  1. I got an RFE asking for:

"Federal income tax returns for the most recent tax year or certified Internal Revenue Services (IRS) copies."

Before we filed our 2006 tax (1040) we made copies in case we needed them. My question is can we send a copy of the tax return that we filed or do we need to get a certified copy or Tax Transcripts from the IRS?

Is there anyone that just sent a copy of their tax return without a problem? We have not yet received our Income Tax Refund so that means getting a transcript would require us to first wait for the actual refund to arrive (so the IRS will have processed the return and have a record of it) and then contacting the IRS to have them send us a transcript?

Any help or advice is appreciated.

  2. I had the same problem, and called them to add my middle name. They also said they'd send me a letter within 45 days, but they never did. At around the 55th day or so I got my interview notice, and it had my middle initial, so I guess they corrected my name in the system. So, to address your concern, no, it will not cause a delay in your AOS processing.

If you do not get a letter in 45 days, make an Infopass appointment to get it corrected or verify that it has been corrected. That's what I did, but I got my interview notice with my correct name the same day I made the appointment, so I ended up canceling it. Do not call the misinformation line again if you receive nothing in 45 days because all they'll do is send another request to change your name and you will have to wait another 45 days.

Thank you so much ajmc, for sharing your experience. I feel much better now.

Thanks for everybody for taking the time to reply. I really appreciate it.

  3. I just got my NOA 1, my middle name was left out. The NOA stated that we should contact them immediately if any of the information is not correct. We called the USCIS phone number they provide at the bottom part of my NOA 1, we asked them to correct it. They said that we will recieve of Notice of Name Correction within 45 days.

Will the correction of my name affect my AOS processing time? My main concern is that my medical will expire while waiting for USCIS to process my AOS. I have read on some websites that as long as I have my NOA 1 it would be OK that my medical will expire before the processing is complete. Can anyone can confirm if this is true or not.

    Thank you,

  4. I just sent my AOS last week and we used 2005 tax returns because my husband did not get all his W2's yet . My husband will file his income tax next week just in case we have RFE.

RFE depends on what documents they ask for and if you already have that documents you can send it as soon as you can and it reduce the delay. In some cases the documents that they ask is not RFE, it's RIE - Request of Initial Evidence and they got approve without interview. I hope this will help.

  5. Hi again, I have more questions?

Is the 1-94 number the 11 digit numbers in the upper left of my 1-94?

In I-485 form question " List your present husband/Wife, all of your sons and daughters"

Do I need to write my daughter's name in my past relationship? She's included in the K-1 petition as K-2 but for some reason she did not attend on our visa interview and she's still in my home country now but on my interview I submitted her birth certificate and her other documents.

    Thanks,

  6. If you ar talking passport photos, if they don't have dates printed on the back of them you should be fine.

Thanks for the quick reply guys. Yes I'm talking about the Passport-style Photos and there's no date on it but I also use the same picture on my visa. I don't want to have an RFE because of sending old Passport-style Photos but nothing change on our face we exactly look the same.

  7. Hi to all the members in this forum. I need another advise. All our papers for my AOS are done and we will send it now, 2 months before my medical exam will expire. But my medical exam will expire before my interview, Do I need to get a new full medical exam for my interview? Or my medical exam is still valid as long as we filed my AOS before my medical will expire? I appreciate any input and advice.

    Thanks
