    From what I've read on VJ and understand, if you are doing the same work you'd be doing in Canada for Canadians and a Canadian company, with the only difference being physical location, and not doing business with Americans, you are allowed to work. It seems to be a grey area and the immigration laws have not been updated to address this situation. Either way, I'll be sure to claim everything.

    Thanks for your reply. I think calling the NVC is a good idea. My plan was always to go back, however not having a place to live back in Canada has changed things for me because i dont want a new lease when i already plan to move / I am already here and its looking the like border is not reopening any time soon. I know there are pros and cons to the AOS and I understand them. Thanks again :)

  3. Hi fellow VJ members,

     

    I am hoping you can help me out as I am in difficult situation due to COVID (as I am sure many of us are too). My interview in Montreal was scheduled for April 20, 2020 and I came to visit my husband on March 14, 2020. The border closed shortly after that and the air ticket i had to return back to Toronto was cancelled.  I have been working remote for my Canadian employer since being here and have been unable to return to my apartment back home due to the fact that I live with a roommate and would be unable to 14 day quarantine with her in our tiny place so I have stayed here with my husband while still paying my rent back in Toronto.  My plan is stay here until the end of August as my visa expires September 13. However, my landlord has just sold our apartment building and it's looking like the new landlord wants his family to move in so I will be coming back to Canada with fundamentally no place to live. I also wont be able to get back into America once i leave since I would have maxed my 6 month limit.

     

    So I'm looking for some advice from you about what my options are - Do I forget about waiting for Montreal to open up and apply for Adjustment of Status? Or do I try extend my current B2 visa through an Extension of Status? OR is there something else I can do?

     

    If anyone has any wisdom to share, we would really appreciate it :)

  4. Hello VJ friends, 

     

    I'm currently waiting for my interview at the Montreal consulate (DQ on Dec 9) and am reading up on what I am required to bring to the interview. On the pre-interview checklist (https://travel.state.gov/content/travel/en/us-visas/Supplements/Supplements_by_Post/MTL-Montreal.html#pre_interview_checklist) it says to bring the following: 

     

    "Your original birth certificate and that of your petitioner if applicable, English translation, and a photocopy."

     

    My question is: In what scenario is it applicable to bring a petitioners original birth certificate?  

     

    My husband was not born in America but is naturalized and we used a photocopy of my husband's passport to show proof of his US citizenship in our iI30 application. Thus far, we have never submitted a copy of his birth certificate in the process. It's not a big deal as we do have his birth certificate but we would need to get it translated and I'm wondering if this is something we need to do before the interview. Has anyone out there been in this situation? What happened when you went to the interview? Did they ask for the petitioner birth certificate AND passport?

  5. Hey fellow VisaJourney friends, 

     

    I'm currently filling out the DS-260 and there is a question about additional citizenship or nationalities. I am Canadian, live in Canada and have a valid Canadian passport which we used to file for the I-130. But i'm also a dual citizen and have a valid Dutch passport which I have included on the DS-260 form. To make things more complicated, I was born in South Africa and used to have a South African passport in the past but it has now long since expired. So I also added South Africa along with Dutch and Canadian but mentioned that I do not have a valid passport for South Africa. Now my question is this: WHEN I AM SENDING MY IV PACKAGE, DO I SEND A PHOTOCOPY OF THE BIOGRAPHIC DATA OF MY VALID CANADIAN AND VALID DUTCH PASSPORT? 

     

    I can't find any information anywhere that tells me what to do. Please help me figure this one out. Thank you!
