  1. There's been some talk about the current administration's plans to add foodstamps to the public charge list for immigrants coming on a visa, and denying immigrants of permanent resident status if they recieve them. My fiance will be here in October. I currently don't recieve any food stamps but I definitely gave it some thought as it would be a big help. Think its worth a shot? Or is it too risky right now?

The visa expiration is the Visa expiration,  meaning you have to present yourself at the border before that exact day.

Yeah that's what I'm telling her. She's just so excited she's trying to rush things lol

She should be renewing it now.

    It's a Fiance K1 Visa

As long as she enters the US before Nov 16th, there will be no problem. I would book it so that the entry date is 2-3 days before the expiration, in case flights get delayed or something

You probably have to apply for a state ID first which will require a social security number depending on the state.  My wife had a Filipino and Mexican drivers license and everyone seemed to accept those in the meantime.   Once she has a state ID and EAD I think she can also get a TWIC.

Oh ok. Then the social security number can only come after the AOS right. Shucks. That means i have to wait before getting back on the road. Thanks alot though

  5. My K1 Fiance case has been at NVC for the past two weeks. Now I just noticed this new update. But it appears to have instructions to pay fees for a spousal immigrant visa. We are applying for the K1 Non Immigrant Fiance visa from Manila Philippines. Why am i getting instructions to proceed for a spousal visa?

If you see the screenshot, it says to fill out a DS-260, but as a K1 filer we're supposed to do a DS-160, not 260. And I-864 is not for us also. We are supposed to do the I-134.

Did our case get mixed up somehow and is being processed as a spousal visa? God I hope not.

  6. We have a case and invoice number from approved petition. When i check the status of the case on the website, under Immigrant Visa, it shows our case is at NVC. It also shows a link to step by step instructions on how to schedule the interview. The first step is to choose an agent which is a DS-261 form. When i try to fill out the form, the site says "case number does not match our records". Right now my fiance's sister is heading to Bank of Philippines to pay the fee. So we're just hoping they'll let us. Any advice appreciated

  7.  Got my approval guys! NOA1 Date was October 30th 2018. Manila Philippines, California Service Center (I129F). Took 141 days and the email notification came to me at 4am this Saturday morning. However the approval did not appear on the case status app nor the online case status tracker. I had to create an account with USCIS website to view the approval

I'd hold off; by April or May you'll be required to have 2018 tax year documents, which you don't have now. Also, the long-pending new edition of the form may happen by then.

Thanks alot, yeah thats what i figured. I was contemplating quitting my job and becoming self employed, and just using the documents from my old employer for the I-134. But since that would be too difficult if manila asks for the documents, I might as well just hold off.

I'd probably wait, for the pay stubs and employment letters at least.

That stuff probably shouldn't take too long to gather if your employer keeps good records/can use a computer, for the pay stubs you might even be able to print it.

The only things I might consider are things that aren't likely to change in 4-6 months anyway.
Past years' tax returns are one good example, you can gather those/request a tax transcript from the IRS.
Other assets that you might decide to list like house, car, etc. are other options. You could probably due your bank balance now if you wanted, but since that's likely to change anyway, it's probably not as helpful.

Got it thanks. Yeah looks like thats the best option for now.

If your NOA 2 in April or May, Interview won't be until June, July or August.

You do realize that the Embassy in Manila does not even ask for the I-134 and has not for years.  You will want to have the supporting evidence available (proof of current income), if requested

Arm you fiancee with the 2018 tax return and a recent check stub close to the interview date

Thank youguys so much for the advice

Then stop reading there.   For most,  the tax return is the basis of the initial evidence.   Secondly,  it's all about current income.   So if you are gainfully employed and can show it via pay stubs that will be primary evidence.   Thirdly,  you are dealing with Manila which doesn't often ask for financial records,  though you need to be prepared in the off chance they do

Visit the Philippines regional forum for all things Manila because they have a few things that are only specific to that embassy

    Nice. Understood, thanks alot.

  11. Received my NOA1 on October 30th 2018. I currently work a full time and a part time job. I'm thinking of quitting the full time job, to start driving for lyft. I will do lyft for only 2 months so that i have time to train for a commercial truck driving license. During the 2 months of lyft driving, I will be considered unemployed since it's an independent contractor thing. I will most likely become truck driver for a trucking company in February or March of 2019. My fiance's interview will be early to mid June at the embassy in Manila Philippines.

So that only gives me about 2 months to come up with paystubs from the new trucking company, and send the I-134 packet.

Will that still be enough to get approved?

Will the lyft driving or multiple employers hurt the application?

    Thanks for the help
