I understand they should have applied before the new expiration date (8/29), but the I-539 instruction also says failure to file before the expiration date may be excused if you demonstrate the delay was due to extraordinary circumstances beyond your control. The thing is, how can you apply for a second extension before you even receive the decision on your first? So there is no way we could have filed before 8/29.

Yes, it is for my in-laws. They plan to leave the country before 180 days to avoid the 3-year bar, but want to try another extension. I know a second approval is rare, but it doesn't hurt to try. They have notes from the doctor to prove they were not suitable to fly due to health issues earlier. Of course they will not stay here and wait for the decision this time. For the fees, I guess I will go with what the website says. Even the form says check with the website for correct fees.

Hi, I am getting some conflicting information on the biometrics fee requirement - page 17 of the I-539 Instructions (10/15/19 version) says an additional biometrics services fee of $85 is required when filing this Form I-539 for V nonimmigrant or for certain
applicants in the CNMI applying for a grant of nonimmigrant status. So it sounds like it is not required anymore for B2 extension. However, when I used USCIS online fee calculator, it says the fee is still required. Can anyone shed some lights on this? Thanks so much! -
Thanks for all the replies. No, they did not leave before 8/29 and are still here. I did not know max extension was 6 months from time of the prior validity, my bad. We were also hoping for a quicker process - when we submitted our application in early Feb, the estimated time frame was well under 6 months, now it is 8 months. It also didn't help that there were VERY few flights to China up until June when limited US flights to China were resumed. Even now it is still hard to book a flight with reasonable price unless you book well ahead. They also have a 10-year visa which they now worry may be revoked because of the overstay - I guess it is at border control's mercy. Thanks again.

My parents-in-law applied for their B2 visa extension in early Feb, we just received approval notice this weekend, but the new expiration date is 8/29 - already expired by more than a month. Their original visa was valid until 2/29, so they granted a 6-month extension, but the process took 8 months! The notice is dated 9/29. We waited for some long and now this. What are our options? I plan to call USCIS tomorrow, but I am not sure if they will change the decision. Any suggestion is appreciated.

Long time lurker, first time posting. Out of the blue, I received my I-797 approval notice today. Hard copy only, no online update. Not expedited. I feel extremely blessed. Our prayers have been answered.

I read a lot of stories, and I understand everyone's struggle. I appreciate the work Naes has done for us. I sincerely hope everyone who is still waiting gets their approval soon.

Great points from everyone. Thanks for the input. We decided not to try again. Booked a Nov flight for them and they will be on their way home.
