My lawyer suggest I not go to my husband interview

"You can go, but I don’t think they will let you in. Even if they let you in they may interview you too. Usually,  I don't advise you show up at the Consulate if the Cosnulate doesn’t request it."

isn't it a positive when spouse accompanies.????

Your lawyer's advice sounds weird to me too. I plan to accompany my husband to the interview. If they don't let me in, I'll go have a coffee somewhere nearby and wait so we can (hopefully) celebrate immediately after he's done.

  2. Marrying now and continuing to live together abroad until you're ready to return is the best path. Take tons of photos of your life together - your wedding, your travels, time spent with one another's family and friends. Include many photos and letters affirming knowledge of your marriage from friends and family with your i130 packet. I don't think co-mingling of funds is that important in your case, but living abroad with your partner and being involved with their family and friends there makes for a very strong case.

  3. If this new guideline goes through, it doesn't take into account USC who married and lived abroad for many years then come back for whatever reason and have 0  or close to 0 reported income for the past few years due to waver of income earned overseas. In my case, I had been living in my husband's country where we married. I had to come home to care for a sick parent and now I'm waiting and waiting, unable to work outside the home because I have a full load caring for my dad. Fortunately, I have assets and rental income that I pay taxes on to put me over 125% but if it was 250%? Yeah, I would have had to choose between helping my dad or staying in Singapore with my husband. My husband does have a job waiting for him here but we can't count that future income since they are not the sponsor. I think USC who have been married abroad for over a set number of years (5?10?) and are returning home should be in a separate category anyway because our situation is quite different. Many countries give breaks to returning citizens, just not the US.

Ok, thank you but I need to know for sure lol.

The people who already have their case sent over after approval will know for sure.

Oh! I'm sorry. I was unclear. I have had my case sent to NVC and have recently received CC. Definitely your NVC correspondence says Department of State. I was just unsure about the "oversees" part of my post. I should have left it out.

Guys is the Department OF State the same as the National Visa Center? Or is it two different thing?  On the website it shows my case was sent to the Department of State not NVC so I’m confused about that.

    Thank you for your response!

Yes, if it shows sent to Department of State it has gone to NVC. I may be wrong, but it appears to me that USCIS is overseen by Homeland Security and NVC is overseen by the Dept of State.

Has anyone who had to rescan their passport heard back yet? It seems there were 3 or 4 of us with the same issue in this thread. I'm getting depressed with this wait and was hoping someone had good news.

Update: Just received the CC email! 11 days after we were asked to rescan for a total of 16 days after our original submission on CEAC. Good luck everyone!

also you say Texas Service Center for a CR1????

    http://bccvisalaw.com/processingtx.php

according to what i  see on this site Texas serves K1 financee visa

i hope if you are not married yet you did not enclose photos that would appear to be wedding photos

Ridiculously false. Texas serves CR1s as well. We did our CR1 through TSC as have many others on this board. I don't know if this poster is married or not, but if they are and they are doing CR1 through TSC they absolutely should enclose wedding photos. I agree with you that the poster needs to give more information so we can help, but we should not be scaring them out of doing what might be the right thing before we know.

Hi all, I'm a bit confused about the "At NVC" status. My case is pivot and my case on ceac website has always said At NVC. I dont think i have a case close as yet because my docs were submitted on 9/17 however how would I know my case is closed by looking at the ceac website?

The "at NVC" that people are talking about is from this page https://ceac.state.gov/ceac/  at the bottom where it says "check my visa application status" - not from your page you used to submit documents online. I am also pivot and my page when I log in also always says "at nvc". I have "accepted" next to all documents but one, which we had to rescan. You will get a message in your inbox on that page if they make any changes to your case, whether it's an approval or a request to rescan a document.

Still waiting for NVC to check my updated birth certificate. It will be 3 weeks on 20th September and that should be the "normal" deadline. Also sent in the request for expedite (based on a job offer I got that has a real strict start date) but sadly it got denied, so I will lose out on the job opportunity. Its just so frustrating, knowing that if everything had been OK with birth certificate, I would already have CC :(

Are you pivot or did you have to mail in your updated birth cert? Just trying to see how long it takes to fix these minor adjustments. We had one as well.

  10. Hi all, Just updating that we submitted all documents to CEAC on Monday 9/10. Today I received an email that NVC had updated our case. I was scared because it was obviously not an acceptance, but it turned out that all documents have been accepted except my husband's biometric page of his passport because he uploaded it reading vertically instead of horizontally. Hopefully this doesn't delay us too much. I'll update again later how long it takes for them to accept the corrected upload.

Hi guys my I-130 was approved on August 24 2018(hard copy) and August 27( new website). It’s already been 2 weeks on to 3 weeks and still haven’t got any mails or emails from NVC on wether they received my case from USCIS. I called NVC on September 10th( 2 weeks after case was approved) I was told that they have not received anything as yet and that it may take up to 6 weeks for them to receive the case from uscis. Is that normal? For those of you who cases was received by NVC how long after your approval did they received your case? I will give NVC a call back on Monday sept 17th.

Thanks for your responses in advance

Yeah I was told this too when I called. I was surprised to hear it could take 6 weeks, but it turned out not to be the case for us. USCIS did take 2 weeks to send our case over and they received it a week later. Hopefully you'll hear something soon.

I submitted mine Aug 31 at 3am west coast time, I haven't heard anything from them yet. I have estimated 14 days out to about 21 days we should be hearing something.

I submitted ours just briefly before you. I hope we hear from them sooner rather than later.

Thank you for updating! I submitted this morning. Hopefully we all hear soon. Good luck!

How would you know which countries are pivot and which once are not? Is there a list somewhere?

I was trying to find a list as well about a month ago. If one exists, I never found it. However, when I called NVC to see if they had received our case, they informed me our case was pivot and to call back and press 5 to speak with someone who handled pivot cases. Prior to that I had also tried clicking on the "portals" tab here and checking out posts from other Singapore filers but none mentioned pivot. Until now :)

    Friends,

this might be out of context but I would appreciate your input.

I am planning to go to India for my wife's CR1 interview. So I am purchasing a return ticket for myself. So I was wondering what I can do to ensure to bring my wife together in the same flight since I don't think it is a good idea to buy her ticket without getting her visa. How can I book my return flight along with her as an added companion on the return leg?  I will have about 5-7 days after her interview date for the return flight. I am worried I might not get her ticket on the same flight itinerary if I purchase her ticket that late.

You may need to rebook your ticket if you can't get her on the same flight. I would call the airlines once she's approved and see what they can do. If you haven't bought your ticket yet, definitely check the costs of rebooking versus buying an open return date ticket.

  15. I have been kicking myself all morning because I did not get a proof of extension approval from the accountant nor did I request tax transcripts for the past two years in a timely fashion. This is going to delay submitting my AoS by at least a week, probably more. But I will just have to wait until Tuesday to make some calls and get the ball rolling again. This process is stressful and at times it can be overwhelming. The only thing you can do is tackle the problem at your earliest opportunity. The sooner you get started, the sooner you will be reunited with your loved one. Like others, I suggest finding an accountant as soon as you can because the alternative to doing your taxes is not completing this process.
