  2. hi Attorney,
    It has been a month since my last service request on my I-765 and there has been no response from USCIS. Today marks 162 days since USCIS received the case.
    Also the Visa bulletin dates for filing are moving at fast pace. Why is USCIS moving those dates faster when they still have to process the pending I-485, I-765 and I-131 cases filed since Oct 2017.
     
    I have had no communication from USCIS since I completed my Biometrics appointment on Nov 2, 2017. Do we need to contact a senator/congressmen etc.?
     
    I am in the process of purchasing a house in Jacksonville, FL but will be changing my address end of June, 2018. I will let you know if I close on the house to change the address at that time.

    USCIS doesn’t move the Visa Bulletin dates.  The Department of State handles immigrant visa issuance and priority dates based on inventory of pending cases and the formula they apply.  The goal is to allow for some visa usage each month without making the categories oversubscribed and unavailable.

     

    The “earliest filing date” exists and is moved forward faster merely to allow people to get an EAD and Advance parole with the Adjustment of status filing, as a benefit of filing.

     

    With the current reported delays of one year to interview, the I-485 interview could take another SIX months.  I expect to hear on your interview appointment date by September, for an October interview, if the below continues to be accurate and times don’t get any slower.  You can check for  the periodic updates to this page and select Jacksonville Field Office processing dates:

    Thank you for the information.
    Is it too late to opt for consular processing?
    People with the same priority dates as mine (March 2016) have got their Immigrant Visas issued by consulates in other countries.
     
    It seems that going for AOS is not a benefit but a disadvantage to applicants who are already in USA.

    It is another completely different legal process to switch the processing and ask for the file to be sent overseas now if you want to consular process. Besides the expense of travel, new filing fees of $1000+ and legal fees of $3,000, you will re-do the medical exam and set your process back possibly a year. It’s better to wait it out.

     

    There are benefits to both types of processes.  The state department does regulate how fast you can apply for an immigrant visa but the limit is a year usually before the visa is expected to be current, so not as strictly as USCIS. For someone here without an H-1B, say an F-1 student, the ability to get a work permit may be a very big deal. USCIS isn’t interested in the fastest processing times any longer.  Things have slowed down considerably at Immigration since Mr. Trump took office.

    Dude. We all are trying to keep up the spirits of each other. Again welcome to the group. And no F2AOct is also an active member on other forums (like everyone else) and even I saw that post on other forums where someone was indeed approved.

    lets not forget the amount of AOS EAD and AP applications they would have received in 1st week of Oct. Probably more than entire month's worth of application they would have received in Sep or August would have come only on 1st week of Oct.

    I am guessing another month before I hear something.

    I contacted my local congressman and he said the USCIS is processing cases as of June 2017. So why the hell does the processing dates say Oct 1?? And also, I've been reading other forums where USCIS is telling them they are processing cases as of September 2017. AHHHH this is soooo frustrating!!! :ranting:

    March Visa bulletin moved some filing dates, lets see if they are valid and USCIS started accepting the early filers again. If yes, then it means that they should be working on our cases

    Lets not get Carried away ! USCIS is even worse than DMV. Atleast at DMV we don't go with high expectations. From now on, I don't have any expectations. there are plenty of better opportunities out there, but without an EAD card its all futile.

    I guess, I will have to wait it out.
