I have an immediate relative that is already living with us on a B2 visa (expired but they stayed in US) and we are applying for i130 and i485 adjustment of status. For city and country of residence, do I put where they live now (United States) or where they are from (Algeria)?
thank you

Yeah no job in US, she just wants to be here for the birth and help my wife recover for a couple months

If she is given less time to stay at point of entry, you can apply for an extension of that time period once she is here in the US. It's not uncommon, especially if she's retired / at retirement age, for people to stay for extended periods.
Thanks! We want her here for the birth of our child and also a birthday in April.

Ultimately, length of stay will be determined by CBP agent at airport.
So we don’t buy a return flight until she arrives? I’m just wondering what our options are if we already have the return flight
Also, does she need to go back to the consulate or just arrive and talk to a CBP

And something you have not considered is that 6 months is the longest she can be granted, but the actual length is set at the CBP agent's discretion.
So if we already have a ticket bought we have to change it?

It could look like she is trying to bypass the queue for a visa by coming over to adjust status. It is not a good idea to ever lie at the border.
If she wants to move here, do it the right way and petition her.
If she genuinely wants to visit, she will need to show strong ties to Morocco so that they believe she will leave the US on time.
She’s not going to lie, we genuinely want her here for the full 180 days then return.
For strong ties to Morocco can we use husband/son/family? Or would a job be better?

MIL has a 10 year tourist visa that expires in 2029.
She came back in 2019 for 2.5 months.
We are trying to have her stay for the full 6 months/180 days this time.
She is coming from Morocco to USA, she is vaccinated and will produce a (hopefully) negative test as well.
Are there any issues we will face that I am not aware of?
Thank you.

One last question. The 751 form on the uscis website says it expires 12/31/2019. Can I still use that?
Thank you everyone for your answers!

Also is the N/A supposed to be in all the fields or just the first one?

1. Yes. Provide both numbers if one has.
2. Use N/A or None as applicable.
3. Use the current name and include evidence of name change.4. Petition plus biometrics fees to be sent at the same time.
Thanks man. What if we can’t find the old uscis number?
Can I include two separate checks or should they be together?

Hello,
My wife and I have started the process for her i751. I have a few questions though:
1. Is the USCIS number they’re asking for the same one we used for her i130 petition 2 years ago? Also, should we include SS# AND A# together or is just one enough?
2. I see inconsistent answers on this, do we leave unnecessary spaces blank or put N/A?
3. We recently changed our child’s name via court. On the form do we put his original name(on birth certificate) or the updated one and attach the court ordered name change.
4. I have the 595$ check, but the 85$ biometrics fee is payed now or later?
Thanks all!

My bad, phone was acting up.
Also will there be a translator for her (Arabic), she doesn’t speak any English?

Besides her passport and visa, does she need to bring anything else to the airport? She needed her marriage certificate and birth certificate to her interview, will the CBP officer require those documents too when she lands in the US? Please let me know.

One last question, DS-160 says April 20-June 20. But the only flights we can find are from April 17-June 16. Is that Ok?

It seems I have my answer. Thank you!

She can stay for as long as the CBP officers permits, which is usually up to 6 months but can differ.
I would not suggest starting off staying longer than was stated to the the CO when obtaining the visa. It can result in the visa being revoked if the CO believes she was not honest during the interview.
The CO did not ask her how long she was staying during her interview. If she goes for the original 2 months can she come back for another visit that’s longer (3-4 months)?

Hello all!
My mother in law in Morocco recently got approved for a tourist visa to come to the United States. It is a 10 year visa. How long can she stay in the United States? I’ve read that it can be up to 6 months. However, in her DS-160 she said she would visit for only 2 months. Is it ok if she stays for 3-4 months? Or will the CBP officer deny her at the Port of Entry? Please let me know as I’d like to book her flight ASAP.
Thank you.

No need for any letter of invitation from you or proof of your income. The relevant information on her DS-160 will be enough. US Department of State says:
Visa applicants must qualify on the basis of the applicant's residence and ties abroad, rather than assurances from U.S. family and friends. A letter of invitation or Affidavit of Support is not needed to apply for a visitor visa. If you choose to bring a letter of invitation or Affidavit of Support to your interview, please remember it is not one of the factors used in determining whether to issue or deny the visa.

Thank you.

I appreciate everyone’s help

Also I said I would be supporting/paying for her trip in the ds160, would she need proof of my income? I can scan my w2 to send to her for the interview.
-
Would a letter of invitation be needed in Arabic or in English? My MIL doesn’t speak English so I was thinking to send it in Arabic then have her translate it for the interview?
Also so she doesn’t need any doctors examination correct? In regards to vaccinations...

Anyone?

She is asked all of the in the DS-160. That is it. She can bring those documents but they won't be looked at.
Take a search of the tourist visa post from members here. The interview usually last 5 - 10 minutes. Documentation is rarely asked for. Many even believe the decision is made prior to the interview and the face to face interview is a formality.
However, she can still bring all of those items just in case. Remember, they focus on why the applicant needs to return to their country, not why they want to come to the USA.
Correct me if I’m wrong, but there was no section for “children in home country”. It only asked for her parents, spouse, and immediate family in the US (my wife/her daughter).

She has a spouse and kid in Morocco. How does she go about proving that, photos? Marriage certificate? Will documents need to be translated into English?
