  1. My fiance arrived here from Jamaica 7-14-2019 and we were married 8-23-2019. I became very sick when he arrived and wasn't able to file our AOS until this week. I am super nervous as I am afraid he will have to go back home because he is out of status now. I've been reading horror stories about immigration doing home visits and I'm scared. I also read that now I have to file another form called a 130? Could someone please help me with advice and what I need to do. I don't want him to have to go back home.

  2. Yani thank you so much! However, I did go and schedule his interview but when I went in, it wouldn't allow me to pick my own date. It scheduled him for the interview for June 21, 2019 and he hasn't even had his medical or received his packet with the medical history form. My head is spinning. Any extra advice?

  3. Hi all. Our case is now ready. I don't know where to go to schedule medical and interview for my fiance. It's Jamaica...I already completed my fiance ds160 but I have not been able to complete his daughter ds160 because the mom isn't cooperating now. Can I go ahead and schedule interview/ medical for my fiance and if so, where do I go? I'm so confused

  4. Hi everyone :)

I'm so glad to say that the NVC received our K1 petition on May 29 and had a case number assigned on May 30. But I was wondering, what comes next? I checked it today and it say "No Status"...what does that mean? Is it still being worked on? And how long does it generally take to see a change? I already filled out the DS160 and registered with the embassy. Thank you for your information :)

  5. Hi everyone. I have 2 part question.

#1-I have a friend who is getting ready to file a K1 for her fiance . However, she does receive food assistance from the government due to medical reasons. She broke her back in an accident but getting better, so her situation is temporary.  If she has a cosponsor, will she be denied? I know she is working but only as tolerated.

#2-I was told that laws are changing and K1 are being denied if the US citizen has EVER received food assistance in the past. So now I am worried myself! I am a business owner now but I did receive assistance in my past. Our K1 has already been approved and is currently awaiting a case number at the NVC. What if we get all the way to the interview in Jamaica and they deny is based on that?!?! I'm very concerned now.

  6. Hi everyone! We are getting things together in preparation for our interview in Jamaica. My fiance got his police record in November of 2018. Is that suitable for the interview or does it have to be recent? And how long are they good for?

Since you listed your fiance's daughter on the I-129F, the NVC and consulate will prepare for both.  My wife's son did not initially plan to come to the U.S., but we still listed him on the I-129F.  He was assigned a case number just as my wife and her daughter and was included on the consulate interview invitation.  At the interview,  my wife said her son was not coming to the U.S., so they set his file aside.  We were lucky that they handled it this way, because he changed his mind days before we left.  He was able to "follow to join" 6 months later.

Once you have the case number for your fiance from NVC, you can track the progress online.  You will notice that the K2 case number is "attached" to the K1.  As noted, the K2 is not guaranteed because it is based on the K1.  However, if your fiance is approved, her daughter's K2 will be approved . . . assuming the medical exam is OK and required documents are provided.

For my wife's son, we got a notarized letter from his father acknowledging that his ex-wife and son were immigrating to the U.S. and he gave his permission for his son to leave the country.  Get 2 copies of this letter.  The embassy will need one copy and if they do not return it, you may need the second at the airport when you leave.  In Vietnam, the airline asked for this letter and his birth certificate, and passport.

    Good Luck! - Jason

    Thanks Jason!

The I-129F petition part of the process is for vetting of the USC. The next part of the process, is at the foreign fiance's interviewing embassy. It is at that portion that the K2 visa for the child comes up. Here is a DOS site link that should give you more information on the K2 process:

    https://travel.state.gov/content/travel/en/us-visas/immigrate/family-immigration/nonimmigrant-visa-for-a-fiance-k-1.html

When we were going for our K1/K2 visas, my wife had sole custody of her son. I still suggested that she get a notarized statement from the boy's father, stating his allowing his son to immigrate with his mother to the US. We likely didn't need it, but you never know. If there are any custody issues at all, the US government is not likely to get involved in an international custody battle, but will likely deny the K2 visa. Follow the lead of the interviewing embassy/consulate regarding the K2 requirements.

Down the road during the AOS phase, this guide: https://www.visajourney.com/content/k2-visa-adjustment-of-status-tips

and the thread at the top of the K1/K3 AOS forum will be helpful.

Good luck on you immigration journey.

    Thank you so much!

You are close to the VisaJourney NOA2 estimate, but keep in mind that the official USCIS case processing times (from their website) are still listed at 5.5 to 7.5 months for your I-129F. So, there probably wouldn't be much value to calling them, since you wouldn't exceed the "official" USCIS timeline until mid-August.

