1. Not sure about your question # 1. I'll answer 2 and 3.

Have You Ever Been Refused a U.S. Visa? >> If she was denied visa she would have a small stamp on the last page of the passport (they do this in Chennai, I know from people who were refused, not sure about Mumbai). However to be clear, talk to VFS folks or better attach a letter with it and explain. In such circumstances, it's better to be straightforward than to answer sketically. If she answer's NO and should they find out they she was denied once, it's considered "providing false information".

Form 156 - Question 28 - Who Will Pay For Your Trip? >> If the applicant answer's "Fiance", then it is fine, I don;t see any problems. If the applicant answer's "Self", then does your fiance have the funds in the US for self-support ? If the applicant has the funds in India, how do you explain transfer of funds ?

To be safe you as a petitioner is the best sponsor, as long as you meet the income needs and have all the supporting documents with I-134. I hope you are aware that you need to submit a notarized I-134 and supporting docs. (bank letter, employer letter, etc...)

  2. Hello all,

Let's suppose I were to leave my job and be in between jobs at the time of our interview (which hopefully will be November sometime). My parents are willing to sign an additional support document. Can the embassy deny our suspend our K1 visa if I am not employed?

    regards,

If you're personally confident of your financial ability, why not simply execute the I-134 and supporting documentation while you are still employed. Nobody is going to double-check to see if you're still working where you worked 60 days before the interview.

But he's gonna need the employer's letter.

  3. For K-1 we needed I-134. Not sure about K-3.

But I know for sure I-864 has to be filed for AOS, regardless of K-1 or K-3.

According to the Guide found on VJ, it could vary from embassy to embassy.

    Check this out.

I-134 / I-864 Affidavit of Support form. Ensure it is notarized (by a public notary), with all required supporting evidence. Some consulates may require one or the other forms. You will need to verify with the consulate which they require. You can call or email the consulate to check ahead of time. Additionally, the consulate will notify your fiance(e) via mail correspondence which they prefer. Attempt to start collecting the required information ahead of time, as it can often take several weeks to collect it all.

  4. Congratulations to both of you. I'm sure everyone on this board is happy for you for the detailed posts that you usually write.

That really was a long list of questions. I'm glad she answered them without any hesitation.

Congratulations once again...and I can imagine the relief :-)

  5. I just checked the A# on the NOA2 and the visa are both the same.

I wish my wife's was the same. Also when looking at the I-94 you can see where the customs officer started to write A088 and then changed it to A099 which is on her visa. I think he was too lazy to say something to his supervisor and just went by the alien number on the visa. I now wonder if when he looked her up in the computer that he noticed that the numbers didn't match and just didn't say anything.

I feel a migraine coming on!!!!:wacko: I called back to the Manila Embassy but they just keep on passing me around from one extension to another. I definitely got the feeling that they don't want to address their mistake.

    Charlie

Charlie... I would not even worry about it - I bet its just a typo on the visa that noone will ever even notice. Pretend you never discovered it :P (That's what I'd do!). Look at my wifes visa above, they did not even put the A number on there - its probably not even necessary.

    Bill

I'm going to call USCIS tomorrow just to see what they say. At this point we don't know which Alien number to use on some of the AOS forms since they do ask for it so that is the difficult part to determine which one to use. We're thinking on using the one on the NOA but then again if they have her visa alien number in the computer then all sorts of red flags might pop up and we all know what happens with that.

At least it was their mistake, haha. I'm not all that worried about but being correct would be nice.

    Take Care,

    Charlie

If the last 6 digits match, then it is definitely a typo. Instead of typing A099, they typed A088.

  6. My husband went for the medical in Chennai after receiving Packet 4 with the interview letter. But he said that no one asked for the interview letter, not at the lab and not at the doctor's office.

He did not need the letter while getting the PCC in Visakhapatnam passport office and at local village police station in East Godavari Dist., AP. The only place anyone wanted the yellow interview letter, was when he entered the Consulate on the day of the interview.

Hmm... the doctor puts the case number on the medical report. The case number is available only on the interview letter as far as the applciant is concerned. Beneficiaries know that from the NVC letter.

  7. Not sure of Chandigarh RPO specifically.

In general they ask for your interview letter and the Passport. Fill a form from available online. That's it. Usually it takes 1 day to issue the PCC in most cities in south india.

  8. Hey folks,

Wendy just received her SS card in the mail today. And of course its stamped only for work, with authorization from DHS.

Is this really only for work? Can she apply for a gas card, or any other high interest credit card? I want her to start establishing good credit ASAP.

Also, anyone K1'ers in California experienced on getting their California I.D. before AOS? Wendy's I94 is still good for about 3 more weeks.

    Thanks!

Congratulations...start getting her name on the utility bills and bank accounts credit cards, that will help her build a credit history

  9. My wife got her NOA2 for 129F & 130. Should she try and get the passport clearance now before she gets the interview letter? Also at the time of our marriage she got a police clearance certificate because I thought it was required for 130 submission. Would that certificate still be valid it is dated from May 17 07 but it was given on the maiden name.

No harm in getting another in one in the new name if it's not much of a trouble.

  10. I wanted to go for the K3 because that be faster. What should I be preparing for K3 interview?

Check out Packet 3 and Packet 4. Also it varies from embassy to embassy in India.

Chennai does not send you packet 3. It straight sends you Packet 4 along with the interview letter. Mumbai sends you packet 3. After you submit your packet 3, they'll send you packet 4 and the interview date.

You can star working on the following:

    1. Get the local police clearance certificate. (no need for the interview letter)

    2. Get the RPO Police clearance certificate (may require interview letter, I know Bangalore RPO requires it).

2a. If the visa applicant has resided in a foreign country for periods of 1 yr or more after the age of 16, need police clearance certs. from those places as well.

    3. I-134 notarized (to be signed by the petitioner, supporting documents are also required depending upon if you are self-employed or employed).

    3a. Employer letter

    3b. Bank statement

    4. Marriage certificate (am sure you already have this one)

    5. Birth certificate of the beneficiary (original in English or translated)

    6. Tax returns for last year. (1040 and W-2)

    7. Copy of Natz. cert. (if it applies to you) and copy of US Passport.

    8. Divorce decree(s). etc (if applicable)

    9. Evidence of relationship (photos of engagement, ,arriage together with family etc. emails letters and the kitchen sink :-))

If possible send USD 100 cash, this will be accepted at the embassy as processing fees for the visa.

Medical exam is also required from the US consulate approved doctors, but can't do it without the interview letter.
