  1. Thank you! I thought you needed to have a green card for 3 years to file N-400. Is that not the case?
  2. My husband and I were married on 3/1/2019 and have been waiting since then for his I-485 AOS interview. This is partially due to our initial interview being cancelled due to COVID-19, and also due to a glitch in the system where they sent our interview notice to an old address, which we haven't lived at for 2 years. (Note: we have received correspondence from USCIS to our current address, and it was confirmed by a Tier 2 agent that it was updated, and must have been a system error). I have a few questions: Is there anything we can do to expedite this? My husband is now applying for his EAD/AP for the third time. Should we file a request to expedite? Since we've been married for 2+ years, will we skip the 2 year green card and go straight to the 10 year? Should we hire a lawyer? Here's a timeline of our events so far: 03/15/2019: Sent I-485, I-131 and I-765 package 05/08/2019: Fingerprints reviewed 09/27/2019: Request to change address approved 02/03/2020: I-485 interview scheduled 03/18/2020: I-485 interview cancelled (due to COVID-19) 03/19/2020: I-485 interview ready to be scheduled 07/23/2020: I-485 interview scheduled *08/06/2020: Interview (we missed it, as we hadn't received the interview letter, despite our address being updated and confirmed on 09/27/2019. Please note at this time the USPS in NYC was also barely operating, so all mail was delayed by 2+ weeks. If it had gone to the correct address, we probably still wouldn't have received it in time.) 08/25/2020: Request to reschedule interview approved It's now 05/05/2021, and we have not heard anything. We have tried calling USCIS dozens of times, and are unable to get through to an officer who can actually help us. Our current case status is "Interview was scheduled. On July 23, 2020, we scheduled an interview for your Form I-485, Application to Register Permanent Residence...". Would appreciate any and all advice. Thanks so much!
  3. On my USCIS case tracker, it says: On August 27, 2020, your request to have your interview rescheduled, referral number [OMITTED], was completed. We received an email which says: On August 27, 2020, you or your representative contacted U.S. Citizenship and Immigration Services (USCIS) concerning your Form I485, Application to Register Permanent Residence or Adjust Status to notify us that you needed to reschedule a missed appointment. Below is a summary of what we found and how the issue has been or may be resolved. We have received your request to reschedule your interview. Once a new appointment date is set we will mail you an interview notice to the most recent address we have on file. We have updated your address in our data systems for the case(s) you contacted us about. We hope this information is helpful to you.
  4. We were finally able to speak to a Tier 2 officer who called the Brooklyn office on our behalf to explain the situation. We also wrote a letter with proof of our address change and sent it to the Brooklyn field office. We received confirmation that the appointment has been rescheduled, but have no idea when. We've been calling every week for an update on the situation, and they said there's no way to know - could be a couple of weeks or a couple of months. So now we sit and wait! The one thing that really helped our case is that we had proof of us updating our address. If you can find the receipt number or an email from USCIS with proof you updated it and that it was a system error, it might really help you. Also, make sure you sign up for the online USCIS account - really helpful with tracking progress!
  5. I finally got in touch with a USCIS agent, who said to do the same thing. I'm going to call back in the morning to speak to a Level 2 officer, who apparently is more able to help. Fingers crossed, this is beyond stressful. Best of luck to your sister!
  6. How do I find the information for my local field office (NYC)? I can't find it anywhere beyond an address.
  7. Wow, this just got more complicated. The tenants in my old apartment just reached out to me to tell me they received the appointment letter this morning - it says the interview date was August 11. How can that be? It was mailed out July 23 and only just received today, so even if it went to the correct address we still would not have made it. I also have email confirmation from April 20 that my address was updated, so it should not have gone to my old address. My case status still says "Interview was Scheduled." On hour 2 of waiting on the phone for USCIS, really hoping they're able to understand this? Any advice as to what I should say beyond explaining the situation?
  8. Ok, good to know - it's definitely starting to feel unusually long. I'll just have to stay vigilant on the phone. Do you think it's worth it to go in person on Monday to try to figure it out? What happens if we missed it but never received the letter?
  9. Hi! It looks like NYC is finally scheduling AOS interviews again (woohoo!!!) however even though my interview was scheduled a month ago, I still haven't received anything in the mail. I updated my address months ago, but checked with the tenants at my old apartment and they haven't received anything either. I haven't been able to get through to USCIS and have been disconnected several times. Is there a way to see the interview date and time online? After waiting so long, I'm really nervous that we'll miss it. Our original interview was March 23, but it was cancelled due to COVID. Our status changed to "Interview was Scheduled" on July 23. Any suggestions? Is it normal for it to take this long? Every other stage in the process took 1-2 weeks to receive the actual letter in the mail.
