We just received a notice for my husband's marriage green card interview, which is scheduled next month.  We thought we had extra certified copies of our marriage certificate from when we filed the AOS form, but can't find them anywhere.  Currently because of COVID, the city clerk office where we got married is closed and only accepting mail-in requests for vital records copies, which can take 10-14 weeks.  Obviously this time table doesn't match up...so we were wondering if we could just give them the original copy of our marriage certificate at the interview?  And then we'd get the certified copy from the city clerk later in the mail to keep.  Not really sure what our options are here otherwise.  We already waited over a year for this interview to be scheduled, so we want to avoid rescheduling if possible.

    Ah, I understand now.  And after re-reading the rejection letter, I see the next sentence says includes outdated form as one of the reasons.  Thanks for clarifying!!

Does anyone have any updates about calling USCIS?  My husband filed for AOS back in October 2019, and our case status online says that they've been ready to schedule an interview since January, right before COVID hit, but we never got any further communication from them.  He said he spoke to some of his coworkers/friends who were also waiting for green cards but came here on a work visa.  They called USCIS and were actually told over the phone that they were approved and would be sent a green card without an interview.  One of his coworkers received their green card in the mail recently this way.  They also encouraged us to call, but I don't want to be disappointed if their case was a rare exception or only because they came on a different visa.

    Did you send the NOA 1 from the AOS form? You either forgot this or sent an outdated form.

    The rejection letter is titled "Eligibility Category:  C09", so I thought that's what's related to.

     

    We did, the NOA I-797C for I-485.  I'm not sure how I would know if that was outdated.  We received it last November, a couple weeks after filing for AOS.  Is there a way to tell if it's outdated?  And if so, what other document would we send?

    My husband actually just got rejected for his EAD renewal (I-765) because we didn't include payment.  We filed for AOS in November 2019.

     

    I just checked the USCIS website on the form and filing fee exceptions, and our category (c)(9) wasn't listed.  https://www.uscis.gov/i-765

     

    Does this mean we have to pay the $410 filing fee, or is there a way to contest this?

    Also a question about the I-797 approval notice of current I-766 docs needed in both EAD and AP renewal packets - I got an I-797 for the EAD (I-765) and and I-797 for the AP (I-131).  I don't believe I got an I-797 for an I-766, so should I just include the two approval notices respective to each renewal packet?

    You can renew as early as 180 days before the EAD/AP card expires. I would do it a few days after the window opens. File as early as possible to be safe. That is what I did for my wifes EAD/AP card, and they are both processed electronically now, so renewals are a little faster than before. But don't wait, I would get it sent as soon as you hit the 180 day window. When the new card comes it won't start until the expiration date on your current card is up. My wife has hers 3 months before her current one expired, and we managed to have our interview before the original expired, but it was good knowing the new one was already in hand before the old one expired. It made no difference at the interview, The IO looked at the cards and handed them back( For AOS it asks you to bring any cards you have received from USCIS, so make sure you bring all your cards)

     

    Thanks!  Did it cost money to renew her EAD/AP?  I saw mixed comments on this in the other threads - some mentioned there not being one if you filed for AOS before a certain date, including your AOS NOA1 in the package to waive the fee, etc., but I wasn't sure which was correct.

  8. My husband received his EAD/AP combo card in February.  I know we have about 6 months before his EAD expires, but I was wondering how long EAD renewal typically takes and how bad the delays have been because of COVID, to get an idea if/when we should file for renewal. 

     

    Also, his AOS status online says that they've been ready to schedule the interview since January.  Some other threads about EAD renewal that I checked generally suggested to wait for the interview to be scheduled, but again, I'm not sure how bad the delays are.  We want to avoid his EAD expiring and pending renewal so that he can't work while we're waiting for his interview.

     

    Any advice would be appreciated!

  9. My husband and I are working on filling out the I-485 for him, and we had a couple questions on how to fill out the form/where to find the information.  We are also referencing the example forms on VisaJourney for help, but need some more guidance.

