  1. Are these all the documents I need from co-sponsor? (my fiance just started working recently so havent payed taxes yet or make the necessary income) .

     

    Taken from an old thread:

     

    Past 3 years Tax returns (Photo copy of 1040+W2 and/or 1099) OR Past 3 years IRS Tax Transcripts which can be ordered for FREE here: https://www.irs.gov/individuals/get-transcript (takes about a week to arrive) or can be obtained at the IRS office but might take a couple of hours there.

    -Employer letter, (Basically, your employer letter should state "To whom it may concern: (first name,last name) has been employed full-time with the XYZ Company since 200_ as a (name of your job), and is an employee in good standing with an annual salary of $XXXX. Signed, John Doe, Supervisor (or whatever title)" The letter should be on company letterhead.)

    -Recent pay stubs going back at least a couple of months.

  2. Hello, I was reading around the forum and I saw somebody saying that now its required to fill something new called 130A, do I need to fill this new form? (Im getting married to a USC on the visa waiver program and adjusting my status). 

     

    I'm opening a thread because in the aos guide doesnt mention anything about it yet.

  3. In the adjustment of status guide:

    1. Documentation showing joint ownership or property; or
    2. A lease showing joint tenancy of a common residence; or
    3. Documentation showing co-mingling of financialresources; or
    4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or
    5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and details explaining how the person acquired his or herknowledge of your marriage); or

     

     

     

    Any other relevant documentation to establish that thereis an ongoing marital union.

     

    So I was wondering if its really needed to include too many proofs in the package or its more important for the interview? She just started working recently so she has never payed taxes and her dad is going to be our affidavit co-sponsor, we are going to live in their home for a couple of months, so we dont have such a thing as leash, rent etc together yet. We are definetely going to have way more proofs for the interview but by the time we get married, all we are going to be able to have is the joint bank account together and lots of pictures together. Is this enough for the package? Or could this be a reason for denial?

  5. I was wondering what is going to be the price of the medical examination for the aos? I have a paper from spain's hospital with all the vaccines signed by my doctor. Do I still have to get vaccines here? How much is the whole medical stuff going to cost for the AOS package? 
    And  I was wondering if somebody knew about a good/cheap surgeon around Flagler/Daytona/StAugustine/Jacksonville?

  6. When filling the I-485, if Im applying for AOS while Im here on the visa waiver program ESTA after getting married to my USC girlfriend, 

     

    What is my current USCIS status?

     

    And which one of this options should I check? 

     

    a)An immigrant petition giving me an immediately available immigrant visa number that has been approved. (Attach a copy of the approval notice, or a relative, special immigrant juvenile, or special immigrant military visa petition filed with this application that will give you an immediately available visa number, if approved.)

     

    b)My spouse or parent applied for adjustment of status or was granted lawful permanent residence in an immigrant visa category that allows derivative status for spouses and children.

     

    c)I entered as a K-1 fiancé(e) of a U.S. citizen whom I married within 90 days of entry, or I am the K-2 child of such a fiancé(e). (Attach a copy of the fiancé(e) petition approval notice and the marriage certificate.)

     

    d)I was granted asylum or derivative asylum status as the spouse or child of a person granted asylum and am eligible for adjustment.

     

    e)I am a native or citizen of Cuba admitted or paroled into the United States after January 1, 1959, and thereafter have been physically present in the United States for at least 1 year

     

    f)I am the husband, wife, or minor unmarried child of a Cuban described above in (e), and I am residing with that person, and was admitted or paroled into the United States after January 1, 1959, and thereafter have been physically present in the United States for at least 1 year.

     

    g)I have continuously resided in the United States since before January 1, 1972

     

    h)Other basis of eligibility. Explain (for example, I was admitted as a refugee, my status has not been terminated, and I have been physically present in the United States for 1 year after admission). If additional space is needed, see Page 2 of the instructions.

     

     

  7. We are going to wait a couple of weeks just in case. I have got my birth certificate and the birth certificate translated sent and will be reciving it soon. I'm now reading the guides all over to make no mistake when it comes to send the package.

     

    Are there any tips you guys want to share, things I should keep in mind or something?

Guys the border patrol never asked me about my relationship or intentions, just simply what was the purpose of my travel, I said I was visiting my girlfriend, and then after he checked I was here a while ago for 3 months he started to be rude saying he didnt like me and I was abusing my ESTA by travelling and staying too long and I was just trying to stay ilegally and all kind of dumb #######. Never had intentions or plans to get married. We had talked about getting married in the past and considered it an option if nothing else worked out to be together, but it wasnt a plan or whole purpose of the travel. So had no intention and no lies were told in the airport.

    Non the less the agent warned him that he would track him.  You know this agent entered notes into the system.  I was just saying what I would do.  I always err on the side of caution.  Nothing wrong with a little good old fashioned caution.

  10. Im pretty anxious already so I will make sure to send everything right the day after of my wedding haha. I spoke to a lawyer through the phone and he adviced me to get married after 70 days of my arrival. So I will get married around the 70 day, the 71 day I will go to the uscis to get the forms, file them and ask them for help to fill them if needed, and send everything the 72-73 day. Will this be fast and safe enough? Thank you for the help :)

  11. Sorry what I meant is that they never asked about my relationship or if I had intentions to get married and stay (which I didnt have back then).

     

    We have been dating for 2 years on the distance, we met one time before and spent 3 beautiful and perfect months together and this is our second time together and we dont want to go through the distance anymore. We have endless amounts of conversations on facebook, skype, texts, we have hundreds and hundreds pictures together, with her family, in theme parks and all kind of situations and places so I believe there is no way nobody will doubt or relationship. Our only concern is ice knocking the door while Im adjusting status or something bad like deportation happening because lately things are pretty messy with the whole immigration subject

  12. Hello everybody, I have been reading the guides and now I kind of know what I have to do and how, but I have some concerns about this whole situation, so now Im going to write down my history so maybe you guys can guide me a little.

     

    I entered the country around a month ago and when I entered, the border agent started to question my intentions, he never sent me to another room or checked my things, nothing like that. He just asked me how long I was going to stay and he automatically said he didnt like me because I was spending too much time in the country and said I was abusing my ESTA by travelling too much, he said he would send me back home and revoke the esta, but at the end for some reason he called another agent who asked me if I was a student, had a job and what I Was going to do here. I said I was visiting my girlfriend and Im a university student. Then the first agent, gave me back  my passport and said "welcome, enjoy it, I will keep you tracked though" . I dont know if it all was just to scare me since they never sent me to another room or asked more questions but Im still kind of scared.

    I never got questioned about my relationship or intentions to marry her.

    Its been a month and we never planed it, but my girlfriend (who is a us citizen) and I want to get married and want to stay together. So we are thinking about getting married and applying for the aos.

     

    Is this a risky process? Could I be deported for doing this even if my intention was never to do it? We just cant handle being apart anymore, the distance is so hard and after the first time we met, it felt even harder, we dont want to go throught it all over again.
