  1. Family-based adjustment of status applications may take 10-12 months;

Is this really so bad? As long as the interim benefits stay 90 days or less, I dont see how this is all that bad.

I agree. Being together with your SO is more important. If you have EAD you can work. AP you can travel.

As for me, if it is taking 10-12 months, I look forward to my 10 year GC instead of a conditional 2 year one :)

  2. Your husband would have to be a legal resident of Canada to go the DCF route.

You can visit the US while your application is pending, Just carry as much proof of ties to Canada. Letter from employer, Apt lease, Mortgage Statements, Utility bills etc.

File for the K3 asap. It took us nine and half months. You can have a look at the timelines to estimate approx how long the entire process will take.

    Good luck

  3. Just wanted to add... as long as you return back to Canada and have not stayed in the US for over 180 days in the last 12 months you should be good.

You will have to have your medical done by one of the panel physicians on the list provided you on your packet 3.

    Good luck.

You have to go back to Canada for the interview and medical exam anyhow, so how is a trip back to Canada "needless"? You can't have your medical exam done in the US, it has to be done by a panel physician in Canada. You also have to personally go to the RCMP or police station to apply for the police certificate, they don't do those by mail.

And as mentioned above, Montreal does not accept faxed copies of the checklist, you have to mail it to them.

thanks for your feed. I will go back for the interview but I didn't want to make a trip back for the package 3 if all I have to do is mail paperwork back. I will do the police report and medical when I know when the interview is and I'll just go back to canada afew weeks before the interview and get that all done. I have to wonder.....why can't I get the medical done down here. He is a civil surgeon who is also working for the USCIS just like the doctor up in canada. What do you think?

  4. Once upon a time in the land of peanut butter and jelly lived pedro and chuck norris who were friends who met in a pride parade that was filled with firemen and EMTs. To everyones surprise during the chorizo with beans celebration, some gay sheep appeared out of nowhere and started to dance the Samba. THis made Pedro and Chuck blush like little schoolgirls ashamed because they had no rythm and couldn't dance. And so, the duo decided to to take dance classes. Richard Simmons was the instructor and Nessa and Amber were their cheerleader. They all wore short-shorts and had crazy curly hair. One day they received a phone call from Oprah to make a guest appearance on the topic of who dances better sheep or cloned goats that graze along the hillside. But at the last minute the topic was changed to who is pedro and chuck? Nobody knew that they were famous carne assada lovers that were only faking to know anything about the Samba. As part of the show, they had to cook carne assada, which was a problem. Cuz there was no carne available to buy anywhere in the entire coutry. This called for a trip to the land of carne assada plus sides of veggies and bread. But when they got there they found out that all the carne there was infested w/ vaca loca disease....so back to the land of peanut butter and jelly.

Once home they decided to become vegetarian and only have friends who like the rainbow colors. All was well until Chuck developed a severe allergy to PB&J. He couldn't even be near people like NEssa that were addicted to PB cuz he would get sick. So he set out for the land of chocolate covered garlic balls, where he heard there was a cure for his ailment. But they noticed that in the land of chocolate covered garlic balls people wore no clothes. Again he was faced with the dillema: should I stay or should I go? The answer to became clear when his bud Pedro showed up one day. They made love under the stars and Pedro finally proposed. They then called Oprah back to see if she could be a candidate for President of the United States and finally legalize gay marriage. Oprah was all for it because she had fallen for Hillary and really needed gay marriage legalized.

Oh my now Hillary had announced she changed parties. She had became a conservative republican, and was secretly lusting after Mel Gibson, with his sexy blue eyes. But what to do w/ her existing "sexy blue eyes"? Turns out that Mel wanted no part of it cause she looks like a man. So Hillary in an desperate attempt to gain attention, pulls off her wig !! And then she takes off her fake teeth, and yells: I'm ready wheres the beef? But nobody hears her, they're concentrating on Mel in a kilt. Mad she grabs the blow-horn, points it under Mel's kilt and blows. All the women chanting go silent at the sight of what was under Mel's kilt. You see there was nothing to see!!!! Which answered that age old question: Are we blind, or is there nothing out there to see?

So back to Chuck and Pedro, who were still trying to find someone to marry them. But, then they thought why not ask Jim Mcgreevey he's dealt with this stuff before. Wearing kilts themselves now they were starting a new trend. When out of nowhere, came Mr. Rogers wearing a kilt and chanting some type of song...."Wont you please... Please wont you be my lover..."

  5. I had the same problem the first time, had to get enough proof of ties and was let through the second and subsequent times. They usually do not ban you the first time but then again it depends on the mood the CBP officer might be in. However if you do not have proof and you attempt to cross over a second time there could be a good chance you could receive a ban also.

