Net value of any assets...i.e. a property can count, but only the value of it above the amount of any mortgage or liens against it.

    Minimum is 5x the income level...i.e. $5 in assets= $1 in income.

That's fine, but you need to be able to show that she will not become a public charge. Typically this means being able to ensure her basic needs and medical costs are covered. The biggest item is health insurance...this is going to cost quite a bit...I suggest start searching now.

Regarding my mother retirement.  can I put in the fact that she will bring cash to the state?! Let say the amount is in 6 figures buy a little bit less than 7 figures. Thats is her entire saving and assets. Will that be enough. Or the money have to be on my ends?!

Well...she hasnt posted any questions except if cursing at the rep will be held against her (asked and answered)

Multiple users have offered multiple times to help her with whatever it was she was trying to ask NVC- but I guess she doesnt need the help anymore.

Hi thanks for all the answer. They are very helpful.

My mom's denied visa was a tourist visa. She just left it alone because I came back to visit her that summer.

When you talk about "significant", how much is significan more. Twice, 3 times the amount of the guiline?! Like I said. I have houses that I still paying. Does it count as assets or count as loan I still owe the bank?!

Once more question. My mother is 71 and want to retire in the state. If I answer that does it hurt the outcome of the case? You know, to "sponsor someone that unable to work"

I do have some question I am not sure it is okay to ask here or make a new topic.

I know you do not have to give property proof if I meet the poverty guideline. I make way more than enough according to the newest USCIS guideline . However, if you were me would put the properties proof, stock, bonds, networth, bank account ect in the mix also. I still make payments on the 2 houses that I have, so realistically I dont own any property. I dont want to open that can of worm. Yes I do have some decent size saving but still it is not enough to cover the amount I owe the banks for the 2 houses.

Q: have you ever been denied visa?

6 years ago my mother visa had been denied because she forgot the date and never made it to the interview. When I answer YES, the reason box pop out, should I just write "forget to make it to the interview" ? Is that too weird/silly?!

Q: have you ever been in the military?

My mother was a major in the Army of Republic of Vietnam which is no longer exist after 1975 (Vietnam war), we move to Japan in 1976 and never come back. Since then we moved to 2 others countries. My mother only have a dog tag, 1 piece of paper that have her military ID on it and a few photos of her in army uniform. Is it very important to answer super truthful about this matter. Since the Republic Army is no longer exist. I think the answer NO would be much easier. Im not sure.

  4. Uscis only care about who comming 😂. If you leaving and she doesnt care to EVER come back then you dont have to do anything. I always suggest she at least get a 10 years because of emergency reason. You might need to go back because you desperately need medical treatment from the US and she can not come with you. Healthcare system in Southeast Asia countries are not always the best.

Your expectation of all the customer service agents being nice is a very high one.

People have good and bad days. Customer Service agents get bullied, berated, chewed up and spat out by many upset and frustrated filers seeking updates on their cases. So if they are direct in what they are explaining and tell you what may seem like them being a bit of a douche, then you can understand that their job is not an easy one.

If you call into the help line for "help" in answering questions on a form - one that I am sure came with a guide - then they would not be able to answer those questions for you and, as with many call centers, agents have an average handle time with each call.

You assumed they being "direct", you wasnt there to hear the difference between direct and rude; "tell you what may seem like" sounded assumed to me . Try to call that number around 1pm to see how long is the wait. There was time I was put on wait for 1hour ans 12 minutes, others time 20 to 45. If Im going here lying dont you think the admin who have at least 10 years experience would have caught it? I never said you say I yell at them. I was trying to tell you that I was not the one that give them the bad day, so i dont deserve to be treated as such. If you really read all my answers you would know that I tell everyone here that I read all the instructions I could find online a.k.a "The guide"

Regardless, I come here to seek resolution not senseless debate on subject that doesnt even matter. So unless you stick to my topic question, I sincerely ask you to leave my topic alone. I will stop respond to you after this to keep this topic from going down the wrong lane.

I thank you for your knowledge in the Customer service field.

  6. I think you should just relax and wait. Nothing is on fire, you are not here illegal, time is on ticking out 😁. You have lots of evidences and about your marriage, kids, jobs,.. ect. Most likely you will get approve. You also have a letter from them saying it was an error on their end. Proccessing time is always long especially now, with Trump policy rumors floating around. Just have to wait. Once you get your removal done. You can pretty much get on with your naturalization. Thing just take a little longer than you plan. If you live close to an USCIS field office, get an appointment, go see them in person. I find the people there are extremely helpful and very knowlegable. Google uscis appointment. I hope this help you feel better.

I know right, certainly. Ive doing the citizenship paperwork for myself before and never encounting anything like such. I learn new things everyday. I dont even have problem with DMV clerks like most my coworkers complaint about. I would think, if I wait over 45 minutes to get a call, I hope I can get at least 5-10 minutes with them.

