    While not part of your question, it sounds like there may be a language barrier between you two. While Italy is a pretty low fraud country, having a common tongue (or other way to show how you regularly communicate) is commonly something they look for. Be sure to provide good evidence of a bona fide relationship to help in that area, if it is an issue.

    I am able to understand enought well english and to be understood. We spent together 6 months (I went in the USA three times) and he went to Italy too, I met his parents, he met my parents too. We travelled a lot together and we chat and talk everyday from 2 years and half and we can prove all of that. I don't think that I have to speak a perfect english for to be recognized as his partner

    A lawyer is not needed in most cases. The circumstances listed here are not suggestive that one would be of particular help. Review the instructions for each form, review the guide here on VJ (http://www.visajourney.com/content/k1guide), and ask questions.

    Thank you. My problem is that my english is bad is very difficult for me to understand the instructions. I have many friends here in Italy that are lawyer but they don't know the law in USA and they can not help me. So do you suggest me to don't ask a waiver? Anyway no, that is his first time that he applay for a K1 visa. The problem is that if we will not have the K1 visa he has to move to Italy and his italian is worst than my english...

  3. My american fiance almost 30 years ago was judged by general court martial and he was confined for 2 years and 6 months for agg assault, conspiracy and destr to private property. 

    We have all the documents about that and we know that we have to send all that documents. They are not specified crimes listed in part 3 1-3.c Criminal Information.

    We don't know:

    - if we have to ask for a waiver for his criminal record. And if yes, what kind of waiver (general waiver, Extraordinary circumstances waiver, mandatory waiver)?

    - if is better to hire a lawyer for to have the K1 visa or if we don't need a lawyer.

  4. I have a problem about I-129F Item numbers 37-38h. Form I-94 Arrival-Departure Record. I went in the USA three different times but now I am in Italy. I don’t understand what I have to type in this items.

    The form says ‘If your beneficiary is currently in the United States, complete Item Numbers 38.a -38h’

    But the instructions says ‘Select the box to inficate whether your beneficiary has ever been in the United States. Provide the date of your beneficiary’s most recent entry in the United States, is or er I-94 Arrival-Departure Record Number, if available, and his o her immigrations status at the time of arrival. Provide the expiration date and identification numbers on the I-94 or I-95 Arrival-Departure Records, travel documents, and or passports.

    Any kind of help is welcome

    I am overthinking... the problem is that they are not exact size of the original, they are a bit smaller

    I did the same, I am only worry that they don't have exactly size as the originals (expecially for documents as boarding passes or passport). the istructions say to include photocopy... 

  7. I have a problem to fill the I-129F. For example in the first page in the section Other names used. My petitioner doesn't have any other names used. the istructions says that in case a question does not applay to you, you have to type or print "N/A". I would like to type NOT APPLICABLE because the software doesn't let me type "N/A". The example of the I-129F form in this website left everything white (no data). My question is: what I have to do?!?!?!

    The official instructions say:

    Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been married and the question asks “Provide the name of your current spouse”), type or print “N/A,” unless otherwise directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many children do you have” or “How many times have you departed the United States”), type or print “None,” unless otherwise directed.

  8. I have a question about the copies to submit with the I-129F. I am doing my paperwork for to finish the I.129F.

    I scanned all the documents (passports, email, boarding pass...) in a JPG after that in a file word I added them as pictures and at the bottom of each page I describe what is that. The size of them should be a little bit smaller than the original. (look the attack file for to understand better). Do you think that it will be a problem?
    the istruction in the official webside says that:


    Copies. You should submit legible photocopies of documents requested, unless the Instructions specifically state that you
    must submit an original document. USCIS may request an original document at the time of filing or at any time during
    processing of an application, petition, or request. If USCIS requests an original document from you, it will be returned to
    you after USCIS determines it no longer needs your original.

    He works 70 hours a week, he doesn't have time for to learn italian and in Italy you have to have a degree in languages for to teach... and for him everything in Italy is very little, the streets, the houses, the cars, he is not use to drive in the mad insane traffic in Italy. He will be retire in 10 years so our idea is to live in USA for 10 years and after that move to Europe

    Do discuss this with your fiancé, explain your fears to him and make a frank assessment of the pros and cons of both countries.

