She can’t adjust status, because of US law. The US only allows for only one spouse. There is now way for her to become legal that way.
Sorry, but if a person wants to immigrate to the US they have to abide by US laws.
She’s not immigrating to the US...she just want to get a tourist visa

If you are in a traditional polygamous situation where you are separated from your husband but still use his Lastname ,are you eligible for non-immigrant visa if the husband and one of the spouse is a U.S citizen? The spouse trying to apply for a b2 visa has visited the U.S several times and don’t plan of living in the U.S..she has always used Dropbox for her visa.but now all Dropbox has been stopped..does she have to change her lastname.concerned that they might think she will come to AOS since the husband & one of his wife just became a USC.any suggestions

Our wavier was approved on 11/15/19. We filed on 9/17/18. We had to to go back to the consulate in Ciudad Juarez on Oct. 24 to answer some questions. Now we're just waiting for the consulate to contact us with instructions.
Did consulate contact you yet?

I'm not sure in your case. Do you have a lawyer you can ask? I'd definitely recommend getting professional advice. You could also call the visa center hotline to ask.
Ok thanks.do you have # for visa center hotline?

I don't think so, no. They're just saying we should show up at the consulate with passport. (we're doing a new medical exam since that's over a year old). But they're still using our old processing number.
Ok.on the ceac site..it won’t allow to edit application before but now since it’s over a year it say the IV is reopened and give me option to edit and submit again.it still shows the fee for IV is paid so I don’t have to pay again..am not sure if I should wait on response from USCIS then consular before I submit IV ...cos if I re-submit now will it schedule me for an interview with consular?

They sent a letter to our former lawyer, who forwarded it to us. (we have a different lawyer now who did register with the consulate so that's weird as well)
The notice from the consulate is dated 9/17/19. It has our old processing number from our previous visa procedure (in which we were deemed inadmissible) and the document makes no reference to the waiver or our USCIS processing number.
USCIS did respond to our outside processing time inquiry on the same day, saying that our case was in line to be reviewed and we should wait 30 to 60 days. The USCIS website still just says "my case was received."
Did you have to re-submit the IV application since it been over a year.cos mine now giving me the option to edit and submit..

We have had a rather unusual update on our I-601 waiver, which we filed on 9/17/2018
The USCIS status is still showing "case received" and that has not changed or updated for about a year. However, we got a notice from the Ciudad Juarez consulate calling us in for a second interview. It says my wife was inadmissable because of "incomplete documentation" and says we can show up whenever without an appointment.
We're not sure why we're hearing from the consulate before we hear anything from USCIS. But it seems to be good news, since I don't think they'd summon us for a rejection.Did consular call or email ? Did USCIS reply back with your outside processing time inquiry?

Thank you for your reply.i do have the i-94 card that showed I was inspected.but the card shows the name on the passport I used at the poe..since am trying to adjust my status with name..I filed the i601a.and if that’s approved I will have to go to my country and face the consular..and am not sure if that will pose a problem to get stuck.or is there anyway to AOS status in the US with my name w/o having to leave the US
-
Ok..is there a different way they determine inadmissiblity.if I came her with a different non us passport and different name..I put that on my IV application..won’t that automatically make me inadmissible..am sure they will see that on my application.
-
If I need a 601.can I file it in the US before I depart for the interview
-
It was NOT a US passport and I was 17yrs at the time of entry.

I came to the US 15yrs ago with a different passport and different name.am currently married to a usc for 8yrs and we have 2kids together.i have never left the US since my initial entry.i filed i601a with my passport and name..am still awaiting a decision.i just want to know if the i601a is approved..will I run into problem with consular being that I came to the us with inspection with a different person passport and different name..will that make me inadmissible? Or what option do I have pending the i601a approval
