    my USC fiance owns a business in the philippines..that was his previous employment but it still exists until now. he has a current job right now in the US...does he need to get income tax return/bank statements or anything eventhough it is in the phil? or just income tax returns/ bank statements to his present job is ok?

Wer'e going to be in Argentina next week, so a Portuguese-to-English translation might be difficult to come by...

    No, it's not needed. We don't know exactly why I got an RFE for it, but it happens sometimes. Nobody here is saying you have to send it in right away.

    I know you guys are just about to file, so what I would do is just file and if you get an RFE, you get one. But that's just what I would do.

    If you read through the thread, you'll see that although it's not a requirement as per the instructions, you might or might not get an RFE for the beneficiary's birth certificate + translation into English. It's not usual to get an RFE for that as it's been in the past, but it can happen.

    Who is 'they'?

    The question asks for your employment. Write down your employment. They're not going to do anything with this anyway - your employment and employment history is going to matter only when the consulate is considering if your fiancee meets the public charge provisions of the law. Unless, perhaps, you spent some time working for the KGB or the bin Laden's construction company.

    Don't get into the habit of providing information that isn't asked for, particularly don't emphasize information that points out potential weaknesses.

    in the G325A form...they said that do not leave gaps in the employment for the last 5yrs....

    what i did was...placed all the employed ones on the given space in the form & then made an attachement and listed all the employed & unemployed ones in chronological order... would that be ok?

    thank you...so it's ok to leave gaps in the employment status right? all is asked for is the time when you are employed...no need to place the unemployed ones,right?

    If you're unemployed and you feel it's best not to leave gaps, you can correct it by filling out another form. Alternatively, have an attachment with all the timeline with not gaps; cross over the answers given that were not complete, write "See attachment". The attachment would be linked to the questions (write that on the top), signed and dated. Have 4 attachments, as you'd send 4 pages of the G325A.

    Name & add of employer occupation date

    None july 2006 PRESENT

    John Smith..49ave.... caregiver may 2006 june 2006

    Joseph Hope..69...st secretary oct 2004 sept 2005

    look at the date? there is no sept 2005 - may 2006 employment - meaning...unemployed...

    can i not write the unemployed ones?

    can i write it just like that?

    dont stress too much over it .. as long as you have everything in the right order and everything is signed and you have triple checked each page you are sending everything will be fine for you...

    or should i just re-type everything - in chronological order?

    My fiance and i simply wrote in the box "see attachment" and then attached an excel spreadsheet with all his work history in chronological order. :)

    Sure, an attachment will be OK.

    what i mean is... all dates of employment are in the box & all the unemployed are in the attachment..

    would that be fine? some are dated 2004 in the box & some 2005 are in the attachment???

    If you haven't even sent the form in, why don't you just do it right the first time? I'm confused. Those forms are downloadable from the USCIS.gov website. Why don't you just do it again? :huh:

  12. No. Financial support is the responsibility of the US citizen. You'll get an I-134 from your Fiancee after she receives approval here in the states (NOA2). US wants to know that you will not become a "Public Charge" and that's the responsibility of your American Fiancee.

    Your having a job is not an issue for the K-1 petition. USCIS could care less if you're working or not. The USCIS is trying to make certain what happens when you move here to the states is good for all involved. And that falls into the lap of your Fiancee, not you.

    Maybe there's something here that I don't understand. The USC filed the K-1 petition and they are responsible for your welfare when you arrive here to live. If you want to get a job, then go ahead. It's OK!

    i am allowed to stay here in canada until MAY'07....can my interview be held here in vancouver eventhough i don't have any work? or will i be sent back to the philippines (my home country) for the interview?

    in the I-129F, we requested that the interview be held here in vancouver....

  14. i read that one of the reasons why there are rfe's is because of leaving gaps during the employment phase?

    is that so?

    i worked during the year of 2003 & then went to training school on 2004 & went to work again 2005. will i write the 2004 - unemployed? or just write the 2003 & 2005 till 2006 as employment status?

    If you are legally allowed to remain in Canada, working or not, until May07, the Consulates in Canada should still take your case. Did you indicate in the petition that you'd like to interview in Canada?

    We did a 3rd country interview.

    All the information you need to file is on the Petitioner. Unless you have been married before. If you have everything listed in the Guide you should be good to go. There will be more stuff to gather later in Consulate stage that will be help in the Philippines

    Your country of permanent legal residence will have jurisdiction....

    Let me clarify my answer... you can request the consulate/embassy where you currently reside but there is no guaranty and therefore no obligation for that consulate/embassy to accept your case. No harm in requesting on your i-129f form.

  17. hi everyone! we're just new here so could anyone please please help....

    my USC fiance & i is almost done gathering all documents needed for our I-129F. we have a lot of concerns here...

    i'm gonna start by telling you a bit of our history... :yes:

    russell is born in the united states but studied in the philippines. he goes to the US every now & then but for just months. after studying... he managed to start up a business & it is still on going right now.

    our relationship started back in 2004...we were engaged in 2005. & then...on may 2006 - my working visa as a LIVE-IN CAREGIVER to ontario,canada was approved. so i have to come here to canada to work. he accompanied me & then went straight to the US. he is now working but only for months..

    after a month...my work back in ontario was a disaster so i opted to go here in vancouver in search for a job. but until now...3 months of searching...i don't have any luck but still trying to find one. several interviews was conducted but still...no work!

    and because of all the hardships that we are going through - of being apart, we are now in the process of filing an I-129F petition. he went here last september'06 to visit me & let me sign documents for his petition.

    we gathered all the documents listed on the GUIDE here... very nervous because we might have forgotten somethings or it may not be approved...

    help us please... & now that i'm not employed here in canada...will there be chances of denial? my work permit is until may'07...will i be sent back to the philippines (my home country) for the interview or can i take it here in vancouver?
