  1. Our friends had an adjustment of status interview based on K1 and were told they can't make a decision because they are missing a petition from the beneficiaries wife. They were told they would get a letter explaining. Well they got a letter and its not even what they were told at the interview, its asking for form i-693 which is the medical examination and vaccination record. When my husband and I did the adjustment of status interview we didn't need this, could it be that they lost the information that was given when the beneficiary entered the US at the airport? We want to help them but unsure of this request of the I-693. Thank you in advance for any help or suggestions.

I have my maiden name card and I did apply for a replacement in my married name on the I765 but I have no gotten it yet. It usually comes shortly after the Combo card arrives so you just got lucky.

"Valid for work only with DHS Authorization" is what it's supposed to say as you can only work with BOTH that SSN AND your EAD card.

Its possible "others" arent just reading it right or they have already received their GC at which time you return to SSA and get a replacement card removing that statement as with your GC you no longer need your EAD (or work authorization), right?

Ok, that makes sense. Yes that’s right, with green card you don’t need the work authorization. Thank you for responding, I feel a lot better now with our situation.

April has been weird. I'll be at 10days by the time it gets here but I've seen a few that have been waiting over 2 weeks too.

You can call and ask but generally they give themselves a month to get it to you.

Did you get a social security card yet? My husbands card says for work only. I have talked to others who said theirs was just a regular social security card, so not sure why his says that. We are so confused but going with it :)

  4. When we applied for adjustment of status we also checked the box to have them send us a social security card. We also did the work authorization. We got the paper saying the authorization was approved, got the social security card the next day but 2 weeks now and no work authorization card. Is this normal or maybe it was lost in the mail? Our case hasn’t even updated. Our AOS interview is next week so I guess it doesn’t matter.

So it is possible to go to an IRS center and just have them verify/certify a foreign passport without having to submit a W-7 and tax return on the same day? Do I need to make copies of the passport for them to certify?

Yes, they will do it for you and send it electronically for you. We thought we had to mail it in but we didn't. We actually forgot to do it, and then the ITIN came in the mail. We were surprised! So if you go to the IRS they do it for you, no need to mail anything in. Just bring everything in with you so they can verify. They also took his application even though his Visa was expiring that day and we still got the ITIN.

its normal and most of the time a good sign of getting a gc card first and if you do get your greencard your ead/ap will be cancelled as you wont need it anymore.

    when is your interview date?

if you don't mind me asking 🙂

At the end of April! We are worried though because we applied for the social security number before marriage and they didn’t file the application right at the social security office. After multiple times coming in checking on it they said that it was denied due to not having matching information. By then it was to late because we got married 3 weeks after we applied. I was only able to put my husband on my bank account. My apartments do background checks so I’m unable to put his name on there because he don’t have a social. I’m worried I won’t have enough proof to provide at the interview.

  7. I feel like I have asked a million questions in regards to this topic, I promise my last question. So we went to an IRS location and they certified everything for the ITIN, and I'm getting ready to mail the federal form with the ITIN app. Since the state is seperate how will I send that in since the federal has all the information for the ITIN? Will they be notified that we applied?

If you are applying for an ITIN you will need to file through a paper file. Can't do it online. You will send the W7, the certified passport copy and the certificate of authenticity that a certified acceptance agent gives you along with the joint return.

Ours took 3 weeks for the ITIN and 3 more weeks for the refund. I used turbotax and just put in whatever number but DID NOT FILE online. At the end I printed the return INSTEAD OF filing it. Whited out the fake SSN, made a copy so it looks clean, and wrote "Applying for ITIN " in the box.

When you filed did you get credit for having your foreign spouse on your taxes or it didn't make a difference? I was reading on the irs website that if you use the ITIN # then even if I file jointly it won't count, like there won't be an exemption for your dependent? When I read that I felt like then whats the since of filing jointly and going through all this.

I knew we had to mail it in, just getting past that error screen with the SSN. Thank you for the response, that helps a lot. We have an appointment with the IRS so won't they authenicate everything there at the appointment? Eliminating the need to send the passport copy in? Or do they certifiy it there and give me the copy?

