  1. Finally got some good news. After having sent my application in for citizenship to Nebraska back in July 2007, I received word on Monday that I attend my local service center for fingerprinting on August 12th. Here's hoping that I'm granted citizenship before my son turns 18 at the end of January. After all I've been through in the past dealing with the local service center, I'm not holding out on much hope of that happening but I will try to think positive.

    In November, I received a notice from Nebraska stating I owed more money in fees however I was able to prove that my application was received by them before the fee hike and they then sent a notice stating that I didn't owe them any more money.

    As of this date, no notice of fingerprinting.

    My question is this. If it so happens that I'm successful in getting Citizenship but it doesn't occur until after my son's birthday who will turn 18 in January of 2009, will this mean he will have to file on his own or will they go by the filing date and my son will be granted automatic citizenship.

    Parents Naturalized February 27, 2001 to Present

    You derive U.S. citizenship if and when all of the following three things become true:

    (1) one of your parents was born in the United States or has become a naturalized citizen,

    (2) you are under the age of 18, and

    (3) you have a green card (lawful permanent residence) and are living in the legal and physical custody of your U.S. citizen parent.

    This law applies to both natural and adopted children. This law also applies to you if your parent naturalized before February 27, 2001 but you were under age 18 and satisfied the green card and residency requirement at the time.

Crikey..I agree life won't be all kittens and roses with her dad..and I think she will want to come back..but if she messes up her AOS..what are my options? would she fall under a K-4 at that point? I'm so bloody confused..If everything worked out perfectly..she would go visit for the summer..and just come back to the states no harm done..thers just so many things that could go wrong..and I can't seem to find out if she abandons her AOS..what does that mean for visiting? I have so many things to weigh here..and now sadly I will have to seriously consider going back with her..**big sigh**

    Cdnwmn.. I can only hope one day she adopts that attitude..but she'll be 16 in june and she knows that legally she can do whatever she wants(by candian law.)<<stupid law!!

    Just to add. If my son still wanted to go back to Canada at 16 and had his father or sister's homes to go to, I would have let him. On the other hand I think in my son's case, he would have been back to the U.S. in no time also. Trust me, he was a real pain at times in those 4 years. What baffled me was that he had more friends here in the U.S. than he did in Canada and his friends were over constantly hanging out or else they were out doing stuff. He seems to have settled down alot since the days of whining to go back.

  5. I wish I had some advice to offer you. When I brought my son here in June of 2002 (he was 11 1/2 at the time) he wanted to return to Canada, however it was not an option as he had no one to stay with in Canada. Two adult sisters living in Canada were unable to take him; his grandparents (my parents) said my son would never be happy living with them. I listened to him on and off for the next 4 years after that telling me he wanted to return and how much better it was in Canada. He had many friends here in the U.S. Taking him back for a visit for a month in the summer of 2005 didn't help even though the friends he had had in Canada before moving to the U.S. had moved on and weren't bothering with him. He went back in July of last year for a month and came back saying he had no desire to return to Canada to live and said it was time to move on with his life in the U.S.

    The suggestions of having your daughter wait it out until the summer is a good idea. I would also let her know what her options would be should she decide to return to Canada to stay as far as being able to return to the U.S. to live should she change her mind.

  6. I'm still waiting here just to get notification about fingerprinting. My application was sent in on July 25th to Nebraska. They claimed at the beginning of November that I owed more in fees which I didn't because my paperwork was received at their office on July 30th. I had the receipt showing paperwork sent July 25th. I then get a notice later in November that I don't owe the additional fees and I should hear soon about fingerprinting. This is so typical for me though. Ever since getting AOS interview in December 2002, there is always one problem or another and it's not me that has caused it. I've done everything I'm supposed to do.

    I just hope citizenship is completed before my son turns 18 in January 2009. :angry:

  7. Sent N400 on July 25 th.

    Received notice from Nebraska on November 1 stating I owed more in fees.

    A week later I sent a letter with copy of post office receipt showing that my package was post marked before the July 30th deadline

    Towards the end of November i received a letter back stating I didn't owe additional fees and within a short time would receive notice for fingerprinting.

    To date...nothing further received.

  8. I posted previously that I had received a notice from Nebraska Service Center stating I owed them more in fees. My application package had been postmarked July 25, 2007.

    I sent a letter to them with a copy of my USPS certified mail receipt showing the date of July 25.

    I got a letter from Nebraska stating I did not have to pay the additional fees since my package was dated before the new fee date of July 30.