    He can't move to Italy because he doesn't speak italian and he doesn't want that I support him. Don't ask me why, but he doesn't feel a man in case that he doesn't work and I support him...

    Yes, but he doesn't speak italian and he doesn't want that I support him. He loves Italy but he wants to be closer to his parents too because they are getting old. They live in Arkansas so I told him that I will stay in Oregon no more than 1 year and after that we will move to an USA state where the weather is more worm, like Florida or Texas so we can be closer to his parents and I can see the sun. I am leaving my county, my roots, my past life for to stay with him and trust me, it is not simple. I have a son in Italy (he is 20 years old), I have my parents, my friends, my dogs, my houses. I know that I am happy only with him and I will do my best for to adapt in the USA but it will not be simple

  13. Hi, I am italian I want to say something about the american health care: it very bad! I don't understan the reason why in a state USA there is not free health care for everybody! The prices for the health care in USA are insane. My american fiance came to Italy and he had all the medical check paying the right price: MRI at both his knees and backs for 120 euro each one (almost 130 US dollars), complete blood check for almost 80 US dollars, he got his teeth fixed for 1600 US dollars (in the USA they wanted 15,000 US dollars). I think that it is only a businsess! Many americans are fat, they don't eat healthy, they don't do sports, the state doesn't say how is a good health life style, so they become sick and they will give money to the doctors, hospitals and so on. That is bad

  14. Hi, I am Carla and I am Italian. My american fiance and I are doing our paper work for the K1 Visa. We are in love form almost 3 years and we thought that we just needed to get married. Everybody in the world know USA as the land of freedom but I realized that there is nothing free in the USA. Is it right that we have to prove everything, that we have to show them our private life, our private messagges, chats, email, photos... I feel sad and I really don't know if I will feel american one day in the future. I am sure that I will miss the italian food, the italian colture, the italian weather (He lives in Oregon = it rains 350 days a year). I truly love him just I don't like the american way for to get married! Can somebody tell me where is the freedom in USA?

  15. I have the problem that my son was Bob's exchange student. My son went to study one year at the highschool in USA and lived with Bob. After two months that my son was in USA Bob and I started to talk as parents and in 3 months we realized that something special was born between us, we realized that we were in love. So I told to my husband that I was not in love with him anymore and I started the docuements for my divorce. Bob told to his wife that he was in love with another woman. Everybody were shocked, they thought we were insane, that it is impossible for two people form two different country, two different colture, two different life style be in love. I went in USA after 6 months that we realized that we were in love. My son decided to study at the university in USA (he got the F1 visa) and to live with Bob but 3 weeks before to live Italy my mother got sick and he decided to stay in Italy for to help her and study at the university in Italy. I went in USA three times for to stay with him and he came in Italy one time. I known his parents, he known my parents too.

    Bob and I got our divorce after we met the first time... I hope that is not a problem: I know that it is not good that we started our love story when we were married with other people but that it was happened to us. I hope that is not a problem that my son got a F1 visa for to study in USA and in the end he stayed in Italy!
    Anyway in case that they will not give the K1 visa will move to another part of the world where we can live together. It is sad that a state has the power to tell if we are allowed to live together or not!

    yes, it is set in a way that they want that the people pay a lawyer for to do that. But I am italian and I will keep knoked at all the doors for to have the replay that I need. They give you the replay for free but it is very complicate to find the right state office that gives you the answer that you need. It took us 3 months for to have a replay form The Pentagon about his services in the army and his records...

    Everyone is free to choose to have a lawyer or not. For my son I did the documents for the J1 visa and for the F1 visa by myself and at that time my english was really horrible, I needed to use google translate all the time, but he didn't have any problem to have his visas. I think that I can prepare all the documents, I just want to be 100% sure about everything and I thank all the people that are helping me.

  18. I think that is better to send all the pages of the passports. I went in the USA for to visit him 3 times in the last 2 years and the last time I stayed there 89 days. He went in Italy one time for three weeks. We don't have hotel's room bills becuase he lived in my house and I lived in his house. We have some tickets about museums but we don't have any pictures together at the museums. We didn't know that we need all that pictures and everything for to get marry. We thought that it was enought to have the documents about our divorces.