You wasnt at there when this happen so please dont make assumption. We all been frustrated, that is not an excuse. They might be yelled at by other people but not by me. It was so very stupid of me to say what I said however it not like I purposely call them, wait 45 minutes to just call them the B word.

Please I need input on my topic not a lesson on how to behave. Thank you very much for taking your time to read and reply.

Also, just be careful in the future. This process is long and stressful and probably everyone who has gone through it has had their moment of screaming and yelling at the computer screen. Losing your temper and insulting an anonymous call center operator is one thing, but if you were to do the same thing with a consular officer, the outcome would be VERY different.

I still dont think it was an anonymous phone call because they have all my info. But will sure learn from this experience.

So which number did you call exactly? The number to call USCIS is 800-375-5283, so I'm not sure you actually talked to a USCIS representative.

Their number is 6033340700. I dont thjnk they are the same as USCIS. I only talked to USCIS agent in person a few time in their field office. As far as they told me, they are not representative, they are actually interview officers who review cases and paperworks. You can make appointment online anytime to come in.

If you need help hire an attny or post your questions here on visajourney. As explained in prior posts USCIS/NVC can NOT provide legal advice- that means they can not help you fill out the forms/explain what things mean/advise you on how to answer besides saying to answer honestly and correctly etc. I dont know what kind of help you got previously in person but it must not have been considered legal help and apparently the questions you are now asking are.

The customer service numbers can give you the same information you can find using your online case account. They can tell you the case status, give you any posted updates etc. Its basically for people who dont have internet access or prefer phone system/live help.

I might confuse between legal advise and general information question. They usually tell me nicely if they can or can not help. These agents must have done this a thoundsand times, it is my first time to apply for a visa and probably last. I never thought I would depend on them to fill out my file. A little compassion would go along way. But then again I should let my emotion get the best of me in this case. It could potentialy hurt the outcome of the situation. 😔😔

The people you were talking to work in a call center they have very little knowledge of the systems and work off of scripts to answer the questions they are not experts in the process and are not allowed to give info on the forms. They have guidelines they have to use and I am sure there is a limited amount of time they can spend on each call. They do not have the ability to put things in your file and should not be able to hold anything against you. They are low man on the totem pole and have minimal access to the info that in in the computer system.

No it should not hurt your case.

They cannot provide answers to any questions on the forms...they are prohibited from providing any sort of legal advic.

Can you please tell me what is the real purpose of their helpline? The one that open from 7am to midnight? Usually, when I have question about any file I130, Affidavit of Support, etc I always make appointment with the USCIS field office and they always will the help me sort everything out or even review my file before I submit. I have to drive 5 hours to their field office but Im willing to do the drive. Visa center doesnt even have a physical address.  I dont have much problem with legal advice either, mostly are some wording question seem very confusion to me, that is all.

  12. Hi, I dont even know this topic is appropriate or not but I feel pretty restless for the last 4 days. Yet also feel stupid to ask such question. Please bear with me and my English.

I argued with a "visa center phone agent" (the 0700 number) and pretty much call her the B word. How extremely stupid of me. Now what?! Can she hold that against my file? Will she be able to mark my case in someway and make it harder for my parent to obtain the visa? My mother is in a difference country right now.

Im applying immigrant visa for my mother to come to the US to live with me. 4 days ago I called the visa helpline to ask their opinion about some details on the application. The woman on the phone was very mean and unpleasant right off the bat. She is very condescending and keep repeating the fact that she can not fill out the form for me before she even heard my questions. Mind you, the form have over 50 questions and I asked her less than 5. We went back and forth, with me being as nice as I can be because I understand the fact that they have the knowledge.  Eventually (about 10 minutes later), she told me she can only answer 1 more question as if there is a guideline somewhere said Im only allowed so many questions. I was so fed up and angry, I did a stupid thing, called her the B word right before I hungup.

I really need input from anyone at all have a experience as such.

Please be kind and understand the fact that I know it unwise of me.

The process have been very hard and lengthy. I have read and researched all the information I could find for days. So what I asked her wasnt some dumb questions. Hence why I was so frustrated. It pretty much wasnt what she said but how she said it.

Thank you very much. Im sorry and Please delete if my topic is not appropriate. Im desperated as I dont know where else to ask about this issue.

  13. I filed I 130 for both my parents at the same time. I sent both their files in the same mail package. I packed my mother's file in 1 separated Manila envelop with my mother's name outside, same thing with my father's file. I take both envelops placed them inside a bigger Manila envelop, sealed and sent it to the appropriate address.

An USCIS consultant at a field office in Kansas City advised me to do this to ensure my parents'case being processed at the same time.

However I recently only receive a Notice of Action only states my mother's name. It'd been 3 weeks now, and I haven't receive anything for my father at all.

Have anyone been into this situation. Please help I'm so worry.
