    I want to apply but I am not sure how much evidence they will require because it will be marriage based and since most bills will be separated due to the relocation I am scared they will think that our marriage is not bonafide. My wife did a terrific job putting together all the evidence for the previous processed but now since I am moving we did the following changes:

    - closed bank accounts - we moved to Discover for saving purposes but I think I can add her although her direct deposit goes to her personal Bank of America account this is just for financial purposes

    - different car insurance policy

    - different driver license

    - no joint apartment lease

    - different health insurance

    - we cancelled our AAA policy

     

    I do have all this evidence as joint since 2014 to Jul 2019 but just last month we split the stuff because of the relocation

  2. Hello my wife (USC) and I have been married since October 2014 and I have been a resident since 07/2016. I have my 10 year GC and I understand that I can apply under the 3 year rule, we havent done so since we have had so many expenses lately and I am now being relocated to another state and she will be staying in our current state, we live in an apartment and since I am moving she will be moving with her mom, this will be only temporarily and it just because my job is forcing me to move. In my new state the N400 processing time is shorter and I was thinking on applying there, since we will be living in different states most of our bills will have to be splitted, car insurance, my rent in the new apartment is just me, she is getting the health insurance from her job instead of mine, etc... We will be flying back and forward to visit each other... My questions are:

    1. Should I apply in my new state after 3 months?

    2. Should I move all of her documents to my new apartment? Driver License Car insurance? Add her on the lease?

    3. Should I just wait for the 5 year rule? We will still be married, all of our process so far have been long but with no complications

     

    I dont mind waiting is just that we want to start the process for my mom and my wife told me that they might be removing that process soon also when we travel we have to go through different lines and what not.

When I read some posts, I realise the marriage was just a means to an end. Encourage your relative to get some counseling with her spouse and try to make it work. It takes two to make it work. 

     

    With that being said, being divorced shouldn't have an impact when applying for citizenship after 5 years based on what I have read over the years.  I wish "your relative" well on her citizenship journey.

    Thank you and I used to think the same way and made me doubt of the legitimacy of some of the marriages on the forum but now that is happening to someone I know and I know their marriage was legit I try to understand and I try not to judge. Divorces happen even when there are not immigration circumstances involved, this couple as far as I know they have done their best efforts to keep their marriage together. As for your marriage advise (that nobody asked for) to get counseling, they have done so and like I said on the original post I don't want to provide more personal details as I am not the person involved and I don't want to provide intimate details of someone else's personals lives.  

  4. Hi guys I am asking for a relative of mine that is not very good with technology. I also dont want to go into details of the relationship.

     

    This is her timeline:

    -10/14 - Married to USC husband

    -07/16 - Got 2 year conditional green card

    -05/18 - Applied for removal of conditions

    -06/19 - Got 10 year permanent green card

    -04/21 - She wants to apply for N-400

    During her marriage I have been a witness that she is not in the most healthy relationship and she is now looking to divorce before the year ends and relocate to another state. She understands that she has to wait for the 5 year of permanent residency which will be in 07/21 minus 90 days for filing. Will her divorce affect her N-400 in someway? Is there any documentation that she still needs to provide to prove that her marriage was legitimate? She still has all the documents for her removal of conditions and as of today they still live together but she thinks he is going to leave her soon.

  5. Asking for my cousin - He is 25yo now. His mom became a USC when he was under 18 they both got a 10 GC when she got married to her second husband. My cousin now wants to get his US Passport, does he has to file N-600 or can he just apply for the passport? I believe that since he was under her care he became a USC when his mom did. At the moment he doesnt have the money to file for the N-600, what kind of proof he has to show so he can get the passport?

  6. Hi guys I am asking for a friend. He has been a Permanent Resident (PR) for 7 years and is applying for citizenship in November, in FL this process is taking 18 months. He is engaged to his Venezuelan girlfriend who is under asylum permit, they will get married in August. They want to start a family ASAP but they want to do the immigration process first, as they are both very nervous with all the immigration changes.

     

    How long does it takes for a PR to adjust the status of his spouse? Would it be faster if they wait for him to become a citizen and then apply for her AOS? If they wait 18 months (maybe less) for his citizenship will this count towards the 2 years of marriage that they need to skip the conditional green card? 

     

    In case is relevant... he got his green card through his first wife.

    Only thing we don’t have Is a shared Bank Account. And we won’t have one this time either or anytime in the future because that’s just something we’ve decided for ourselves. 

     

    I sent them: 

    - Signed Lease on our house of both of us

    - We both Signed for the Car Credit 

    - Car insurance in both our names 

    - Cell Phone Contract in both our names

    - He is part of my health insurance, proof of that was sent as well that we are each other beneficiaries in case anything happens 

    - Photos from Honeymoon, vacation, holidays, Birthdays, with Family and Friends; over the course of the last 3 years from beginning till the time of filing. 

    - proof of same address by providing Drivers License. 