  10. So this will be my first time filing with my husband who is here on K1. We have already applied for AOS in December. He did not get a social security number which is a long story. We have an appointment tomorrow with the IRS to apply for ITIN so we can file. I want to file jointly but having some difficulty finishing up the information on turbo tax because they won't let me go any further because he don't have a ssn. Is there a program that I can use that will allow me to finish up the taxes and print them, or will the programs not allow me to do this?  Also, I was told that I would have to add my husbands income but he didn't have any. Is there something I should be doing before I send in the taxes along with the W7 application?  I'm a nervous wreck over this. I have always done my own taxes so i'm overwhelmed with doing this right.

Just find a local acceptance agent and they can validate the documents if you don't want to send off the passport

Will be it ok if his visa is currently expired? I mean they will understand that whole K1 Visa situation right, and that he is legal here because we got married and just waiting for AOS? Also will we have to still do the tax return if we go to an acceptance agent? Thank you for your help.

  12. My husband doesn't have a social security # yet because we just filed for adjustment of status 2 months ago along with Work Authorization. We tried getting a social security number before we got married but the office made a mistake and delayed the application. By the time they figured out what they did my husband had no status because we got married. We were told now we have to wait. The problem now is, we can't get a ITIN# because it states to get one you have to send in a tax return when applying. I will file taxes in a month or two for myself, and want him on my taxes of course but I need to get him on my apartment lease, and on my bank account. I was able to put him on my credit card, they don't ask for social security #. But I don't know how i'll be able to add him to the other things without a social or ITIN # and his visa is now expired. These things are critical for our AOS interview, and I feel like we are stuck.  I have been stressing about this everyday along with working overtime I'm making myself sick.

  13. We applied for AOS and then a couple weeks later got a letter requesting the most recent tax return. I had sent them my W-2 and for some reason didn't think I needed to send my tax return. So here we are! I went to print my tax return from the program that I used last year and it's 85 pages. I don't think they want all 85 pages. How do I know exactly what ones I should print and send back? Also I requested a tax transcript for last year from the IRS and have that as well. Could I send that instead or should I send both? Thank you

  14. We sent our AOS packet 3 weeks ago, I got 2 text messages stating they got our packet and both messages had a case number in it. When I check the status, one says we received your payment for biometrics fee for I-485, and the other states they received application for employment authorization. Shouldn't we get a seperate case number for the actual AOS application? Or is the case # the same for the biometrics fee? Also it states we should get something in the mail but we got the text message a week after we sent the AOS packet but nothing came in the mail yet.

  15. We went today and the woman told us our application never went through the system because it was denied. We didn't get a letter from them saying it was denied. She deleted it from the system and tried reapplying. She said no sorry it says your information doesn't match up with immigration we can't send it through. She told us to contact immigration. Then she said when you applied you weren't married, now your married and your status changed so you can't apply. I'm like what? We just sent our AOS application today so my husband should still be considered K1 right? Maybe we should apply again at another office?

  16. My husband applied for a social security card almost 4 weeks ago, he is here in the United States on a K1 Visa. The paper they gave us said it can take up to 4 weeks for him to get the card. We went into the office yesterday, just to see if they could tell us if there was an issue or if it was already mailed, just anything. The woman just gave a blank stare and said, wait the 4 weeks then come back. It would be 4 weeks in 2 days so I don't know why they couldn't just look for us. Then she said we have no way of telling if one was initiated or sent out. Why would there be a reference number on the letter and no way of knowing? I feel like they just didn't want to help us. Has anyone experienced this?

  17. So my fiance got his K1 Visa and it has 2 dates, the petition expiration date and the visa expiration date. Does he have to travel before the petition expires? I read some stories online from a few years ago and people were denied entry because it expired. People were saying they should of asked for a supervisor. My fiance wants to come after it expires which is the end of september, he just got it 2 weeks ago. Should he come before or will he be ok? Thank you