    • Is his A-number on his K1 visa?  I see a number as "A### ### ###" on his visa.  It has spaces though, so we weren't sure if this was the right one.
    • Is his USCIS Online Account Number the WAC# on his visa?
    • Under "Recent Immigration History", it asks for Passport Number Used at Last Arrival and Travel Document Number used at last arrival.  The example form leaves this blank, rather than using the visa information.  Is this correct?
    • I saw another thread talking about filling out Part 2 Questions 3-4 or not, using the information from the I-129f, while the example leaves this blank.  Which is right?

     

    For the I-765, it looks like VisaJourney has an older form example.  Are there any updated examples available?  And for questions 13-15...we're planning to go to an SSA office next week to submit the paperwork for a social security card.  Since we're working on the AOS and EAD paperwork at the same time, and I'm guessing his social security card won't arrive before we mail these off, would no for 13a, yes for 14, and yes for 15 be correct?

     

    I know if we file these two forms together, we only have to pay the fee for the I-485, right?  Would we just mail these together in one big envelope?  Also, do we need to send the I-864, G-1145, I-131, and/or any other forms?

My fiancé is arriving on a K1 visa in October, and he was wondering if there are any good travel/immigration health insurance plans he can purchase.  I have health insurance from my company, but I can't enroll him until we're married.  He doesn't want to be without coverage for the month or so that it'll take us to get married, and wanted to know what his options were.  He will be coming to New Jersey from Japan.  We weren't sure if there are immigration-specific insurances available, or if he can just get a generic travel one.  Does anyone have any recommendations?  Thank you!

    You DO NOT need an I-693 if your fiancé's vaccinations were completed overseas. If they weren't, wait to complete them until you have an interview date for AOS. In any case, include DS-3025 in the AOS packet.

    File for AOS before his I-94 expires.

    Get his SSN, and state ID if possible. Add him to your insurance.

    So it looks like I was missing a few steps here between his arrival and getting married 😅

    1. Apply for SSN asap
    2. He completed his vaccinations in Japan, so it looks like we won't need an I-693.
    3. Apply for marriage license
    4. Get married
    5. Apply for AOS and EAD/AP at the same time after getting married, before I-94 expires (90 days upon his arrival)
    6. AOS interview

     

    So once he receives the EAD/AP, can he start working legally?  How long does it typically take to be approved?

  12. I'm looking at the Step by Step guide for SSN on Visa Journey, and I had a few questions...

    • I noticed it said you should wait about two weeks after arrive to file for an SSN.  Is this true?
    • How long does a I-94 typically last before expiring?
    • The guide said another form of valid ID (than passport I'm guessing) is needed, as defined in the SS-5 instructions ( https://www.ssa.gov/forms/ss-5.pdf ).  I only see US driver's license, US state-issued non-driver identity card, or US passport listed in the Evidence of Identity section.  Obviously my fiancé coming from Japan won't have any of these items, so other than his passport, what would be an acceptable form of ID for the SSN process?
    • Is the RM 10211.530 a form?  When I open the hyperlink, it just takes me to this page:  https://secure.ssa.gov/apps10/poms.nsf/lnx/0110211530  I don't understand what we need to print out and bring to the SSA office.

My fiancé just got his K1 Visa approved, and now we're looking at next steps for his arrival.  I know we have to fill out the I-693 for vaccinations, and the I-864 and I-485 for AOS - do these all have to be completed by his Visa expiration date, or within the 90 day period that we have to get married after he arrives?  His visa expires at the end of November, and he's going to come at the beginning of October.  We're planning to get married within a week or so of his arrival, but I'm not sure that we'll have enough time to finish all of the other documents by his visa expiration date if that's the deadline.  Also, are there any other major steps that I'm missing here?  Thank you!

    Double check if your consulate/embassy communicates by mail or email. Amsterdam consulate sends package 3 by mail, its a pretty important package. If they do send something out by mail (besides visa, he can change that typo once he's at the interview) I would change the typo asap to avoid missing any important mail.
