If you file jointly you have to request that the IRS treats your spouse as a RA. At that moment you have to report ALL the income over 2018, even if (s)he made it in his/her home country. Apparently you can exclude it later on, but it's a little confusing so we'll use an accountant. Don't use an accountant that doesn't know the rules of immigration and taxes. Tbh I don't think h&r block, turbotax etc are very educated on this.

Ok. So what documentation is needed to report the foreign income. My spouse never had any bank accounts in the foreign country, he received cashed and paystubs.

I don't know how important this is to anyone, but since we have been talking a lot about taxes I'll post it. My wife got her SSN last week and I tried to file married filing joint on Monday but it was declined because my spouses info did not match the e-file database. After some research I realized I had to wait a while. Re-filed today and it was accepted. My understanding is as long as you were married by December 31st you are eligible to file married filing joint just as a regular citizen would and it was extremely advantageous to me as she had 0 income. Hope this helps someone.

Did you report your spouse worldwide income when you filed or no? I went to hr and block and they said I didn't have to include it.

  3. Did any petitioners receive their Bank letter from bank of America? They told me they only show the average balance over the year rather than showing the amount deposited over the previous year (which is required by USCIS) and the banker showed me it in their guidelines for their immigration letters. Will this be okay for me due to the bank guidelines? Help!!

Do you make (line 22 of your most recent tax return) more then what is listed for your family size as listed in the below document? If so you'll have an easy time. Prepare your documents but no need to go overboard with stacks and stacks of proof. They are looking to whether you meet or exceed the income level for your new family.

Yes I make above the poverty line. So there's no need to wait until my 1st paycheck to request documents from bank and my new employer?

  6. Hello! So I started a new job today and decided to wait till my 1st paycheck to get the letter from my employer and bank to. However I won't receive one until June 1st. I think that's a long time to wait and I don't want to hold up the process because we all know the process is dreadful. Can I still request my letter from the bank and employer now or is it better to wait until my 1st paycheck?
