    Yea yall hang in there. The wait is the hardest part.

     

    As soon as your husband holds the visa in his hands, he can theoretically go straight to the airport.

    To my knowlage he should unregister in Switzerland before he leaves (because of taxes and millitary and so on).

    Thats what im about to do. I dont think it will take long.

    We have been married for about 1.5 years and we do have a son. I will be moving back to VA this summer to resume my job. Obviously my husband and I will be going back and forth between Switzerland and USA. 

    If your husband is Swiss-citizen or Swiss-Resident, he will go to the Embassy in Bern.

    After everything is finished ofc...

    Here how it was for me, (i just got my visa this last week 11.04.2019.)

     

    USCIS (i130&I130a + proof + fee) (took about 7 months to get NOA2.)

    After that everything will be sent over to NVC. (took about 1 month) 

     

    NVC (DS260 & i864 or i864ez + a couple of documents like IRS Transcript and others + 2x fee) (takes about 1-2 months)

    After that everything gets sent over to Embassy and they will give you both a date when your husband can come in for the interview. (took about 3-4 weeks)

     

    Your husband will have to scheudle a Medical Checkup by a approved Doctor before he goes to the interview. (either in Bern, Zürich or Geneva). (This will cost something too ofc...)

    From the interview date email to the interview itself it took about 3 weeks.

     

    After the interview it took 2 days until my passport could be picked up at the embassy. But they also offer to send it to you per mail, if you bring a envelope incl. stamps.

    Oh im pretty sure you will have some good news very soon too. According to your timeline something should be happening in the coming weeks. But im sure you already know this. :D

    I got a kinda offtopic question. Was werdet ihr mit all deinen grösseren Sachen machen in Österreich? Oder besser gesagt wie nimmst/sendest du sie rüber?

    I know what's required and that's what i did bring. See the thing is we are doing CR-1 and you did K-1. It might have been different for you.

     

    Note: Evidence of a Bonifide Marriage 
    The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:
    1. Documentation showing joint ownership or property; or
    2. A lease showing joint tenancy of a common residence; or
    3. Documentation showing co-mingling of financialresources; or
    4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
    5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or
    6.

    Any other relevant documentation to establish that there is an ongoing marital union.    ;)

    Im not sure if i understand your answer right.

    We are talking a couple of hundert printouts. Ofc i could have just sent it all over per messenger or even per mail. Now we just did it that way. Meaning i did bring all those printouts already printed out with me. I am aware that this was probably not the smartest way to do it.

    You are right. But what about the evidence of a bonafide relationship? I had to get pictures, conversations, letters and so on. We had planed for me to come back anyways, to spend time together. So it was easyer for us this way than me sending all the stuff over. Is all that stuff not a requirement to send off in the I-130 packet? If not then now im just confused. :D

    If not, it could be held against you as in reality you visited your wife, however, if they did not ask directly, you would be most properly alright.

     

    They want to see ties to your home country when you visit, this is what they mean as documentation.

    If you mention in May that you visit your wife, and that you filled the I-130 it could be that you are ok, as now they know

    why you spend so much time in the US. You are from Switzerland, together with Austria , Scandinavia, Canada and Australia one of the best developed countries in the world. I think you can give it a shot if you prepare yourself well and bring enough ties to your home country with you.

    I didnt mention it. Which now afterwerts in my opinion was stupid.

    The reason i didnt was i was trying to go tru the easy way without allot of questions just like i did in the past and all went fine.

    My story was not a lie. I did visit with friends. I collected proof of that as well.

    But like you said they also didnt ask me directly. They where more interested in my "red eyes" than in anything else i was telling them.

    If im coming back in may, i will mention it and i will also prepare myself with allot of evidence and proof that i intend to go back home.

    No. I dont work while im in the states. I would not know where to start here anyways, plus i know thats not legal and im not even going there. And i cant do work for clients back in Switzerland while im here, since i  mostly work hardware.

    I forgot to mention, we didnt send off I-130 yet, since i had to go back home to collect all evidence of a bonafide relationship.. But we are doing it now on my stay. This is also a reason why i came back to the states to do this together with my wife and ofc to spend as much time as possible with her.

    I freelance IT Support.  It sure looks like i spend more time in the states, but fact is i aint. i stayed 10 weeks in the states so  approx. 70days  after that i stayed over 100 days back at home.

    so i wanted to share my story.

    My wife and I got married last year in july, after i stayed for 10 weeks.

    At end of November i came back to the states and i was asked how long i want to stay. I told him 10 weeks.

    I got asked why 10 weeks? What will you do? and so on. I told him for vacation, where i will visit friends and the trips we have planned.  And the reason why 10 weeks i told him, because i am allowed to stay up to 90days and i would like to stay as long as i can afford. So I answered all questions truthfully. Then i got asked are you high? Since according to the officer i had red eyes...

    I told him no i am not. He didnt believe me and sent me to another officer. This one asked me are you on alcohol? (i was thinking, wth?)

    Anyways i told him everything again. He was very unfriendly and didnt believe me either i guess. So i recieved a Yellow envelope and had to go to an office with it.

    After a short wait a 3rd officer called me up and told me the reason why im in here is because i wanted to stay 10 weeks.  He was friendly. Nothing about intoxicated or anything like that.

    He told me he will let me in, but i should not come back till next november, except i got documentation for my stay, or a emergency or for buisness.

    After i showed him my backflight ticket he stamped my passport and i was free to go.

    Im not sure what they mean with documentation.

    I would like to come back this comming may. But i am scarred now.

    Another thing about this new 90 days rule you mentioned in another post geowrian.

     

    This confused me a bit. Is this something i have to worry about?

     

    AOS isn't a visa. :P It's handled by USCIS. Visas are handled by the embassies, which are under DOS.

     

    The new rule regarding preconceived intent is a DOS rule, and is not adopted by USCIS at this time (and doing so would be difficult due to past court cases). Technically, due to this change, going for a CR-1 visa after marrying within 90 days would be more difficult now. Some background info for others not familiar with the change:

  14. Hello everyone,

     

    First of thank you all for this forum. I already learned some things i didnt know about.

     

    To my Story:

    My Wife (U.S Citizen) & I (Swiss Citizen) are since almost 8 years in a relationship. I go over to visit her every summer and sometimes in winter. Long story short, as often as we can afford. I visited 9 times so far, and this comming winter will be the 10th time. I mostly stay 10 Weeks +/-. Never over 90days.

     

    This past summer we got married shortly before i went back to Switzerland. We where thinking thats the right thing to do, and then file CR-1. But after reading here a bit, now im just confused.

     

    We didnt send anything in yet, but are filling out i130 & i130a, g1145, & gathering evidence (pictures, tickets & all that).

     

    Is this the right thing to do?

    Or would it have been better, if i just would have stayed and did AOS?

     

    I hope someone of you guys can help me with some advice.