No need to panic, just keep waiting for now. The VJ timelines are pretty good, but they are not a guarantee. The visa process is a test of patience. You are still on track, so don't get frustrated.

The USCIS website and USCIS case tracker apps both worked for me recently as our petition was approved last week. So make sure you are signed up on both of those.

As all the other VJ'ers will tell you, you should use this time to read the guides and posts that have information on your upcoming visa steps. The more prepared you are, the faster you can navigate your way through the rest of the journey. Good luck!

    Thank you so much!

Where are y’all in the process? Are you waiting for the I-129f to be approved?

your fiancé will need to make sure they have documentation showing they have full custody/parental permission of the daughter before she can immigrate.

We are waiting for the NOA2, which should be any day now.

Nothing is automatic in immigration. What will happen is she will be a K2. And she will need to be interviewed also (as well as medical, etc).

Also, you should look at getting permission to immigrate from the mother of his daughter.

Okay. Will I have to make a new petition? And getting permission, like through the courts?

  12. I am full of questions today :)

I hope you can help. My fiance and I filed a K1 back in December. I did list his 14 year old daughter on there as it asked for any of his children. She wants to come here and live as they are very close. If she is listed, does that automatically approve her too when he is approved? Or do I specifically have to petition her separately?

According to other VJ members, the average time from NAO1 to NAO2 is about 119 days.........you are right at the average now....You should hear something very soon, imo.

It will be the best day of my whole life. Thank you for the hope! It's been over 2 years since we've been together and I'm so ready to have him home. We both are.

It sucks waiting.   The estimate is based on averages.   Some people get faster and some get slower.   I think of it how i am in a line at a supermarket and the lady in front of my pulls out a ton of coupons and pays in small bills.  The petitions get processed in batches by a person.  Some are faster.   Some petitions are easy and some are not.

    Hang in there.

I just feel like crying my eyes out... This waiting is absolute torture. But I will hang in there and keep praying.

  15. Hello all. It looks like I have reached the end of our timeline estimate for our K1... without an approval in sight. I am disheartened. I know it is an estimate but so I have heard from others that it has been spot on for them. I have been told from several people over the last few days that the USCIS isn't updating and applicants are actually recieving their approval by mail. Is this typical? I'm checking everything, every day and there is nothing. Should I be calling the USCIS? or should I just keep waiting? I'm so frustrated.

Hi everyone:) I have a question in regards to the letter of intent to marry. I visit my fiance in his home country Jamaica every couple of months, for the past two years. While I was there I wrote by hand, ONE intent to marry and we both signed it (wet). I sent that along with our K1 back in December. We haven't been approved yet and I am concerned about getting an RFE because I am reading that we were supposed to each write our own separate letter of intent. Any advice is greatly appreciated.

Thank you all, I think I will have him write a letter of intent of his own just in case and send to me. We have come so far and hopefully we are almost there. I'm so tired of waiting.

I'm not sure what country the person was from where you read that post, but when we did our interview in February (JA embassy) the officer didn't ask for any bank statements. She only asked for I134 and 2017 tax transcript although I had 2018 tax transcript as well. I was prepared with pay stubs, bank statement, letter from employer, etc. and she didn't ask for any of it. It's always better to have everything though.

Thank you, this makes me feel 1000 percent better! I hope I get the same response too.

Yes thank you, I'll make sure to bring everything just in case

  19. Hi everyone! I read a post today in regards to Jamaica and Co sponsor. I just barely make enough to support my fiance right now but my parents make well above enough to sponsor so they agreed to be the cosponsor. However, my mom is a big spender on just crazy miscellaneous stuff and often depletes their account lol. The post someone made today was that their cosponsor makes enough to do that for her but she said at her interview, they told her to find a new sponsor because the bank account statements showed too much spending. I am super stressed right because what if that happens to me? How do I tell my to stop spending all her money at Amazon lol?! Can someone please give me some insight. I will be crushed if we are denied. So very very crushed.

You are not alone :) We thought about it too.. but start this all over again is a pain.. And it start being challenging to explain people why we dont set up wedding date lol

After we applied to K-1, i read more about CR1, and honestly, if i had done research a bit earlier we would have married and would have applied for CR1.

But we try our best and booked holidays in April! :) So i am counting down now to this month.

This wait is filled with so many emotions huh? We will just keep going. I just put my mind to the day I get the approval :)