    Thought I would share.

  9. We had exactly the same thing happening here when I moved down. My husband was out of the house during the day so didn't get the day calls and just didn't answer the land line at night unless he recognized the number. When I arrived though, they were calling almost every half hour! I was furious! No matter how many times I told them that I didn't know this woman, I didn't know where she lived, that we had had this number for a year (at that time) already and she did not live at this address, they kept telling me I must know her and that she owed them money.

    Finally, after about 2 years of this I found out about the No Call Directory and listed the number plus our two cell numbers with them. Blessed relief! The calls stopped within a few weeks and I only had one since then from her doctor's office with a reminder for her physical. They listened when I explained she didn't have this number any more and I had no idea where she lived.

    So, do list your number with the no call list https://www.donotcall.gov/default.aspx and then if they do persist on calling, you can file a complaint against them with the No Call List.

    We are on the No Call List however we still get the calls from the collectors. Only two companies have identified themselves right off the bat when they've called via the answering machine. I didn't realize that they didn't have the right to call too if you were registered on the No Call List. I'll get their numbers in future and report them.

  10. My husband's ex left him in 1999. We keep getting calls from debt collectors for her to this day. In the past I told a few that she hasn't lived here since 1999,she's moved to another State and no idea of her address in the other State. Just lately though, I finally gave them the name of the small company that she owns along with the phone number and address. I don't know how many collectors are after her. We're still getting the calls. I don't know if it's the same people or different ones. I have the answering machine on 24/7. I asked my husband to get a new number or an unlisted number but he's not doing anything about it.

  11. I wouldn't fight it and pay the extra $275. Attach a cover letter explaining the situation at the same time.

    Your's isn't the first where USCIS screwed up with petitions submitted before the fee increase that came back asking for more dough.

    I am the other person who got a letter back from Nebraska stating that I have to pay the extra $275 yet my package was postmarked July 25th and I have the receipt for it. There is no way on earth I would pay that extra $275 when it clearly states that you pay the old fee when your package has been postmarked before the 30th of July deadline.

    If you receive a rejected petition or application on the basis of improper fees, please do the following:

    1. Verify RECEIPT and POSTMARK date:

    As a reminder, I-485s filed by "Aliens Whose Priority Dates Were Current Under the July Visa Bulletin" and their associated I-765s and I-131s were subject to the OLD fees until August 17. They must have been received by USCIS by August 17, 2007. Note that the NEW fees apply to I-140 petitions, even if filed concurrently with an I-485/I-765/I-131 packet. I-140 petitions concurrently filed with above I-485s were subject to the NEW fees effective July 30th.

    All other applications or petitions are subject to the NEW FEES effective July 30th. These applications must be postmarked or entered into a courier service tracking system prior to July 30th for the old fees to apply.

    2. If it appears to be an improvident rejection, resubmit the original application/petition to the Service Center with a brightly colored cover sheet along with proof of timely delivery/postmark stating:

    ATTN: CRU SUPERVISOR - CASE IMPROPERLY REJECTED FOR FEES

    Enclose a cover letter detailing what fees were enclosed and what date the case was postmarked and/or received.

    This is the first time I've ever had a problem if you want to call it that with Nebraska. Usually it's been through my local office. Thanks. :thumbs:

  13. I sent my paperwork in on July 26, 2007 Express Mail through USPS. USPS issued me a receipt showing a date of July 26, 2007.

    Today I get a Notice of Action (I-797c) stating they (Nebraska) have suspended my application from processing for "Underpayment of Required Fee". I had sent in $400 to cover my application and biometric fees under the old fee schedule. They say I owe them $275.00 in addition to the $400 I had already sent.

    Ok it is my understanding (or am I wrong?) that as long as my package was postmarked before July 30th, I was still safe under the old fee schedule? I have my original receipt from USPS.

  14. We have a cat my hubby calls Squeaker who lives in our garage. She just had babies a few weeks ago. There's 4 little ones. They are so cute! Two of them have homes lined up already, and my hubby wants to keep one too ( like we need anymore cats with 6 in the house).

    As soon as the kittens are weaned and gone, we will try to get ahold of Squeaker and get her to the vets to be spayed. ( All our cats are Spayed/nuetured so no need to post how terrible I am to breed cats! cuz I don't! )

  15. I've just printed off the forms for citizenship tonight. Will work on them tomorrow morning and will send out tomorrow afternoon. It's more for my 16 year old son's sake than for mine. Got to get it in before the fee hike.