    Musharraf rejects UN Bhutto probe

Pakistani President Pervez Musharraf has ruled out a United Nations inquiry into the assassination of the opposition leader, Benazir Bhutto.

He told the French paper Le Figaro that Pakistan had its own institutions to investigate the killing and that they were being assisted by the UK.

The president said he hoped the results of the investigation would be published before February's parliamentary vote. 1

Ms Bhutto's son, Bilawal, has repeatedly called for a UN inquiry.

He has said his family and the Pakistan People's Party, of which he is now joint leader with his father, do not believe that a government inquiry into Benazir Bhutto's death has had the "necessary transparency". 2

    'Not possible'

In the interview with Le Figaro on Friday, Mr Musharraf rejected the demands for a UN inquiry, saying Pakistan should not be compared to Lebanon, where the organisation is investigating the murder of the former Prime Minister, Rafik Hariri.

"It is not possible. Is another country involved?" he said. "Pakistan is not Lebanon." 3

The initial findings of the UN inquiry suggested Syria played a role Mr Hariri's assassination - a claim Damascus has denied.

Mr Musharraf said Pakistan had its own institutions to investigate the killing of Benazir Bhutto and that they would receive assistance from British police.

He said there was a campaign by al-Qaeda to undermine Pakistan, but denied the country was about to disintegrate and descend into violence.

"They do not have the capacity to destabilise the country, but their suicide attacks create disorder and dishearten the population," he said.

The president said the delayed parliamentary elections scheduled for 18 February would be held "whatever happens".

"We must defeat the terrorist campaign aimed at derailing the economic and democratic process. We must not play their game," he added.

"That is why elections are necessary."

The parliamentary elections were postponed from 8 January following Ms Bhutto's death in a suicide attack in Rawalpindi on 27 December.

More than 50 people were killed in violent unrest sparked by the assassination.

    Notes:

    1. Gives him enough time to rig the votes
    2. It is notable that Pakistan's investigative transparency was proved by the investigation of 1951/10/16 Liaqat Ali Khan murder. As Robert Payne, I believe Pak Army was heavily involved (as they certainly gained power afterwards)
    3. In this case, I'm surprised that he didn't follow a technique used by Zia of blaming India for an act committed by his own (Army/ISI/militants)

They did it before and no one believed them then. With both countries armed with nukes I don't think even they are that crazy as to accuse a nuclear armed neighbor.

  7. Hi All,

I hope I can make myself clear while I explain my situation. Packet 3 has been mailed back as of Dec 13th and I am waiting for an interview in MTL. I will be done my job at the end of the month and be moving out of my apartment in Toronto. While waiting for my interview date (if it didn't happen before Feb. 01  ) I will be taking my two cats and flying to my families home in Regina, Sask because my brother will foster my cats and I will be spending time with my ill father, visiting etc.... My questions are the following....

    1. While waiting for my letter, should I and how would I change my mailing address to a Regina address with the Montreal Consulate or should I just use the Canada Post change of address service where they forward the mail from your old address to your new one and not notify Montreal?

    2. Do you think the Montreal Consulate will care if I change my address to a Regina address?

    3. On the day of my interview, upon approval of my Visa, it is my understanding that Montreal mails out the Visa in 2-7 business days.....would they let me pick it up in person the next day? I don't wanna have to fly back to Regina to get the mail just to turn around and get back on a plane to Los Angeles. I need to be able to fly out of Montreal direct to LA.....

    Thoughts?????

    Thanks for your advice.

    Christine and her cats

    in the T.O..

    1. I would do both, change with Canada post and inform the Consulate of the change of address

    2. No.. they wont care for the change in address. As long as it is in Canada.

    3. You can always ask them if you can pick the passport up. They usually mail out the visa 2-3 business days after the interview. It took me 6 days to get visa in hand.

You could ask your family to mail the passport back to Montreal if you do not want to fly back to Regina.

    Good luck :)

EDIT: I just remembered that you have to put down the address where you want your passport to be mailed on the Canada Post Xpresspost mailer... if you know anyone in Montreal (Family or Friends) you can put down their address on there and pick it up from Montreal itself.

  8. Not sure about length of validity of CR-1/IR-1 visa from Canada, State department table does not list immigrant visas.

    http://travel.state.gov/visa/frvi/reciproc...ocity_3531.html

However, I would delay entry to the USA on that visa until after 2nd wedding anniversary (4/21/08), when you enter the country, show the POE officer your marriage certificate, and they should recode your green-card as the 10 year permanent one, NO conditions to then lift 2 years later.

I can't delay on entering because our daughter would be left without care. Although, maybe they can/will hold off on activating the visa, but in the end I just want to get this whole thing over with.

You can try asking them to not activate your visa and tell them you are visiting and on returning will activate it. Hopefully they let you in just as a Canadian tourist.
