    This is not the topic i want to be talking about openly but i need some guidance if possible. 

    I am an Australian male, i went through the K1 Visa with my American fiance, so i could live in America with her and our 2 year old son. 

    The Visa process took 15 months before it was approved, i was about to go for my final interview when my fiance decided she did not want to go through with it (she is the beneficiary so i believe she has to withdraw the petition?) 

    Now i want to be close to my son in America as the distance between us is killing me, is there anyway this is possible? are my only chances a visa lottery?

    @Naes if you want to update my status change.

     

    just a quick question, once i receive the visa is and i am in the states, how long on average would it take before i can start legally working? i know they say 3 months but i have heard cases taking 8 months!? is that a possibility? even if i submit correct paper work once i arrive?

    noa2 itself has an expiration date (4months), which can be extended by the embassy. 

     

    However if your embassy decides on the interview dates and not you, then it may be a problem.

    It should be fine then, from what i can gather you have to schedule your own interview at the Sydney embassy where i have to go.

    abide the esta esta rules and have your return ticket with you! This is extremely important. Have your noa1 copy or a picture of it in case they ask.

     

    have ties to your home country. If you quit your job entry may be harder than normal. you will need legitimate ties.

     

    do not lie if asked at the port of entry by a cbp agent.

    Once we receive our NOA2 and i am in America (on an ESTA) can i complete the rest of the process in my own time (the medicals, interview etc.) or will they say 'you have to be here on these exact dates' ?

    when i say my own time it will be within a month or so of receiving the NOA2 (after my return flight back to Australia) 

    i just don't want to have to book an early flight home from America as they are not cheap!! :rolleyes: 

  5. Hello, 

     

    So i am the beneficiary in our visa application (i am Australian), my fiance and 16 month old son are in America waiting on my arrival. 

    it has been 220 days since we filed and we have still not received our NOA2.

     

    Would it be possible for me to fly to America in the next week or two for 5-8 weeks (round trip) to be with them (under an ESTA)? once we receive our NOA2 in America and contact NVC for case number i can fly back to Australia take medical, get police reports do interview in Sydney and then fly back permanently once approved? 

     

    we cant bare anymore months apart, but we don't want to jeopardise our K1 visa also.. 

     

    any input would be greatly appreciated.

    No good news yet, still waiting on that NOA2 :rolleyes:  (case received 17 july 2017, 220 days ago)  

     

    How long after we receive our NOA2 will i be able to enter the USA to be with my fiance?

    i know this varies but we just want to prepare ourselves? is 3 weeks being optimistic? 

     

    Also not sure if there are any fellow Aussies on the forum, but are there any required vaccines i have to get before moving to the USA?

    @P&R2017 Im not sure how to reply to a direct post but hopefully this reaches you. I have spent many sleepless nights over the past 207 days! haha! glad i finally have people to talk to who are in the same boat as me.. I've been trying to find answers by googling my questions but that has done nothing but cause more heartache :wacko: 

     

    Does anyone have a rough idea when july applicants may be approved/processed? based on previous approvals?

    My name is James i am new to this forum, i have just discovered that there is a section for july 2017 I-129F filers (cant believe i did not get onto this sooner!!)

    I am an Australian male with a fiancè and son in Wisconsin patiently awaiting my arrival.  

    The whole visa situation is a bit of a grey area for me, so ill try my best.

    We filed our I-129F in early July 2017 and our case was received on July 17 by USCIS.

     

    We have not heard anything since then. Are there many people in our situation? has anyone been approved yet? 

    Also how much longer can we expect to wait until i can be in America with my family?(just so we can mentally prepare ourselves) we were hoping to be together by now another two months will be extremely hard on us, as i imagine it would be on anyone else waiting for approval.