    - jointly filled Tax returns for 2 or 3 years I’m not sure exactly but definitely everything since the beginning of our marriage 

     

    Starting to prepare the same thing again. What would be good to further add. Keep in mind we don’t share our bank accounts (which wasn’t a problem when we filled for Adjustment of Status initially). I’m preparing some Affidavits since I’ve not done that the first time. 

     

    Should I only include them from US Citizen or can I also include my Mother who is German but has spent significant time with us, or friends who actually were there when we met who are not US Citizen?  

      

    Any suggestions?

     

    Your package looks very complete, they might be just asking for current documents since they are taking forever to touch our cases. Personally, I had 3 affidavits from my side 2 family members and one friend, his family was not very cooperative with the process. What I have heard that I am not sure if it is true, is that the affidavits have to come from people legally living in the US.

    Did you have to pay back? I wouldn't mind paying as long as I know that I am safe with the IRS but I need to prepare for an expense if there is one. Btw I am from the valley too!

    If we file this year I wouldn't have 2019 taxes yet. If I file on a 5 year basis will they ask for 5 years of my taxes?

    Yes we filed 2017 and 2018 jointly as married. My 3 year window is already open so we will probably file for N-400 in September this year. We have been married since 2014 but we didnt have any income that year since we were both in school.

  10. Hi guys, I was checking our taxes and there are two years that we filed as single. I trusted my husband to take care of them since I was new to the country and he took them with a friend of his and she filed both of us as single 😐 I think the tax years in 2015 and 2016 . I understand that I can amend this but I am not sure how, does anybody has previous experience doing this? I already have my 10 year green card but I know that when I try to apply for N-400 they will ask for our tax returns and I really want to have this fixed.

  11. I couldnt wait for 6pm to open the envelope and decided to call USCIS about my case. After 30 mins on hold the representative told me that my case was finally approved. I dont want to celebrate until I open the letter in a few hours and the tracker, account and check my status websites are still not updating my case.

     

    I-751 Sent: 4/28/18

    Received 12 & 18 mos extensions in July

    Biometrics waived 2/28/19

    No RFE, No Transfer, No Bio, No Interview, No N-400,

    We did have a lawyer but just because the process was so long and sometimes I am not very diligent with the mail

     

    I was very concerned and I already had a file ready in case of an RFE. My evidence I think it was light. We have a joint bank account but since my husband (USC) is sick he cannot work so it only shows my direct deposit, we didnt have an apartment lease at that time, but we had the car insurance, 3 affidavits, a letter from my family member that rented us a room, Driver license, just one year of joint taxes, life insurance that we got online, the title of 2 old vehicles we own and around 25 photos. I did make sure that all the evidence was from the beginning of the relationship, middle and actual. I hope everyone gets approved soon

    This does not have the bar code in the end - so it’s def NOT the biometric notice. It’s some other letter Approval/ RFE

    I hope it is the approval notice, it looks like it is printed on the green hard sheets, I am not sure how the RFE letter looks like. Are they printed on regular sheets or this "official" sheet. I have been preparing for an RFE but I really hope is not one.

  13. About 22% of the CSC applicants have been approved and 52% of the cases transferred to Nebraska have been approved. Hopefully we will all be approved this week lol

    She is aware that she is not allowed to work until she gets her EAD but she was already offered one by a friend so when she gets the EAD she can start working.

    @Mollie09 and @Boiler it wasnt a few days it was more like 4 months with no communication with no response from the father he was also not sending the child support. She heard he had moved states. She didnt bring the kid to stay, they came for vacation with some relatives of them and then decided to stay since she got offered a job and she didn't know about the whereabouts of the father until a few months after they settled in the US that he reached out.

  16. Thank you so much for all of your responses. When they decided to travel to the US he had left their house and didn't answer my friends calls, we think that he already had another person in his life and he just wanted to ignore my friend and her daughter. I think he was notified via text that they wanted to come to the US for vacation but he never replied or anything. The girl is 12yo and he calls her now and then to her cellphone but he doesn't want to communicate with the mother. She is going with a lawyer today so hopefully they can come to an agreement.

     

  17. Hi guys I hope to find some abswers about this topic here. My friend was going through a separation and waiting for a divorce in Mexico, her hometown. During this process she came to the US for vacation with her daughter, it was supposed to be a short stay but she met her now fiancé and the 3 of them live very happy, they are about to start her AOS process next month. This week she received a letter from Homeland Security that her ex husband and father of her daughter had applied for a Convenio de La Haya which I think it is an appeal to take the kid back to Mexico. My friend decided to stay in the US because her daughter is a US Citizen and she is now enrolled in a school a loves it and she is also going to fix her own status soon since her fiancé is a UScitizen. My friend didn’t have a job in Mexico and her ex husband didn’t provide for her or for their daughter that’s why she also decided to stay, since she already has a job here. My question is, can they really take her daughter back to Mexico even if he cannot provide for her? Has anybody experienced the same situation?
