    We contacted our lawyer about it. Definitely discrimination. Surely they would want our business instead or turning us away? Haha

    Why is it an issue? You only need proof of ID and your social security card. As your SS card itself doesn't say restricted, it shouldn't be a problem. At this rate I'm going to need to make an info pass appointment later this year because I'm heading out of the country at the end of December.     I recently bought a house and so many mortgage lenders denied me due to the status of my visa expiration. One lender told my wife that they could not approve me because I might "run off back to my country" come the end of my extension which was outrageous. A couple of jobs have given me a hard time about my visa expiring at the end of 2022. One lady said "can't you just go down to the office and get a new one?" Yeah if only it were that easy.

    338 days at ready to schedule interview, nearly at the 1 year mark (2 years total). 

    I filed Sept 2020 and as of Sept 2021 I have been ready to schedule for an interview. My case is with the National Benefit Center (receipt number begins with MSC) and they have no processing time to even check if my case is outside of normal processing times. And you cant even talk to anyone! Don't worry, we are all in the same boat here. I am just worried that my 'extension' is only until December 2022 and what if I do not receive a new extension. I have not been able to apply for new jobs as the visa expiration date is a big issue.

If you got your green card when you arrived in the USA with a CR1 visa then you are going to be interviewed those green card holders that were interviewed by the state department at the embassy not USCIS. USCIS would like an opportunity to interview both the petitioner and spouse at some point during the final green card process. If you adjusted status in the USA, USCIS already interviewed you and your spouse when you got the green card, those interviews are almost all waved.

    USCIS also will interview some selected random i751 cases for quality control purposes. 

    And yes, if USCIS suspects a marriage is not valid or fraudulent they will interview those cases for sure, but that is a small number of cases.

    My case is also ready to be scheduled for an interview. Does anyone know if this is a bad thing? I always assumed that if you needed an interview it's because they have doubts on the validity of your marriage? Our marriage is solid and we submitted everything, pictures and all. We didn't get an RFE so this comes as a surprise.

    Yes we are some of the unfortunate ones who did not get their biometrics waived but I went this morning and if was an easy process. Not having the biometrics waived isn't a bad thing, I think it depends on the service center and where you're located. Hopefully now that they're are done it shouldn't be too much longer. If you have questions just let me know

  7. So after 276 days of pretty much radio silence for MSC, I received a letter in the mail today dated 06/05 to visit my local USCIS office in Philadelphia to get my biometrics done on 06/29. 

     

    It takes time but just be patient! My spouse wanted to file asking where our claim was, but I knew it is just a waiting game and I was right! 

     

    Finally feels like I'm on track now.

So in your case most likely the delay is because your case is in line to get an interview, and your local office it’s probably busy with previously filed applications. Other service centers besides Texas, takes longer, difficult to guess why, maybe they process more applications. 

    I hope so. I was getting a little disheartened and worried that something was wrong when I saw a lot of people on here having their process take only a matter of months. I don't think there's anything wrong with my case, I checked it a million times! I was also thinking it could possibly be due to the furlough situation they had over the course of the pandemic. I believe like 1/3 of USCIS employees were furloughed. I don't believe many cases were being processed during those times. Fingers crossed its resolved before my 18 month extension is up haha 😄

  9. My case is 233 days active and all I have received so far is my extension letter :(

    My case was sent straight to MSC so no transfers or anything. But I haven't heard anything since. It was received 9/11 and got my extension letter shortly after but that's as far as it goes in terms of USCIS updates. No biometrics waived or anything. Is this normal? I feel a lot of people in my boat are getting their cards already and I'm still at step one.

  10. Yesterday I had my interview at the embassy in London. All went pretty well and smooth and overall she said I was approved... however, they have to wait for my petitioner to upload her W2 form on CEAC before they can begin processing. Weirdly enough, she has already submitted her W2 but either way, somehow, the embassy did not have it. So we have had to submit it both online and I have also had to send a physical copy of it through their courier service as that was also instructed of me through email. So she said once they receive the W2, they will begin issuing me the visa. I hope it doesn't take too long. I've read many mixed reviews on the lengths of times people have had to wait once they have gone into administrative processing. The officer conducting my interview made it seem like once they have received the document - which they have today, I will be getting my visa shortly after. I feel as though it may be a bit premature to celebrate as I feel as though I'm still in limbo. I'm hoping that it should not take too long as they only need that one document and she stated that there was nothing else against me; I was cleared of all police checks etc. So fingers crossed this time does not take too long!

  11. Finally! I have been given an interview date! 28th November.  I got the email 18th October.

     

    For those wondering the timescale, 

     

    We got the notification of the creation of our visa immigrant case from NVC on 30th August,

    We paid both fees on 4th Sept

    My petitioner submitted her financial info 17th Sept

    I submitted my DS-260 18th Sept

    And finally my civil documents on 21st Sept.

     

    All documents were accepted by NVC 27th Sept to which they said they were now working with the London embassy to schedule an appointment.

     

    When checking the site, it still said my case is currently at NVC, but be patient, it was only about 3 days before I got the email that it said, my case is currently at London. I guess that is when they are actively creating an appointment for you. It was exactly 3 weeks to the day from them accepting all of my documents to when I received an interview date.

     

    Fingers crossed all goes well and I should be out there for Christmas, although I was hoping to be out there for Thanksgiving. Either way, I am beyond happy. 

  12. Hi guys. 

     

    My wife is a US Citizen living in the states and I am a British Citizen living in the UK. We applied for the i-130 on 2nd January and it was received as such, now we are just awaiting the approval. But I was doing some reading online and it seems to imply that if you are married to your spouse, that you can travel to the US on the Visa Waiver Programme, which my country is eligible for and simply adjust your status seeing that I am a spouse of a US citizen. Is that simply the case and I have wasted time applying for the i-130?
