up for the online USCIS account - really helpful with tracking progress!

My sister just found out she missed her interview scheduled on 08/10. She was out of state to take care of our sick aunt. Tried calling but as usual wait time is hell. So chatted with an online representative, who said she should a letter explaining why she missed the appointment and attached the notice. mail it to the address at the bottom of the notice. We are about to send the letter, so hope this help and do keep us posted with any update

I finally got in touch with a USCIS agent, who said to do the same thing. I'm going to call back in the morning to speak to a Level 2 officer, who apparently is more able to help. Fingers crossed, this is beyond stressful. Best of luck to your sister!

They probably won't even let you enter the building without an appointment.

The sad thing is that it will be on you to prove that you never received the letter which can be quite impossible sometimes. Best case you'll get a new interview date, worst case you'll have to file AOS again

Wow, this just got more complicated. The tenants in my old apartment just reached out to me to tell me they received the appointment letter this morning - it says the interview date was August 11. How can that be? It was mailed out July 23 and only just received today, so even if it went to the correct address we still would not have made it. I also have email confirmation from April 20 that my address was updated, so it should not have gone to my old address.

My case status still says "Interview was Scheduled."

On hour 2 of waiting on the phone for USCIS, really hoping they're able to understand this? Any advice as to what I should say beyond explaining the situation?

Yea you need to get somebody on the phone who can tell you the date and email you the invite. Interviews are usually scheduled 4-6 weeks ahead so you're cutting it close

Ok, good to know - it's definitely starting to feel unusually long. I'll just have to stay vigilant on the phone. Do you think it's worth it to go in person on Monday to try to figure it out? What happens if we missed it but never received the letter?

  9. Hi! It looks like NYC is finally scheduling AOS interviews again (woohoo!!!) however even though my interview was scheduled a month ago, I still haven't received anything in the mail.  I updated my address months ago, but checked with the tenants at my old apartment and they haven't received anything either. I haven't been able to get through to USCIS and have been disconnected several times. Is there a way to see the interview date and time online? After waiting so long, I'm really nervous that we'll miss it.

Our original interview was March 23, but it was cancelled due to COVID. Our status changed to "Interview was Scheduled" on July 23.

Any suggestions? Is it normal for it to take this long? Every other stage in the process took 1-2 weeks to receive the actual letter in the mail.

  10. Hey! I'm writing this to get your guys opinions on my advance parole situation - and sorry if this isn't in the right place, I'm new to this forum. My fiancé's visa was approved and he's coming to the USA from Sweden this week (8 months to the day from when we sent the I-129F), we're getting legally married at the NYC courthouse 3/1. We're having a big wedding in Iceland in August 2019 - before you guys comment, we're not getting legally married in Iceland, just ceremonially, and we're doing it because we weren't sure about the timing with the visa and wanted to have a big party with all of our friends from NYC and Sweden 🤷‍♀️

Anyway, August 3 is almost exactly 5 months from our legal wedding in NYC. We had assumed that we would be getting the K1 visa much earlier than 8 months, and also assumed that advance parole would take 2-3 months. It seems that advance parole is taking much longer than that, with an average of 5-6 months. I know it's highly unlikely we'd get approved for emergency advance parole, because a wedding is not an emergency.

We've already paid for the entire wedding in full, so rescheduling it will definitely be a financial burden, but we obviously can't have a wedding without the groom. Is there anything we can do to make sure we get his advance parole before 5 months, or do we eat our money and reschedule the whole wedding to a date we know will be 100% okay?

Insane that it could take up to 16 months with no RFEs and everything done correctly....

Anyway, would be eternally grateful for any advice and we're quite unsure of what to do. Thank you in advance!
